Rem 232 Circular Letter E.L. 03/2014 9 June 2014 New Entrant Pay Rates - Persons being recruited to certain direct entry grades (Section 2.31 of Haddington Road Agreement). A Chara 1. I am directed by the Minister for the Environment, Community and Local Government to convey the following instructions to local authorities in relation to implementation of Section 2.31 of Haddington Road Agreement which concerns new entrant pay rates. The purpose of this circular is to address the imbalance between those on 10% reduced pay rates (i.e. to whom Circular Letter E.L. 01/2011 applies) and those who are not (i.e. those who entered prior to 1 January 2011 and to whom Circular Letter E.L. 17/2009 applies). This circular supersedes Circular letter E.L. 01/2011 which is hereby rescinded. Grades affected: 2. The revised pay rates in respect of the relevant grades (Circular letter E.L. 01/2011 refers) are set out in the attached appendix. These rates also apply to posts at analogous levels (e.g. Assistant Engineer rate applies to Assistant Planner posts). Instruction is also conveyed to pro-rata pay adjustments for part-time officers in accordance with established practice. In all other cases, the pay scales set out in Circular E.L. 17 of 2009 and E.L. 5 of 2013 will continue to apply, where appropriate. Adjustments to Overtime Rates 3. As a consequence of merging of the 2010 pay scales (i.e. E.L. 17 of 2009) with the relevant 2011 pay scales (i.e. E.L. 01/2011), overtime rates for those on salaries of up to 35,000 (inclusive of allowances in the nature of pay) are revised as follows: For employees on salaries of up to 35,000 (inclusive of allowances in the nature of pay) overtime will be paid at time and a half at the third point of the appropriate (merged) scale. This formula will not apply to any scale where this provision would result in overtime being paid at less than time at any point on the scale. Section 2.13(a) of the Haddington Road Agreement will continue to apply to those on the first and second point of the merged scale. Accordingly, for those on salaries up to 35,000 and on the 1 st or 2 nd point of the merged scale, overtime will be paid at time and a half at the 1 st point of the scale. This
formula will not apply to any scale where this provision would result in overtime being paid at less than time at any point on the scale. Where the implementation of merged scales under this circular does not arise, overtime will continue to be paid at the first point of the scale. Allowances 4. All fixed allowances which were reduced by 10% with effect from 1 January 2011 are restored and should be paid at the 2010 rate (100%) with effect from 1 November 2013. Allowances and other payments (overtime, etc) which are linked to basic pay should be calculated on the revised merged pay scales. Non-National Grades 5. Under the terms of Paragraph 5.1 of the Appendix to Circular Letter LA (P) 4/96, these pay adjustments may be applied to non-national grades. Sanction may be assumed to the application of the merged scales to members of national and local grades which have the same scales as the grades listed in the Appendix. Full-time Fire Fighters 6. This pay adjustment will apply to all full-time fire fighters. Local authorities will be notified separately in accordance with established practice. Implementation 7. The new scales are effective from 1 November 2013. As the new scales apply to both existing staff on the 2010 scales (i.e. E.L. 17 of 2009) and those currently on the 2011 scales (i.e. E.L. 01/2011), payroll sections should arrange for the migration of all staff to the new scales as soon as possible.
