I. GENERAL RFP INFORMATION A. Purpse and Backgrund Purpse The purpse f this Request fr Prpsal (RFP) is t prvide infrmatin t engineering prfessinals which will allw them t submit qualificatins t cnduct engineering cnsultant services fr the Lehigh Valley Ecnmic Develpment Crpratin (LVEDC) thrugh United States Envirnmental Prtectin Agency (EPA) Brwnfields Assessment grants. This prject is in partnership with the Green Knights Ecnmic Develpment Crpratin (GKEDC). The required engineering cnsulting and technical assistance wrk t be cnducted under this RFP includes the fllwing: Bundary, tpgraphic, and existing feature surveys. Subdivisin plans required t divide the single large tract int 4-5 smaller lts fr sale and transfer as a small industrial park. Design f infrastructure required t serve the lts including radway, water, sanitary sewer, strm sewer, electric, etc. Analysis f three existing warehuse buildings n the site t determine 1) what imprvements (if any) are required in rder t reuse/repurpse these structures fr cmmercial/industrial reuse and 2) estimated csts f such imprvements. Plans required fr regulatry apprvals and permitting including but nt limited t traffic studies, municipal land develpment planning apprvals, strm water management plans, ersin and sedimentatin plans, etc. This task als includes preparing applicatins and attending municipal meetings n behalf f the prject as required. All questins submitted prir t the pre-prpsal meeting, as well as questins submitted at the preprpsal meeting itself, will be addressed at the meeting. Any questins nt answered at the meeting will be answered in a written addendum that will be prvided t all firms wh attended the pre-prpsal meeting. In rder that all firms have the same infrmatin fr preparing their qualificatins, an addendum t the RFP will be prepared that addresses all f the questins received by the abve date and time, and then will be distributed t all the participating firms at that time and psted t LVEDC s website. Frm f Cntract LVEDC will select the firm(s) that will be ffered the cntract assciated with this RFP. The selected firm(s) must enter int a Cntract fr Prfessinal Services with the Lehigh Valley Ecnmic Develpment Crpratin (LVEDC). H. Payment This will be an hurly fee cntract with a nt-t-exceed maximum cap f $100,000. Payments will be made in mnthly installments, based n perfrmance, with ten percent (10%) retained t be released upn cmpletin f assigned services. Payments will be made up t 60 days after date f invice. I. Insurance Requirements The cnsultant will need t maintain adequate public liability, prperty damage, malpractice, and wrkers cmpensatin insurances, insuring as they may appear in the interest f all parties t the cntract. Certificatin f this insurance must be submitted t LVEDC at the time f the executin f the cntract. LVEDC must be listed as an additinal insured n certificates f insurance prvided. 6
The fllwing insurance prvisins are required: 1. Wrkers Cmpensatin Insurance fully cvering all persns wrking under this cntract, including emplyees f the Wrking Parties and any subcntractrs, in accrdance with the laws f Pennsylvania; and 2. Emplyer s Liability with minimum insurance f $500,000 per ccurrence; and 3. Cmmercial General Liability with minimum insurance requirements cvering bdily injury (including death) and prperty damage in an amunt nt less than $2,000,000 per ccurrence cmbined single limit n all peratins fr bdily injury and prperty damage arising ut f said peratin; and 4. Cmmercial Autmbile Liability Insurance cverage in an amunt nt less than $2,000,000 per ccurrence cmbined single limit fr bdily injury and prperty damage liability; and 5. Participatin by Minrity-Owned and Wman-Owned Business Enterprises LVEDC is cmmitted t prviding access and pprtunities fr minrity-wned and wman-wned business enterprises (MBE and WBE, respectively). EPA's DBE Prgram is primarily based n tw statutes. Public Law 102 389, 42 U.S.C. 4370d, prvides fr an 8% bjective fr awarding cntracts under EPA financial assistance agreements t business cncerns r ther rganizatins wned r cntrlled by scially and ecnmically disadvantaged individuals, including HBCUs and wmen ( EPA's 8% statute ). Title X f the Clean Air Act Amendments f 1990, 42 U.S.C. 7601 nte, prvides fr a 10% bjective fr awarding cntracts under EPA financial assistance agreements fr research relating t such amendments t business cncerns r ther rganizatins wned and cntrlled by scially and ecnmically disadvantaged individuals ( EPA's 10% statute ). The specific level f participatin shuld be indicated, if applicable. The cnsultant awarded the cntract thrugh this RFP will als need t indicate their intent t take the affirmative steps listed in 40 CFR 31.36 fr subcntracted services. K. Other Requirements and Infrmatin It is expected that the cst f attending meetings with LVEDC and its partners representatives fr the purpses f crdinatin and infrmatin gathering will be included within the scpe f the prject. Respnse and resulting cntract, if awarded, must cnfrm t the latest regulatins regarding cntracts, and all ther applicable regulatins. If LVEDC and its partners is unable t negtiate a final cntract which it deems reasnable, LVEDC and its partners may negtiate with the Cnsultant deemed secnd best qualified, r LVEDC and its partners may reject all respnses received and issue anther Request fr Prpsals. N csts shall be 7
cnsidered incurred r encumbered fr such services eligible fr Federal and/r State reimbursement until the Federal and/r State agency issues its apprval letter fr the eligible services. The final selectin will be cntingent upn the willingness f a firm t negtiate a nt t exceed fee which meets bth the budget and the apprval f LVEDC and its partners is fair and reasnable with respect t the services t be prvided, and ffers the expeditius cmpletin f all services required. The cntract will be awarded t the respnsible ffer r whse respnse is within the cmpetitive range and determined t be the mst advantageus t LVEDC and its partners, price and all ther factrs cnsidered. The factrs t be cnsidered and the methd t be utilized in the evaluatin f the respnses and selectin f the cntractr are set frth abve. It is required that all prject activities be carried ut in accrdance with applicable Federal, State and lcal laws and regulatins. LVEDC and its partners reserve the right t reject any and all respnses, r parts f respnses, at its discretin. This is nt an ffer f emplyment; but the party awarded a cntract will serve as an independent cntractr t LVEDC. GENERAL PROJECT INFORMATION A. Prject Descriptin The Lehigh Valley Land Recycling Initiative (LVLRI) is a jint prject f Lehigh and Nrthamptn Cunties and is administered by Lehigh Valley Ecnmic Develpment Crpratin (LVEDC). The prject fcuses n prmting ecnmic develpment thrugh the reuse f abandned and underutilized industrial prperties. Land Recycling is an imprtant initiative fr the Cunties and LVEDC in their effrts t prmte urban redevelpment and balance ecnmic and sustainable develpment. The Green Knight Ecnmic Develpment Crpratin (GKEDC) is a private nt-fr-prfit crpratin fcused n facilitating cmmunity and ecnmic develpment in the Slate Belt regin f Nrthamptn Cunty, PA. GKEDC uses revenues frm efficiently perating a methane-t-energy plant at the Grand Central Sanitary Landfill in Plainfield Twnship, PA t supprt prjects and initiatives that imprve ecnmic pprtunities and the verall quality f life in ur target area. In September f 2011, GKEDC entered int a Letter f Understanding with J.H. Beers Inc. (Beers) that established a perid during which GKEDC culd cmplete varius due diligence activities at a tract f land wned by Beers (Tax Parcel F7-9-6). This tract is the site f a frmer slate quarry and tire pile and is lcated partially in 3 different municipalities (Wind Gap Brugh, Plainfield Twnship, and Bushkill Twnship see attached map). GKEDC s intent was t utilize that due diligence perid t cmplete envirnmental, engineering, and financial analyses as required t determine the feasibility f redevelping the prperty fr cmmercial/industrial use. Based n the results f the due diligence wrk and sme preliminary cst estimates, GKEDC develped a cnceptual plan t develp the prperty as 8
an apprximately 4 t 5-lt, 16 t 20-acre industrial park. The GKEDC estimate that the prject will increase lcal tax revenue by nearly $300,000/year and bring between 160 and 200 jbs at the site. GKEDC and Beers have cme t an agreement n the verall terms f the prperty transfer and all parties are wrking twards the GKEDC being able t clse n the prperty befre the end f 2013. B. QUALIFICATION EVALUATION Each qualificatin that meets the submissin deadline and respnse frmat requirements will be reviewed t assess if the respndent meets the minimum capability requirements. LVEDC will evaluate written qualificatins frm firms meeting these minimum requirements based upn the infrmatin requested in Respnse Sectins 1 thrugh 4 abve. LVEDC will then determine whether interviews will be necessary. Based n the cntent f the written respnses and any interviews (if required), LVEDC and its partners will then select the firm(s) best qualified fr the assignment in LVEDC and its partners judgment.
