In these terms and conditions unless the context other wise requires the Bank means Standard Chartered Bank Kenya Ltd and only refers to the branches of Standard Chartered Bank carrying on business in Kenya. These Terms and Conditions are supplemental to and in no way to the exclusion of the general terms and conditions mentioned here and the general Credit Card Agreement, the provisions and definitions contained in the credit card agreement shall apply to the exclusion of these conditions, nothing in these Terms and conditions shall amend, very revoke or other wise change the credit card agreement, which remain in full force. The Rewards programme is established by the bank to reward Cardholders for their loyalty and creditworthiness. The Rewards programme is open to the bank s Credit cardholders and will be enrolled automatically into the Rewards programme. Enrolment to this programme is free. The Rewards programme will enable qualifying cardholder to accumulate Reward Points that may subsequently be redeemed for various goods and service (called Rewards) as detailed in the Rewards catalogue Reward points earned vary by product and nature of spends as communicated in the Rewards Catalogue. Reward Points are awarded only for retail purchase transactions charged to the Card account. The Bank reserves the right to change at any time and without having to give notice, the number of Reward Points to be rewarded for an amount charged to the card or the amount required to be charged to a card Account for rewarding 1 Reward point. The cardholder will earn Reward Points for every eligible charge on his/her Card on or after the starting date of the Rewards programme, which will be announced by the bank. Reward Points will not be awarded for charges to card Account in respect of finance charges, late payment charges, over limit charges, returned cheque fees, annual fees, renewal fees, other fees, other charges and / or penalties, reserved transactions, fraudulent and/or disputed transactions, or cash transactions. The bank may, from time to time at its sole discretion and without having to give any notice add to or remove from or other wise change the lists of eligible or non-eligible charges. The bank s decision as to what constitutes an eligible or a non-eligible charge shall be final and conclusive. Reward Points awarded to a cardholder will be shown on the cardholder s statement of account, and will be redeemable as set out in the Rewards catalogue. Only the Reward Points accumulated up to and shown in the latest issued Statement of account (or such other date as may be determined by the bank at its discretion) are redeemable. Reward Points redeemed in any billing cycle will appear in the statement of account following that billing cycle. The primary cardholder can check his/her Reward points balance by
calling the bank s Customer Contact Centre.The statement of account gives the definitive balance of Reward Points (in the absence of manifest error). Reward Points earned by a supplementary cardholder will be credited to the account of the primary cardholder and may only be redeemed for Rewards by the primary cardholder. Reward Points are earned by primary cardholder only for himself/herself. A supplementary cardholder can only earn Rewards Points for the primary cardholder. Reward Points cannot be transferred to any other person (whether or not a cardholder) and are not exchangeable for cash or any other thing whatsoever whether tangible or intangible. Only a primary cardholder can redeem Reward Points. Accumulated Reward Points are only redeemable by a primary cardholder if his/her card is valid, has not been cancelled or terminated (whether by the primary cardholder or by the bank) is not being operated fraudulently (whether by a cardholder or a third party) and all charges, fees, finance charges and the required Minimum amount due on the card account have been paid on the relevant payment due date. A primary cardholder cannot redeem the Reward Points if the card account is overdue or over limit in any way. No accumulation or carry over or redemption of Reward Points will be permissible, if on the relevant date any card in the Card Account be it a Primary, Supplementary, Multiple or any other Card has been withdrawn or closed or cancelled or reinstated or is liable to be cancelled / withdrawn or if the Standard Chartered Card Account is a delinquent account or if there is any breach of the Terms and Conditions of the Credit Card Agreement. The Rewards Points will lapse in the event that such a Card Account is closed either voluntarily by the Cardholder or by the Bank at its discretion whether or not the Cardholder dues are cleared. Should the Card Account be reinstated, either by the Cardholder or by Standard Chartered Bank, the Cardholder will not get the benefit of any Reward Points accrued prior to cancellation or withdrawal or closure of the Card Account. Before the first redemption of the Reward Points the primary cardholder must also meet the minimum Reward Points balance requirements (even if the Rewards or merchandise being redeemed requires less Reward Points than such minimum Reward Points balance) the bank shall set the minimum Reward Points balance from time to time. Cardholders need to have a minimum of 5,000 Reward Points when redeeming for the first time. Subsequent redemptions can be made anytime.
To redeem Reward Points, the primary cardholder must have accumulated required number of Reward Points in his/her card (s) or card account (s) A primary cardholder can redeem the Reward Points by following the procedures set out in the Rewards Catalogue. Where redemption or use of any Reward Points is subject to a cardholder participating in the membership programme of the provider of that Rewards item, redemption or use of the Rewards item by the Cardholder will be conditional on the cardholder first being a member of that provider / merchant s membership programme, such membership programmes may include without limitation, those operated by airlines, hotels or other service providers the bank may at any time without prior notice to the cardholder, alter the number of Reward Points required to obtain any Rewards or impose additional conditions, or restrictions on any Rewards. The Express Lane redemption option is only available at the Reward Points and cash values fixed and published for specific items in the Rewards catalogue. Cards issued by the bank are to be used as a means to pay the balance of the Rewards value or the cash portion of the redemption. If the primary cardholder chooses the express lane option for redemption, the cardholder s redemption instructions, received by the bank as a fax request or through a phone call, can be used as an authorization to debit the card account for the cash value of the Rewards item. The cash portion of the Rewards item paid through the card(s) will be reflected in the monthly statement of account as a retail transaction. The use of the card for express lane redemption will also earn Reward Points. For the Reward items which are held by the bank, these will be delivered by any method which the bank chooses as appropriate, within 10 working days from the date the redemption request is approved by the bank. Delivery of such items will be solely at the risk of the primary cardholder. For the Reward items which are not held by the bank, the bank will send to the primary cardholder within 10 working days from the date the redemption request is approved by the bank, a redemption confirmation letter authorizing the primary cardholder to collect the Reward items (s) from the relevant merchant. The bank will not entertain any complaints about any Reward item that has been collected from the relevant merchant; any complaint must be addressed to the relevant merchant. Redemption request once approved or fulfilled cannot be cancelled by the cardholder.
Redemption request for any Reward items stated under the Rewards Catalogue is subject to the Banks approval and availability of the Reward items and suppliers restrictions. The Bank may, at its absolute discretion and without having to give any notice, withdraw or substitute any Rewards item for another Rewards item of comparable value or nature. The Bank reserves the right to suspend and /or disqualify any cardholder from further participation in the Rewards programme if in its sole judgment, that Cardholder has in anyway violated these Terms and Conditions or the conditions under the Credit Card Agreement or has otherwise abused the Rewards programme. Suspension and/or disqualification could result in all Reward Points being forfeited. The Bank does not accept any liability of any nature in respect of Reward items or the Rewards programme. The Bank gives no warranty (whether express or implied) whatsoever with respect to Reward items. In particular but without limitation, the bank gives no warranty with respect to the quality of Reward items or their suitability or fitness for any purpose or their design or specifications. The Bank will not be liable for any damage or loss incurred by the Cardholder or any other person arising out of the purchase, installation, and use or otherwise of any Rewards item. If a Rewards item is delivered by the Bank, through any method the Bank chooses as appropriate, is damaged or faulty when received by the primary Cardholder, the Cardholder must notify the Bank within 2 days of receipt of the rewards item with full details of the damage or fault. The Bank may replace, at its sole discretion, upon return of the damaged or faulty Rewards item, with another Rewards item of comparable value or nature. The Bank shall not be responsible for any damaged defective Rewards item if its is not notified of the damaged or defective Rewards item if it is not notified of the damaged or defective Rewards item in accordance with this provision. In no circumstances will a cash refund be made. The Bank is entitled at any time without any prior notice any liability to any Cardholder or any other person whatsoever to terminate the Rewards programme or cancel or vary its benefits or features, or vary or add or delete any of these Terms and Conditions, or withdraw or exclude the primary Cardholder or supplementary cardholder from all or part of Rewards programme, or modify or limit the value of Reward Points and/ or the manner of their redemption, even though such acts may diminish the value of the Reward Points already accumulated. The Rewards Catalogue and its contents may be changed, withdrawn or replaced by the bank without prior notice. The Bank reserves the right to change the format or all or
part of the Rewards programme from time to time without prior notice. The Bank may terminate the Rewards programme at any time. The Bank shall not be liable if it is unable to perform its obligations under these Terms and Conditions, due directly or indirectly to the failure of any machinery or communication system, industrial dispute, war act of God, or anything outside the control of the Bank. The Bank shall not be responsible for any delay by the participating merchants or any third party in transmitting evidence on any Card Transaction. The Reward Points will expire once every three years and will be executed based on FIFO method. If at any time any dispute arises in connection with the Rewards programme or these Terms and Conditions the Banks decision in connection with the same shall be final and binding. The law in Kenya shall govern these Terms and Conditions.
