SWEEPSTAKES PERIOD: The Contest begins on Wednesday, February 10, 2016 at 8:00 a.m., Pacific Time (PT) and ends on Wednesday, February 24, 2016 at 11:59 p.m. PT (the Contest Period ). All activities must be completed by Wednesday, February 24 2016 at 11:59 p.m. PT. ELIGIBILITY: The Contest is open only to legal residents of the 50 United States (including the District of Columbia) and Canada (excluding Québec) ( Territory ) who are twenty-one (21) years of age or older at time of entry, and have a valid driver s license except that residents of New York, Rhode Island and Florida are not eligible. Void outside Territory and where prohibited by law. Void in Québec. Employees, officers, and directors of (i) Sponsor and Speedway Motorsports, Inc. and their subsidiaries and affiliates and each of their respective parent companies, divisions, affiliates, subsidiaries, officers, directors, shareholders, members, successors, assigns and agents, and (ii) any others engaged in the development, production or distribution of promotional materials or prizes for this Contest (collectively, the Released Parties ), and (iii) members of the immediate families (parents, children, spouse, siblings) or households of any of the above are not eligible to enter or win. The Released Parties and judges are not responsible for late, lost, damaged, garbled, incomplete, or misdirected entries, for errors, omissions, interruptions, deletions, defects or delays in operations or transmission of information, in each case whether arising by way of technical or other failures or malfunctions of computer hardware, software, communications devices, or transmission lines or data corruption, theft, destruction, unauthorized access to or alteration of entry materials, loss or otherwise. Sponsor disclaims any liability for damage to any computer system resulting from participation in, or accessing or downloading information in connection with this Contest. All activities become the property of the Sponsor and will not be returned. WINNER SELECTION AND NOTIFICATION: Decisions of Sponsor with respect to the Contest are final. One (1) potential grand prize winner will be selected based on the Leaderboard standings on Wednesday, February 24 at 11:59 p.m. The Leaderboard is in real time and available here - http://www.amsfanzone.com/leaderboard. The potential prize winner is subject to verification, including without limitation, verification of eligibility, age, compliance with these Official Rules and completion of release forms (described below). If a potential prize winner is found not to be eligible or not in compliance with these Official Rules, the potential prize winner will be disqualified. If attempted notification is returned as undeliverable, if the potential winner cannot be verified, or if the potential winner is otherwise unable to accept whole prize, prize will be forfeited and may be awarded to an alternate provided sufficient time remains, in Sponsor s discretion. The potential prize winner will be notified by email or phone on and no later than Monday, February 22, 2016. The Judge s decisions are final and binding in all respects. ODDS OF WINNING: The odds of winning depend on the total number of eligible entries received. PRIZE DESCRIPTION: Two (1) Grand Prizes consisting of one (1) Atlanta Motor Speedway blankets. The Total Actual Retail Value ( ARV ) for Grand Prize package is $40. PRIZE CONDITIONS: All prize details shall be determined in the sole and absolute discretion of Sponsor. Winner s guest must be twenty-one (21) years of age or older. All costs and expenses associated with the prize acceptance and use not specified herein as being provided, including but not limited to transportation costs, meals, gratuities, service charges or taxes, hotel room service,
laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, insurance, and any other incidental costs or expenses not identified in these Official Rules are the sole responsibility of the Winner. All prizes will be awarded as-is with no warranty or guarantee either expressed or implied. No substitution, transfer, or cash equivalent of a prize is permitted except by Sponsor, who reserves the right to substitute a prize (or any part of the prize) with one of equal or comparable or greater value, at its sole discretion, or in the event a prize becomes unavailable for any reason. Any difference between stated approximate value and the actual value of Contest Prize(s) will not be awarded. Seat and parking locations at the event shall be determined in the sole discretion of Sponsor. The event and event dates and times are determined in the sole discretion of NASCAR, Sponsor, or Prize Provider (as the case maybe), and may be subject to change. The terms and conditions of the prize awarded will govern in the event an event is not conducted due to weather conditions, an act of God, and an act of terrorism, civil disturbance or any other reason. Winner and his/her guest agree to comply with all applicable Speedway, Prize Provider and Venue regulations, as the case may be, in connection with the prize. Sponsor reserves the right to remove or to deny entry to the Winner and/or his/her guest who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event. Released Parties (defined above) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any event. Event tickets and passes awarded as prizes may not be resold or offered for resale. Any such resale may result in disqualification and prize forfeiture, and may invalidate the license granted by the event tickets. WINNER RESPONSIBILITIES: Contest winners will be solely responsible for all taxes on Contest prize(s) and will receive an IRS Form 1099 for the retail value of the prize(s). Winner will be required to sign a Statement of Eligibility, Liability Release and Publicity Release (collectively Releases ) (except where prohibited by law). In addition, Winner s Guest will be required to sign a Liability and Publicity Release (except were prohibited by law). Failure to provide such will result in forfeiture of the Prize. RELEASE: By participating, entrants agree, and by accepting prize, winner(s) agrees, to release and hold harmless the Released Parties from any and all liability, injury, loss or damage incurred by participating in the Contest and/or the awarding, receipt, acceptance, possession or use/misuse of the prize(s). By accepting the prize(s) the winner agrees to allow Sponsor the use of his/her name and address (city & state), photograph, videotape or likeness for advertising or publicity purposes and to the use of statements made by or attributed to the winner relating to Contest or Sponsor, and grants to Sponsor any and all rights to said use, without further compensation or notice, unless prohibited by law. name, likeness and state of residence for promotional purposes in any media without further consideration. Also, except where prohibited by law, participation in the Contest constitutes entrant s consent to the use by Sponsor, its affiliates, and their agents, of entrant s personal information, email addresses and other contact information for marketing and other purposes. In the event of cancellation, Sponsor shall award the Contest Prize (or prizes of equal or greater value) in a random drawing from all eligible, non-suspect entries received as of the time of Contest cancellation. Additional companies or organizations may join in sponsoring the Contest and such additions shall likewise be posted at http://www.amsfanzone.com/promotions. DISPUTE RESOLUTION: All entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contest or any Prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Georgia or the appropriate Nevada State Court located in Henry County, Georgia; and (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Georgiaa, without giving effect to any choice of law or conflict of law rules (whether of the State of Georgia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Georgia.
