CIMB Bank Balance Transfer Terms & Conditions as of 1 January 2018 Balance Transfer Programme 1. CIMB Bank Berhad ("CIMB Bank") has established the CIMB Bank Balance Transfer Programme ("Programme") for CIMB Bank s principal Cardholders ( Cardholders ). The Programme allows Cardholders to apply to transfer the outstanding balance from his/her credit card accounts with other financial institutions (the "Outstanding Balance") to any CIMB Bank credit card account held in their name. The Cardholders are allowed to use a portion of their available credit limit under their CIMB Bank credit card accounts to pay off the outstanding balance of their other bank s credit card accounts and repay CIMB Bank the sum utilized within the relevant period specified in the balance transfer plans selected by the Cardholders ( Tenure ). 2. This Programme is not valid for CIMB Islamic Cardholders. 3. Applications for this Programme are subject to CIMB Bank s prior approval and the terms and conditions herein contained. CIMB Bank reserves the right to approve or reject any applications and determine the Outstanding Balance allowed to be transferred (the Approved Balance ) at its absolute discretion. Cardholders who are in breach of or who have breached the terms and conditions of their credit card accounts with other financial institutions or who have otherwise not conducted such other credit card accounts properly shall not be entitled to participate in this Programme. 4. Subject to the available credit limit in the Cardholder s CIMB Bank credit card account(s), Cardholders can select balance transfer plans specified in the application form or through telephone communication with CIMB Bank. The Cardholder s consent obtained via phone call will be deemed conclusive proof of the Cardholder s instruction to apply for this Programme and accept the Approved Balance upon the terms and conditions herein and the terms and condition governing the use of the CIMB Bank credit card(s) ( Cardholder Terms & Conditions ). Notification 5. A notification (Short Messaging Services (SMS) or any other means of notification which CIMB Bank may select) will be sent to the Cardholder advising him/her whether his/her application under this Programme has been approved or declined. In the event that an application has been approved, CIMB Bank will make payment of the Approved Balance to the Cardholder s credit card account with the other financial institution in such manner as CIMB Bank deems fit. 6. Until the notification of approval (referred to in Clause 5) is received by the Cardholder and payment of the Approved Balance is made by CIMB Bank to the other financial institution, the Cardholder shall continue to be liable to make payment under his/her credit card account with the other financial institution in accordance with the terms of payment of the other financial institution and CIMB Bank shall not be liable for any interest on any overdue payment or any other finance charges or other charges incurred by the Cardholder or other consequences arising as a result of the Cardholder s and/or CIMB Bank s failure or delay in making payment of the Approved Balance to the other financial institution. Account 7. An additional account number will be assigned to the Cardholder for the purpose of operating and administering the Approved Balance and the Cardholder will receive a separate statement with details of his Approved Balance. Notwithstanding the additional account number assigned to the Cardholder, the Approved Balance refinance by CIMB Bank shall however still be deemed to be an amount incurred by the Cardholder under his/ her CIMB Bank credit card account(s) and shall be treated as part of the Cardholder s credit card(s) outstanding amount. The Cardholder will have to make a monthly minimum payment of 5% on the outstanding thereof or RM50.00, whichever

is higher. If the minimum payment is not paid by the due date each month, the late payment charge of 1% on the total outstanding balance as at statement date (subject to a minimum of RM10.00 and a maximum of RM100.00) will be charged on the next day after the Due Date for each month. This late payment charge is imposed by way of liquidated damages and not as a penalty and shall be payable before, as well as after any court order or judgment. 8. Any approved balance not paid in full within the Tenure will be subjected to finance charges of 1.5% per month or 18% per annum calculated on a daily basis. No Bonus Points or Cash Rebates 9. Cardholders shall not be entitled to any form of bonus points/ cash rebate in respect of their participation in this Programme. Credit Limit 10. The Approved Balance will form part of the total available credit limit for all of the Cardholder s CIMB Bank credit card account(s), including his Supplementary credit card account(s). There will be no increase in the available credit limit whether equivalent to the Approved Balance or otherwise. The Approved Balance will reduce the available credit limit of the Cardholder s credit card account(s) accordingly. 11. After the expiry of the relevant period specified in the balance transfer plans selected by the Cardholder where a preferential rate of finance charges is chargeable, CIMB Bank shall impose finance charges on the Approved Balance of the Cardholder's credit card at the rates and in accordance with the terms and conditions of the Cardholder Terms & Conditions. Right to Amend, Malaysia Law & Cardholder Terms and Conditions 12. CIMB Bank reserves the right at its sole and absolute discretion to vary, amend, delete or add to any of these terms and conditions herein at anytime by giving the Cardholder twenty one (21) days prior notice and the duly amended terms and conditions shall become effective on such date as CIMB Bank may determine and specify in the notice. 13. The terms and conditions herein shall be governed by and construed in accordance with the laws of Malaysia. 14. The terms and conditions herein are in addition to and without prejudice to the terms and conditions stated in the Cardholder Terms & Conditions. In the event of a conflict between the terms and conditions herein and the terms and conditions in the Cardholder Terms & Conditions, the terms and conditions herein prevail in relation to this Programme. 15. CIMB Bank shall not be liable for any default in respect of this Programme due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failures or any event beyond the reasonable control of CIMB Bank. 16. In the event of any inconsistency, conflict, ambiguity or discrepancy between the English text or the Bahasa Malaysia version of this Terms and Conditions, the English version shall prevail. Notwithstanding the aforementioned where request had been made by the Cardholders and noted and acknowledged by CIMB Bank in its records that the Bahasa Malaysia version of the terms and conditions shall govern the Cardholder s credit card account, then the Bahasa Malaysia version of the terms and conditions herein shall prevail.

Pemindahan Baki CIMB Bank Terma-Terma & Syarat-Syarat seperti pada 1 Januari 2018 Program Pemindahan Baki 1. CIMB Bank Berhad ( CIMB Bank ) telah menyediakan Program Pemindahan Baki CIMB Bank ("Program ini") untuk pemegang kad prinsipal CIMB Bank ( Pemegang Kad ). Program ini membenarkan Pemegang Kad untuk membuat permohonan untuk memindahkan jumlah baki yang tertunggak dari akaun-akaun kad kreditnya dengan institusiinstitusi kewangan lain ("Baki Tertunggak") kepada mana mana akaun kad kredit CIMB Bank yang dipegang di bawah nama mereka. Pemegang Kad dibenarkan untuk menggunakan sebahagian daripada had kredit tersedia di bawah akaun-akaun kad kredit CIMB Bank mereka untuk membayar baki tertunggak di bawah akaun-akaun kad kredit Pemegang Kad dengan bank-bank lain dan membayar balik kepada CIMB Bank jumlah yang digunakan dalam tempoh relevan yang dinyatakan di dalam pelan pemindahan baki yang dipilih oleh Pemegang Kad ( Tempoh ). 2. Program ini tidak sah untuk pemegang kad CIMB Islamic. 3. Semua permohonan untuk Program ini adalah tertakluk kepada kelulusan oleh CIMB Bank dan terma-terma dan syarat-syarat yang terkandung di sini. CIMB Bank menyimpan hak untuk meluluskan atau menolak sebarang permohonan dan menentukan Baki Tertunggak yang dibenarkan untuk dipindahkan ( Baki Yang Diluluskan ) atas budi bicara mutlaknya. Pemegang Kad yang memungkiri atau telah memungkiri terma-terma dan syarat-syarat akaun kad kreditnya dengan institusi-institusi kewangan lain atau tidak mengendalikan akaun-akaun kad kredit lain dengan cara yang betul adalah tidak berhak untuk menyertai Program ini. 4. Tertakluk kepada had kredit tersedia ada dalam akaun(akaun-akaun) kad kredit CIMB Bank Pemegang Kad, Pemegang Kad boleh memilih pelan-pelan pemindahan baki yang dinyatakan dalam boring permohonan atau melalui komunikasi telefon dengan CIMB Bank. Persetujuan Pemegang Kad yang diperolehi melalui panggilan telefon akan dianggap sebagai bukti muktamad mengenai arahan Pemegang Kad untuk memohon untuk Program ini dan menerima Baki Yang Diluluskan mengikut terma-terma dan syarat-syarat di sini dan terma-terma dan syarat-syarat yang mengawal penggunaan kad kredit CIMB Bank ("Terma-terma dan Syarat-syarat Pemegang Kad ). Notifikasi 5. Suatu notifikasi (Sistem Pesanan Ringkas (SMS) atau apa-apa cara notifikasi lain yang boleh dipilih oleh CIMB Bank) akan dihantar kepada Pemegang Kad untuk memaklumkan Pemegang Kad sama ada permohonan beliau di bawah Program ini telah diluluskan atau ditolak. Sekiranya suatu permohonan telah diluluskan, CIMB Bank akan membuat bayaran untuk Baki Yang Diluluskan kepada akaun kad kredit Pemegang Kad dengan institusi kewangan lain mengikut cara yang dianggap sesuai oleh CIMB Bank. 6. Sehingga notifikasi mengenai kelulusan (yang dirujuk dalam Klausa 5) diterima oleh Pemegang Kad dan pembayaran Baki Yang Diluluskan telah dibuat oleh CIMB Bank kepada institusi kewangan lain, Pemegang Kad adalah bertanggungjawab secara berterusan untuk membuat pembayaran ke atas akaun kad kredit Pemegang Kad dengan institusi kewangan lain berdasarkan kepada terma-terma pembayaran institusi kewangan tersebut dan CIMB Bank tidak akan bertanggungjawab ke atas apa-apa faedah yang dikenakan ke atas pembayaran lewat atau apa-apa caj kewangan atau caj-caj lain yang dikenakan ke atas Pemegang Kad atau apa-apa akibat lain yang tertimbul disebabkan oleh kegagalan atau kelewatan Pemegang Kad dan/atau CIMB Bank dalam membuat pembayaran Baki Yang Diluluskan kepada institusi kewangan lain tersebut. Akaun 7. Satu nombor akaun tambahan akan diberikan kepada Pemegang Kad untuk tujuan operasi dan pengendalian Baki Yang Diluluskan dan Pemegang Kad akan menerima penyata berasingan dengan butir-butir mengenai Baki Yang Diluluskan. Walaupun nombor akaun tambahan diberikan kepada Pemegang Kad, Baki Yang Diluluskan yang dibiayai

semula oleh CIMB Bank akan masih dianggap sebagai amaun yang harus ditanggung oleh Pemegang Kad di bawah kad kredit CIMB Bank dan akan dianggap sebagai sebahagian amaun tertunggak kad kredit Pemegang Kad. Pemegang Kad dikehendaki membuat bayaran bulanan minimum sebanyak 5% daripada jumlah baki yang tertunggak atau RM50.00, yang mana lebih tinggi. Sekiranya bayaran minimum bulanan tidak dijelaskan selewatlewatnya pada tarikh matang setiap bulan, caj bayaran lewat sebanyak 1% akan dikenakan ke atas keseluruhan baki tertunggak pada tarikh penyata (tertakluk kepada minima RM10.00 dan maksimum RM100.00) akan dikenakan pada hari seterusnya selepas tarikh matang untuk setiap bulan. Caj bayaran lewat ini dikenakan melalui cara ganti rugi jumlah tertentu (liquidated damages) dan bukannya sebagai penalty dan perlu dibayar sebelum dan juga selepas apa-apa perintah mahkamah atau penghakiman. 8. Sebarang baki yang diluluskan yang tidak dibayar sepenuhnya dalam tempoh akan dikenakan caj kewangan sebanyak 1.5% sebulan atau 18% setahun yang dikira setiap hari. Tiada Mata Bonus dan Rebat Tunai 9. Pemegang Kad tidak berhak mendapat sebarang mata bonus/ rebat tunai untuk penyertaan mereka di dalam Program ini. Had Kredit 10. Baki Yang Diluluskan akan menjadi sebahagian daripada jumlah keseluruhan had kredit tersedia ada untuk semua akaun-akaun kad kredit CIMB Bank Pemegang Kad, termasuk akaun (akaun-akaun) kad kredit Tambahannya. Had kredit tersedia ada tidak akan ditambah sama ada bersamaan dengan Baki Yang Diluluskan ataupun sebaliknya. Baki Yang Diluluskan akan mengurangkan had kredit tersedia ada untuk akaun kad kredit Pemegang Kad dengan CIMB Bank. 11. Selepas tamat tempoh relevan yang dinyatakan di dalam pelan-pelan pemindahan baki yang dipilih oleh Pemegang Kad di mana caj kewangan pada kadar keutamaan dikenakan, CIMB Bank akan mengenakan caj-caj kewangan ke atas Baki Yang Diluluskan untuk kad kredit Pemegang Kad pada kadar-kadar dan berdasarkan kepada Terma-terma dan Syarat-syarat Pemegang Kad. Hak untuk Meminda, Undang-undang Malaysia & Terma-terma dan Syarat-syarat Pemegang Kad 12. CIMB Bank menyimpan hak atas budi bicara tunggal dan mutlaknya untuk mengubah, meminda, memotong atau menambah terma-terma dan syarat-syarat yang terkandung di dalam ini pada bila-bila masa dengan memberi notis dua puluh satu hari (21) terdahulu kepada Pemegang Kad, dan terma-terma dan syarat-syarat yang telah dipinda akan berkuatkuasa pada tarikh yang akan ditentukan dan dinyatakan oleh CIMB Bank dalam notis tersebut. 13. Terma-terma dan syarat-syarat ini akan dikawal oleh dan ditafsir mengikut undang-undang Malaysia. 14. Terma-terma dan syarat-syarat yang terkandung di dalam ini adalah tambahan kepada dan tanpa prasangka terhadap terma-terma dan syarat-syarat yang terkandung di dalam Terma-terma dan Syarat-syarat Pemegang Kad. Sekiranya terdapat sebarang percanggahan di antara terma-terma dan syarat-syarat yang terkandung di dalam ini dengan terma-terma dan syarat-syarat yang terkandung di dalam Terma-terma dan Syarat-syarat Pemegang Kad, terma-terma dan syarat-syarat di dalam ini akan digunapakai berkenaan Program ini. 15. CIMB Bank tidak akan berliabel atas sebarang kemungkiran yang berkaitan dengan Program ini akibat daripada tindakan Tuhan, peperangan, rusuhan, mogok, sekatan masuk, tindakan perindustrian, kebakaran, banjir, kemarau, ribut, kegagalan-kegagalan teknikal atau sistem atau sebarang peristiwa di luar kawalan munasabah CIMB Bank.

16.
