TERMS AND CONDITIONS: RESERVATIONS AND PAYMENTS: Your reservation will be confirmed in writing upon receipt of the Registration Form and deposit of $2,998.00 per person. Final payment is required by 1 st February 2013. BOOKING AMENDMENTS: Amendment fees prior to final payment will be charged $25 per person per booking. Once final payment has been received, changes to airline reservations are subject to particular airline rules and conditions but a minimum charge of $100 per ticket will apply. Changes to other components of this package will be on request basis and applicable fees will be advised at that time. Once tickets have been issued, name changes are treated as a cancellation by the airline and a fee of $250 will apply. Please ensure the booking name matches the passport details exactly. CANCELLATIONS: Travel insurance is essential and should be requested at time of registration. Subject to policy conditions, travel insurance will cover cancellation due to an unforeseen reason. Notification of cancellation to World Travel Professionals must be received, in writing, before action can be taken. Cancellation of travel package: Cancellation prior to balance payment loss of deposit; cancellation up to 15 days prior to departure 50%; cancellation with 14 days of departure no refund. PASSPORTS, VACCINATIONS AND VISAS: It is the responsibility of each individual to ensure they travel with a passport that has at least six months validity beyond their intended period of stay. Visas are not required for Australian passport holders to visit Morocco. It is essential that you check visa requirements with World Travel Professionals. Vaccinations are the travellers responsibility. PRICE CHANGES: The Heartful Travellers package is quoted in Australian dollars and is based on exchange rates as at November 2012. The package price is subject to change due to influences outside The Heartful Travellers control, such as (but not limited to) currency fluctuations. All monies received by World Travel Professionals will be held in our Client Travel Account (Trust Account) and therefore is covered by the Australian Travel Compensation Fund. ADDITIONAL TERMS 1. Definitions Companies means each of World Travel Professionals Pty Limited (WTP) and The Heartful Travellers Pty Limited (THT), severally, and Company means either of them as the case requires; Claim includes in relation to a person, a demand, claim, action or proceeding made or brought by the person, however arising and whether present, unascertained, immediate, future or contingent; Loss includes any damage, loss, cost, liability or expense of any kind and however arising (including as a result of any Claim), including any that are prospective or contingent and any amounts which for the time being are not ascertained or ascertainable; Personnel of a Company means the officers, employees, contractors (including subcontractors and their own employees), representatives and agents of that Company. 2. Responsibilities of WTP and THT WTP acts as your agent or intermediary to arrange the means of transportation, accommodation, and other services notified to you. These services are subject to the conditions specified by the carriers, hotels, and other suppliers. WTP maintains no control over the personnel, equipment or operations of any airline, charter aircraft, cruise line, bus operator, or other carrier, hotel, tour company or any other supplier. The passage contract in use by the airlines, cruise lines, and other carriers at the time of booking will constitute the sole contract between the carriers and you. The responsibility of any carrier to you is limited to the carrier s contractual and statutory liability. WTP will prepare its materials and render its services in a competent manner. THT acts as a tour guide to facilitate your enjoyment of your time away. It will prepare its materials and render its services in a competent manner. 3. Limitation of liability 3.1 To the maximum extent permitted by law:
3.1.1 All terms, conditions, warranties and statements (whether express, implied, written, oral, collateral, statutory or otherwise) in connection with the transactions contemplated by these terms which are not expressly set out in these terms are excluded and, to the extent they cannot be excluded, each Company disclaims all liability that it may have in relation to them. 3.1.2 In particular, each Company assumes no responsibility for, and will not be liable for, any financial loss, personal injury, death, property loss or damage,other loss, accident, delay, inconvenience, or irregularity that you or any of your companions may suffer by reason of any act, omission, default, nonperformance or wrongful misconduct, or any careless, negligent, or unauthorised act or omission of any supplier, any supplier s employee, or any other third party, or from any other services utilised, or for any nonperformance, delay, misconnection, mechanical failure or any other act or omission of any nature caused in whole or in part by any occurrence, condition, or circumstance beyond that Company s reasonable control, including, but not limited to, acts of God, fire, casualty, national or local emergency, shortages, riot, strike, lockout, any other labour difficulty, storm or similar occurrence, or any law, order, regulation, action, or request or demand of any government or any official or instrumentality of any government. 3.1.3 No Company is liable to you in contract, in tort (including negligence), under any statute or otherwise for, or in respect of, any indirect or consequential loss or damage suffered by you or any other person arising out of any breach or other act or omission in connection with these terms. 3.2 The parties agree that indirect or consequential loss or damage, for the purpose of clause 3.1.3 means or includes: (a) any financial loss or expense including loss of business opportunity, including where caused by loss of use or of goodwill, loss of data or delay in the performance of any obligation; (b) any expense incurred in connection with that loss or in mitigation or attempted mitigation of that loss; and (c) payment of liquidated sums or damages in accordance with any other agreement, even if those losses were in the contemplation of the parties at the time they entered into this agreement. 3.3 Except as expressly set out in these terms, you release each Company and each of its Personnel from (i) all Claims, whether in tort (including negligence), statute, contract, or otherwise; and from (ii) all Losses which you have or may have after the date of this agreement which arise out of the subject matter of these terms. You acknowledge and agree that each of these people is entitled to the benefit of the release, which may be enforced by either Company on behalf of any of them. Each Company holds on trust for those people, jointly and severally, the benefit conferred by this clause 3.3. 3.4 Where any condition, warranty or right is implied by law and cannot be excluded, each Company limits its liability for breach of that implied condition, warranty or right: (a) in the case of goods supplied, to any one or more of the following (as each Company may determine): (i) the replacement of the goods or the supply of equivalent goods; (ii) the repair of the goods; (iii) the payment of the costs of replacing the goods or of acquiring equivalent goods; or (iv) the payment of the costs of having the goods repaired; and (b) in the case of services supplied, to one of the following (as each Company may determine): (i) the supplying of the services again; or (ii) the payment of the costs of having the services supplied again. 3.5 Subject to clauses 3.1, 3.2, 3.3, and 3.4 and except in the case of any claim for damages arising from the death of, or injury to, any person caused by any wilful or negligent act or omission of either Company, but otherwise notwithstanding anything else to the contrary contained in or implied in these terms, any liability which either Company may have to you in relation to breach of an obligation: (a) in relation to the goods or services, will be limited to the remedies set out in clauses 3.4(a) and 3.4(b); and (b) otherwise, for the aggregate of all events, is limited to the total fees then paid by you under these terms. 3.6 Where any term or part of a term is void or voidable, it is to be taken to be severed to the extent required to retain the rest of the term or part thereof.
