COOPERS SUPER CODE COMPETITION TERMS AND CONDITIONS - GAME OF CHANCE ( Terms and Conditions ) Promotion name 1. Coopers Super Code Competition ( Promotion ). Conditions of entry 2. Information about the Promotion, how to enter and the prize forms part of these Terms and Conditions. Entry into this Promotion is deemed acceptance of these Terms and Conditions by each entrant. Entries not made in accordance with these Terms and Conditions will be disqualified. 3. The promoter is Coopers Brewery Limited, 461 South Rd, Regency Park, South Australia, 5010, telephone, 08 8440 1800( Promoter ). 4. For the purposes of these Terms and Conditions, the Promoter includes all related and subsidiary companies, past, present and future officers, agents, representatives, employees and assigns of Coopers Brewery Limited ABN 13 007 871 409 5. Employees and their immediate families (of the Promoter) are not permitted to enter the Promotion. 6. Entry is free and open to residents of Australia aged 18 and over ( Entrant ) who enter the Promotion in the manner stipulated in these Terms and Conditions. Duration of the Promotion 7. Entry into the Promotion opens at 8:00am (AEDST) on 24 November 2017 and closes 11.59pm (AEDST) 26 November 2017 ( Promotional Period ). The Prize 8. There will be one prize awarded for this Promotion. The prize is a 2018 Adelaide 500 Experience for two (2) adults (the Prize ) valued at up to $12,000 depending on point of departure. Prize includes: Return economy class airfares for two (2) adults from winner's nearest capital city to Adelaide, SA (only provided if winner resides outside of SA). If the winner is from SA, then the prize does not include airfares and the airfare component of the Prize is not redeemable for cash; Four (4) nights twin share minimum 4star accommodation in Adelaide, SA (exact hotel determined by the Promoter); Tickets to the 2018 Adelaide 500 for two (2) adults between Friday 2 March 2018 and Sunday 4 March 2018 including: o A Corporate Hospitality Package (including food and beverages);
o The opportunity for the winner to drive a Supercars Hot lap in a car competing in the 2018 Adelaide 500 (exact date will be determined by the Promoter); o The opportunity to for two (2) adults to experience a behind the scenes tour of the 2018 Adelaide 500 (exact date will be determined by the Promoter); o The opportunity for two (2) adults to experience an escorted walk on the 2018 Adelaide 500 Supercars Grid prior to a race (exact date will be determined by the Promoter); o The opportunity for the winner to be an official trophy presenter on the 2018 Adelaide 500 podium for one (1) race (exact race will be determined by the Promoter); and o The opportunity for the winner to experience an official Safety Car lap in the 2018 Adelaide 500 as a passenger (exact date will be determined by the Promoter); and A Coopers merchandise pack valued at $300 for the winner. Exact merchandise to be awarded will be determined by the Promoter in its absolute discretion. 9. The Prize must be taken and travelled in full between the specified dates of March 1 - March 5, 2018 to coincide with the 2018 Adelaide 500. All components of the Prize must be taken together and when offered. The winner and his/her companion must travel together and depart from and return to the same departure point. The winner and companion may not accrue frequent flyer points. No extension or variation of the travel dates nominated by the Promoter permitted. All elements of the Prize may be subject to prevailing prize supplier terms and conditions of use. Any additional costs not expressly stated, but which may be incurred in acceptance and use of the Prize, are the responsibility of the winner and his/her companion. Such additional costs include, but are not limited to, additional beverages, additional meals, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, additional transfers, insurance and travel insurance. For the avoidance of doubt, the Prize does NOT include any spending money. Winner may be required to present a credit card at time of accommodation check-in. The Promoter shall not be liable for any costs associated with the Prize after delivery to the winner. How to enter 10. To enter, individuals must undertake the following steps during the Promotional Period: Identify the code word ( Code Word ) that appears on the virtual Coopers signage during the Foxtel and Channel 10 broadcasting of the Coates Hire Newcastle 500 (between 24 November 26 November 2017); Visit www.cooperssupercode.com.au ( Promotional Website ) and follow the prompts on the competition entry page;
Input the requested details including the Code Word, full name, mobile telephone number, current and valid email address, address, state of residence, Post Code and date of birth; and Submit the fully completed online entry form. 11. Entry is limited to one (1) entry per person. There is no cost to enter the Promotion. Entrants may only enter in their own name. 12. Entries will be deemed to be accepted at the time of receipt of the completed online entry form by the Promoter and not at the time of transmission by the Entrant. 13. Entries must be received by the Promoter during the Promotional Period. The Promoter accepts no responsibility for late, lost or misdirected entries. 14. Any costs associated with accessing the Promotional Website is the responsibility of the Entrant and is dependent upon the Internet service provider used by the Entrant. 15. Entries not completed in accordance with these Terms and Conditions or received after the expiry of the Promotional Period will not be considered. The outcome of the draw is final and binding on every person who enters. No correspondence will be entered into by the Promoter. 16. Incomprehensible and incomplete entries will be deemed invalid. 17. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved The Draw 18. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 9.30am (AEDST) on Wednesday 29 November 2017. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 19. If the winner cannot be notified within 60 days, of the original draw date, an unclaimed prize draw will take place at the same time and place as the original draw on Monday 29 January 2018, subject to any directions from a regulatory authority. Notification of winners 20. In the case of the original draw, the winner will be notified by phone and email within two (2) business days of the draw and their name will be published in The Australian Newspaper on Thursday 7 December 2017. 21. In order to claim the Prize, the winner must confirm its desire to do so in writing by
Sunday 28 January 2018. If the winner fails to do this by the deadline, the winner will be deemed to have forfeited the Prize and an unclaimed prize draw will take place. 22. Should an Entrant s contact details change during the Promotional Period, it is the Entrant s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. 23. The Promoter reserves the right to request the winner to provide proof of identity; age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the Prize. Proof of identification, age, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered to the winner by the Promoter. 24. The Promoter reserves the right to request the winner s travel companion (if any) produce proof of identification in order to confirm the travel companion (if any) s identity and age before issuing the Prize. Proof of identification, residency and age considered suitable for verification is at the discretion of the Promoter. 25. Should an unclaimed prize draw occur, the winner will be notified by phone or email within two (2) business day of the draw and their name will be published in The Australian Newspaper on Monday 5 February 2018. 26. The Prize must be taken as offered and is non-refundable, non-transferable and nonredeemable for cash or other goods or services. 27. As a condition of accepting the Prize, the winner (and his/her companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. Privacy 28. The Promoter collects Entrants personal information for the purpose of conducting and promoting this Promotion (including but not limited to determining and notifying the winner). 29. The Entrant s personal information may be disclosed to representatives and agents acting on behalf of the Promoter or assisting the Promoter in the administration of this Promotion, including prize suppliers and deliverers. The personal information provided by Entrants in connection with the Promotion will be used by the Promoter in accordance with these Terms and Conditions and in accordance with the Promoter s privacy policy which can be viewed at www.coopers.com.au. 30. Entrants personal information may be disclosed to State and Territory lottery and regulatory departments (as required) and winners names published as described under these Terms and Conditions and as required under the relevant lottery legislation (as applicable). A request to access, update or correct any personal information of an Entrant should be directed to the Promoter. 31. Each Entrant consents to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this
Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. General Terms 32. This Promotion is conducted by the Promoter. The Promoter s decision is final and no correspondence will be entered into. 33. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 34. The Prize will only be awarded following winner validation and verification that the Promoter requires in its sole discretion. Prizes will only be awarded where the Code Word entered fulfils all of the requirements of the Promoter's verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion. 35. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited. 36. If the/any prize (or part of the/any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the States and Territories of Australia ( Non- Excludable Guarantees ). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the Coates Hire Newcastle 500 or the 2018 Clipsal 500 events are delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize / taking of the prize. 39. The Promoter is not responsible for any incorrect or inaccurate information, either
caused by the Entrant or by any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof, that may occur in the course of the administration of this Promotion. 40. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. 41. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
