Auto Europe Car Hire Damage Excess Reimbursement Protection The Auto Europe Car Hire Damage Excess Reimbursement Protection Summary The Auto Europe Car Hire Damage Excess Reimbursement Protection is to provide a refund of the amount paid by the car hire renter who booked their car hire from Auto Europe for the amount charged by the Car Rental Company for car hire damage excess directly as a result of an incident arising during the car hire rental period. Auto Europe Rental Vehicle Damage Excess Reimbursement Cover Welcome to Auto Europe with JM Marketing Limited We are dedicated to providing you with a high quality service. This reimbursement cover is designed to provide you with the carhire damage excess reimbursement cover. You can identify the cover you have purchased by looking at the reimbursement cover summary. This reimbursement cover will form the contract between you and us, subject to the terms and conditions detailed below. The headings used in this reimbursement cover are for ease of reference and identification purposes only. Any endorsement or other variation which relates to this reimbursement cover is subject to the terms and conditions below. Words and phrases in bold have been given specific meanings and can be found in the definitions section of the reimbursement cover. Definitions Word Booking reference number Booking voucher Damage Eligible person Endorsement Worldwide Specific meaning means the booking reference number which is exclusive to the renter and the renter s vehicle rental agreement and is shown on the booking voucher. means either a printed or electronic confirmation that a booking has been made. This document will show the renter s booking reference number. means damage to the rental vehicle caused by fire, vandalism, accident or theft of the rental vehicle. means: 1. a renter resident anywhere in the World at the time a booking voucher is issued. The renter must hold a driver s licence which entitles them to rent and drive the rental vehicle in the country where they are renting and driving the rental vehicle. The renter must also be: a) aged between 19 and 85 years of age; and b) eligible to rent and drive the rental vehicle; and c) be named on the vehicle rental agreement. means a change to the terms of the policy. means any Country in the World with the exception of the following named Countries being: Afghanistan, Algeria, Belarus, Central African Republic, Chechnya, Cuba, Democratic Republic of Congo, Iran, Iraq, West Bank, Gaza and the Occupied Territories of Israel, Libya, Nigeria, North Korea, Myanmar, Somalia, South Sudan, Sudan, Syria, Yemen. 1

Where a limit of indemnity is stated in the policy schedule as in the aggregate, that aggregate is the maximum we will pay for all insured events during the period of insurance. means the time for which this policy is in force as stated in the policy schedule. means this policy wording, the policy schedule and any endorsements. means the document attaching to or incorporated into this policy wording and headed policy schedule and bearing the policy number applicable to this insurance. means the amount stated against the premium in the policy schedule. means a company or agency which is fully licensed (where required) with the regulatory authority of the country, state or local authority which rents automobiles for a fee. means a valid comprehensive motor insurance policy in respect of the rental vehicle arranged through the rental company for the trip. means any vehicle hired under a vehicle rental agreement on a daily basis up to a maximum of sixty (60) carhire days from a rental company within the territory covered by your policy and which is collected from the rental company within the geographical scope of this insurance. This policy will not cover any rental vehicle that is a motor home, camper van, trailer or caravan, a commercial van, commercial vehicle or truck, motorcycle, moped, motorbike, vehicle for which the main use is intended to be off-road, recreational vehicle (RV) or a vehicle with more than 25 seats. means the individual named means the person(s) named as the hirer on the vehicle rental agreement who meets the criteria for an eligible person. in the singular or plural, means the person(s) who is named as permitted to drive the rental vehicle on the vehicle rental agreement and on the booking voucher. Worldwide excluding Afghanistan, Algeria, Belarus, Central African Republic, Chechnya, Cuba, Democratic Republic of Congo, Iran, Iraq, West Bank, Gaza and the Occupied Territories of Israel, Libya, Nigeria, North Korea, Myanmar, Somalia, South Sudan, Sudan, Syria, Yemen. in the singular or plural, means the period of a single vehicle rental agreement in respect of a single rental vehicle which is collected and rented from a rental company for the period stated on the vehicle rental agreement. means the contract of hire between the renter and the rental company. means JM Marketing Limited and Lloyd s Syndicate AMA 1200 trading as ArgoGlobal. means the insured specified in the policy schedule as named insured. When and where cover applies Valid rental agreements This policy must have been purchased and have commenced prior to the start of a vehicle rental agreement for 2

which you wish cover to apply. We will not accept any liability for damage occurring under a vehicle rental agreement that commenced prior to the start of this policy. You must ensure the vehicle rental agreement includes a valid comprehensive motor insurance policy whilst the renter is renting and driving the rental vehicle. Maximum rental period Cover is provided for multiple rental vehicles at any one time. The maximum period of any single vehicle rental agreement should not exceed 60 days. Territory covered You are covered only when the renter uses the rental vehicle in the territory specified in your policy schedule. The policy you selected includes the following geographical areas: Worldwide except the following countries Afghanistan, Central African Republic, Chechnya, Democratic Republic of Congo, Iraq, West Bank, Gaza and the Occupied Territories of Israel, Libya, Nigeria, North Korea, Nigeria, Somalia, South Sudan, Sudan, Syria, Yemen. Our agreement We will reimburse you, up to the limit of indemnity stated below, for the amount of excess which the renter is required to pay under the vehicle rental agreement for any single incident or series of incidents under a single vehicle rental agreement in respect of accidental damage to the rental vehicle including: 1. physical damage to the windows and windscreen of the rental vehicle; 2. physical damage to the roof, wheels, tyres, clutch, transmission and undercarriage of the rental vehicle; 3. loss or damage resulting from fire, theft or vandalism; provided that the renter is held responsible as declared in the vehicle rental agreement for the excess. Limit of indemnity Our liability shall not exceed 3,000.00 each and every claim during the period of insurance. Our total liability under this policy shall not exceed the aggregate limit of indemnity stated in the policy schedule during the period of insurance. Extensions to the policy This policy automatically includes cover for the following costs and services up to the amount specified in each section: (1) Replacement keys This policy covers you for costs incurred, up to a maximum of 300 for each and every claim, for damage to the key for a rental vehicle including replacement locks and locksmith charges during the period of a single vehicle rental agreement covered by this policy. The most we will pay in any period of insurance is 300.00. (2) Misfueling This policy covers you for costs you incur, up to a maximum of 300 each and every claim, for cleaning out the engine and fuel system and any towing costs in the event that the renter uses the wrong type of fuel in the rental vehicle during the period of a single vehicle rental agreement covered by this policy. The most we will pay in any period of insurance is 300.00. (3) Towing costs This policy covers you for towing costs you incur, up to a maximum of 300 each and every claim incurred following a vehicular accident. The most we will pay in any period of insurance is 300.00. 3

(4) Administration fees This policy covers you for administrative costs you incur, as charged by the Rental Company, up to a maximum of 300 each and every claim incurred following a vehicular accident. The most we will pay in any period of insurance is 300.00. Exclusions This policy does not cover any liability arising directly or indirectly from any of the following: 1. Claims exceeding 3,000.00 2. Excess waived under the motor insurance policy Any claim for an excess which is waived under the motor insurance policy or reimbursed to you, or if paid by the renter to the renter, under the motor insurance policy or by a third party. 3. Trip(s) exceeding 60 days Where the vehicle rental agreement is for a period longer than 60 continuous days. 4. Unauthorised use of rental vehicle Any claim for loss or damage arising while the rental vehicle is being: a) used for a purpose which is not permitted or is excluded by the terms of the vehicle rental agreement or corresponding motor insurance policy; or b) used in racing competitions, rallying, trials, rallies or speed testing, or when driven on a motor sport circuit; or c) used beyond the limits of the public highway; or d) used to transport illegal goods or contraband; or e) driven by the renter or a specified driver, should it be proven to our satisfaction that the driver was under the influence of alcohol or drugs at the time of such loss or damage occurring. A conviction under the relevant law (including a conviction for failing to supply a specimen of breath, blood or urine) shall be deemed to be conclusive evidence that the driver at the time of the loss or damage was under the influence of alcohol or drugs. 5. Violation of the vehicle rental agreement terms Any liability loss or damage if either the renter or a specified driver is in breach of the terms and conditions of the vehicle rental agreement at the time such liability loss or damage occurs. 6. Damage to third party vehicles For damage to vehicles which are not rental vehicles hired by the renter under a vehicle rental agreement (other than a courtesy car). 7. Unauthorised drivers Any person driving the rental vehicle who is not the renter or a specified driver named on the vehicle rental agreement, and by any person who does not hold a valid full driving licence issued within the territorial limits of this policy. 8. Territories We will not pay any claim for loss or damage that occurs outside of the territorial limits of this policy. 9. Unacceptable vehicles Any claim arising from the rental of a vehicle which is: a) more than 8 years old; or b) valued at more than 150,000; or 4

c) considered to be unconventional or unusual (e.g. is antique or exotic ) 10. Unacceptable vehicle types Any claim arising from the rental of a vehicle not licensed for road use, and other vehicles types, including trailers or caravans, camper vans, commercial vehicles, vans or loan vehicles, trucks, motorcycles, mopeds, motorbikes, off-road vehicles, recreational vehicles, motor homes, commercial vans and vehicles with more than 25 seats. 11. Rental vehicle interior Any claim arising from loss or damage to the interior of the rental vehicle other than in the event of a collision. 12. Mechanical breakdown Any claim arising from loss of or damage to the rental vehicle resulting from mechanical breakdown as a result of normal use and aging. 13. Property in the renter s control Any claim arising from loss of or damage to the contents of the rental vehicle or any property being transported by the renter or otherwise in the renter s care, custody or control. 14. Radioactivity, Nuclear Any legal liability of whatsoever nature directly or indirectly caused by or contributed to or arising from: a) ionising radiations or contamination by radioactivity from any irradiated nuclear fuel or from any nuclear waste from the combustion of nuclear fuel; or b) the radioactive toxic explosive or other hazardous properties of any explosive nuclear assembly or nuclear component. 15. War and Hostilities Any consequence of war invasion or act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power. 16. Deliberate or reckless damage Any claim resulting from loss or damage caused deliberately or recklessly by the renter or any of the specified drivers. 17. Wear and tear, gradual deterioration, damage caused by animals Any claims arising from loss or damage, caused by wear and tear, gradual deterioration, domestic animals, pets, insects or vermin. 18. Loss of value Any claim for depreciation or loss of value following repairs. 19. Confiscation, requisition or destruction of the rental vehicle Any claim arising from confiscation, requisition or destruction of the rental vehicle by or under the order of any Government or Public or Local Authority. 20. Benefits payable pursuant to uninsured, underinsured motorist legislation Benefits payable under any uninsured or underinsured motorist law, first party benefit law or nofault law, or law similar to the foregoing in any state or territory. 5

21. Payment of Premium Where the full premium or any additional premium has not been paid by you. 22. Car Clubs Any payment or any claim from vehicles operated by a Car Club Company and or your acceptance to the terms and conditions of such membership agreement. 23. Fines Any fines imposed, administration costs, claims for diminution of value or any costs involved with the impounding of the rental vehicle. 24. Eligible driver Any claim resulting from a renter renting and driving the rental vehicle who is not an eligible person. Reimbursement cover conditions 1. Keeping to the terms of the reimbursement cover The cover provided by this reimbursement cover only applies if you have met all the terms and conditions stated within this document. 2. Number of rental vehicles Cover is provided for multiple rental vehicles at any one time which may be driven and operated by the renter or any of the specified drivers as detailed on the vehicle rental agreement. Cover will take effect from the time the renter takes legal control of the rental vehicle and will cease at the time the rental company assumes control of the rental vehicle whether at its business location or elsewhere. 3. Purchase of reimbursement cover This reimbursement cover must have been purchased prior to the commencement date of a vehicle rental agreement for which you require this cover to be operative. 4. Care of rental vehicle You, the renter or any specified drivers are required to maintain the rental vehicle in a roadworthy condition. The renter or any specified driver in charge of the rental vehicle for the duration of the trip are required to take all reasonable care to safeguard it and its contents from loss or damage. We shall at all times be allowed free access to examine the rental vehicle. 5. Accidents or losses If a claim under this reimbursement cover is due to theft, attempted theft, malicious damage or vandalism you must also notify the police and obtain a crime report number. 6. Defence and settlement of claim We shall be entitled to take over and conduct the defence or settlement of any claim or prosecute any claim in the name of any person covered by this insurance. 7. Assignment Assignment of interest under this reimbursement cover will not bind us unless we have consented in writing. 8. Contract (Rights of Third Parties) Act 1999 This reimbursement cover does not confer or create any right enforceable under the Contracts (Rights of 6

Third Parties) Act 1999 or any amending or subsequent legislation by any person who is not named as an insured and both you and us may amend, cancel or lapse this insurance without giving notice to, or requiring the consent of, any other third party. However, this will not preclude rights enforceable under the Third Parties (Rights against Insurers) Act 2010. 9. Fraudulent claims or misleading information We take a robust approach to fraud prevention. If any claim under this reimbursement cover is fraudulent or is intended to mislead, or if any misleading or fraudulent means are used by you or anyone acting on your behalf to obtain benefit, your right to any benefit will end, your cover will be cancelled and we will be entitled to recover any benefit paid and costs incurred as a result of any such fraudulent or misleading claim. We may also inform the police. 10. Other insurance If you wish to make a claim under this reimbursement cover but have already claimed, or intend to claim, for the same loss under another insurance policy, we will only pay our share of the claim. Claims procedure Notification All claims should be notified via Rightpath Insurance Solutions Limited s website, www.refundsolutions.co.uk where you will be able to submit your claim and all supporting documents online. To obtain a reimbursement under your cover you will need: 1. Your booking document issued by Auto Europe Limited which confirms your carhire damage excess cover with Auto Europe Limited 2. Copy of your Rental Agreement from the Vehicle Rental company 3. Your copy of the Rental Company Accident Damage Report and/or a photographic picture of the damage caused 4. Copy of the driving licence of the person named on the Rental Agreement in control of the vehicle at the time of the incident 5. Proof of your payment in the form of a copy of your credit/debit card statement showing payment of the damages which you are seeking reimbursement 6. Your bank details a. UK Bank Sort Code and Account Number b. Bank based outside the UK IBAN and BIC/Swift code (This can be found on your banks website) 7. Description of the incident that caused the accident (including time and date) 8. Police Report if applicable. 9. Copy of pre-rental inspection report if completed 10. Invoices / Receipts / other documents confirming the amount you have paid in respect of the damage to the Rental Vehicle for which you are seeking reimbursement. 11. Any third party contact details. You are required to: Provide any information or documentation we reasonably ask for to support your claim. Co-operate with us at all times by providing supporting documentation or other information as we may reasonably require. 7

Advise us if there is another insurance which may also cover this event, so that we then will pay our proportion of your claim. Do not admit that you are at fault or promise to pay any money, or become involved in litigation without our apporval. Help us recover any money we have paid. Please note: When completing the reimbursement claim form you still have a Duty of Disclosure. When answering these questions you must: Tell us everything that a reasonable person in the circumstances could be expected to tell us. Provide honest and complete answers Governing Law and Disputes Clause Any dispute between you and us arising out of or in connection with this reimbursement cover shall be referred to arbitration before a sole arbitrator (to be mutually agreed upon by you and us or failing agreement to be appointed by the Chairman for the time being of the Bar Council) whose decision shall be final and binding on both parties. As an alternative to the above paragraph, disputes arising from or in connection with this reimbursement cover may be referred to a recognised mediation service if the parties to this contract agree in writing. Disputes arising from or in connection with this reimbursement cover shall be subject to the jurisdiction and law of England and Wales. How to make a complaint Our aim is to ensure that all aspects of your reimbursement cover are dealt with promptly, efficiently and fairly.
