No.579, Dated 15th September 2006 (Viya, Aavani 30, Thiruvalluvar Aandu 2037) Pension Refixation of Pension / Family Pension with effect from 1-6-1988 Orders Issued. Read the following:-: 1. 1) G.O.Ms.No.810, Finance (Pension) Department, dated 9-8- 1989 2. 2) G.O.Ms.No.271, Finance (Pension) Department, dated 15-6- 1998 3. 3) Tamil Nadu Administrative Tribunal Order in O.As.7224 / 1998 and 7630 / 1998, dated 11-4-2001 4. 4) The Hon ble Madras High Court Order in W.P.Nos.18751 to 18755, dated 15-12-2005 ***** ORDER: The Fifth Tamil Nadu Pay Commission had recommended different percentage of increase in the pension / family pension of existing pensioners retired / died during various period prior to 1-6-1988. Accordingly, the Government have issued orders in reference first read above, among other things, fixing the pension / family pension with effect from 1-6-1988 for those who retired / died before 1-6-1960 and upto 30-9-1987 whose pension / family pension plus dearness allowance at 608 points per month does not exceed Rs.500/- by increasing the sum total of the basic pension and the related dearness allowance at 608 points ranging from 60% to 20% and
whose pension / family pension plus dearness allowance at 608 points exceeds Rs.500/- by increasing the sum total of basic pension and related dearness allowance at 608 points ranging from 50% to 15%. 2. In the Government Order second read above, the Government have extended the benefit in respect of the pensioners / family pensioners of the Ambasamudram Taluk Pensioner s Association, who retired / died after 1-6- 1960 till 31-5-1988 and whose pension / family pension plus dearness allowance at 608 points per month does not exceed Rs.500/- shall be refixed with effect from 1-6-1988 by increasing the sum total of the basic pension and the related dearness allowance at 608 points by 60% and whose pension / family pension plus dearness allowance at 608 points exceeds Rs.500/- shall be refixed with effect from 1-6-1988 by increasing the sum total of basic pension and related dearness allowance at 608 points by 50%. 3. In the reference third read above, the Tamil Nadu Secretariat Retired Official Association, Chennai and the Tamil Nadu Retired Official Association, DPI Complex, Chennai has filed O.A.7224/1998 and 7630/1998 seeking direction to extend the benefits of orders issued to the reference second read above to them also as they are all similarly placed pensioners / family pensioners. The Tamil Nadu Administrative Tribunal in its order third read above, have passed common orders extending the benefits of the Government Order second read above to the pensioners / family pensioners of the Association. 4. In the reference fourth read above, the Government filed writ petition as against the orders of Tamil Nadu Administrative Tribunal in O.A.7224/1998 and 7630/1998. The writ petition has been dismissed on 15-12-2005 and orders were passed to extend the benefits of the orders issued in the Government Order second read above to the Tamil Nadu Secretariat Retired Official Association, Chennai and the Tamil Nadu Retired Official Association, DPI Complex, Chennai. In view of this, various pension associations / individual pensioners approached the Hon ble High Court and obtain orders in favour of them to extend the benefits of order issued in Government Order second read above. The Government have been issuing orders based on the orders of the Hon ble High Court. 5. The Government after careful consideration, direct that in respect of the pensioners / family pensioners who retired / died after 1-6-1960 till 31-5- 1988 and whose pension / family pension plus dearness allowance at 608 points per month does not exceed Rs.500/- shall be refixed with effect from 1-6-1988 by increasing the sum total of the basic pension and the related dearness allowance at 608 points by 60% and whose pension / family pension plus dearness allowance at 608 points exceeds Rs.500/- shall be
refixed with effect from 1-6-1988 by increasing the sum total of basic pension and related dearness allowance at 608 points by 50%. 6. The Pension Pay Officer / Treasury Officers / Sub-Treasury Officers are requested to revise the pension / family pension as ordered in paragraph 5 above. In the case of pensioners who have died, the life time arrears shall be paid to the legal heirs. For this purpose, the legal heirs shall apply through proper channel for revision of pension along with death certificate and relevant documents. 7. This order shall apply to the Government pensioners, teacher pensioners of aided and local body educational institutions and pensioners of local bodies.
