Anna de Luca (Università Commerciale Luigi Bocconi) Lucian ILIE (Senior Associate at Lazareff Le Bars) Investment protection based on international treaties has been available to investors for some time now. However, there is a gradual change to this mechanism due to steps taken by the EU Commission, including to create an Investment Court. In the case of BITs, the issue evolved with the Romanian Micula case, followed up by infringement proceedings against Austria, the Netherlands, Romania, Slovakia and Sweden and today with the AG Wathelet opinion on these issues. What are the issues at stake and the current developments? 4.55 Panel II Recent Enforcement Problems under the New York and ICSID Conventions Benoit Le Bars (Managing Partner, Lazareff Le Bars Adrian Iordache (Managing Partner, Iordache Partners) The effectiveness of international arbitration depends ultimately on the question whether the arbitral award can be enforced against the losing party. Therefore, the arbitral process cannot be completely divorced from national courts. Dr Crina Baltag is a senior lecturer in law and an attorney-at-law specialized in investment and commercial arbitration. Crina received her Ph.D. from Queen Mary University of London, under the supervision of Professors Julian Lew and Loukas Mistelis. Crina holds an LL.M. in International Commercial Arbitration from Stockholm University and a M.Sc. in International Business from the Academy of Economic Studies, Romania. She is a graduate of the Faculty of Law, University of Bucharest. Crina was associated with law firms from Romania, Austria and the U.K. and she lectured at Queen Mary University of London; FGV Law, Rio de Janeiro; and Stockholm University. Crina also acted as the Secretary General of the Amcham Brazil Arbitration and Mediation Center. Currently, Crina is a Senior Lecturer at the Department of Law and Finance of the University of Bedfordshire, UK, teaching the courses on International Commercial Arbitration, Investment Treaty Arbitration and International Commercial Litigation. She is also the acting editor of the Kluwer Arbitration Blog and she regularly publishes on international commercial and investment arbitration. Crina regularly sits as an arbitrator in international and domestic arbitrations. Her latest book, ICSID Convention after 50 Years: Unsettled Issues (ed.) was released by Wolters Kluwer in 2017. Dr Anna De Luca is an international economic law scholar and practitioner specialized in international investment law & arbitration, European trade and investment policy and treaties, and European internal market. She has been practising in the field of investment arbitration since 2007. Since 2016 she is a member of the ICSID panel of conciliators and of the list of arbitrators at the Bucharest International Arbitration Court. She regularly lectured on international investment law, European external relations, and trade law at Bocconi, where I worked as a research fellow in international law from November 2010 to October 2014. She is a prolific author in International Investment Law, International Arbitration, and European investment policy. She is coeditor of General interests of Host States in International Investment Law, Cambridge University Press, 2014. Recent publications focus on Trade and Investment Law & Energy, Investment Arbitration & Finance and Banking, and Investor-State Arbitration and the law of State responsibility. She is a frequent speaker at international conferences and seminars on international arbitration, investment law and trade matters. Anna acts as Liaison Office for the Italian Association for Arbitration (Associazione Italiana per l'arbitrato, AIA) since 2015. As liaison office she provides technical opinions on draft provisions of the trade and investment agreements under discussion to the competent Italian authorities in the interest of the AIA, when requested.

Benoit Le Bars, co-founder and Managing Partner of Lazareff Le Bars, represents clients in international arbitration and ADR. His practice focuses mainly on commercial and investment arbitration involving complex trade relationships between businesses, investors and states, and spans a broad range of jurisdictions and arbitral institutions. In addition to his work as counsel, he is often appointed as arbitrator and has extensive experience in arbitral forums. Benoit Le Bars is also known for his strong engagement in business and law in Africa, and is a recognized specialist in OHADA law. Furthermore he launched a magazine focused on entrepreneurship in Africa (MIDAA) and he was appointed by the Intergovernmental Authority on Development (IGAD) and the Djibouti Chamber of Commerce to co-head the legal task force to establish the new IGAD Arbitration Centre in Djibouti. In the same year, Benoit received the prestigious "Cauris d'or de l'intégration" from Mr. Sidiki Kaba, Minister of Justice of Senegal. Benoit is also an academic teaching arbitration and international corporation in France and the US. He also lectures in various professional conferences and published several books about international arbitration, international commerce law and Ohada. In 2017 he launched a blog dedicated to international arbitration (internationalarbitrationlaw.com).

Lucian ILIE is a Senior Associate at Lazareff Le Bars and specialises in international arbitration (commercial and investment), EU law and transnational litigation (private and public international law). He represents companies and States and acts as secretary to the tribunal in international arbitration proceedings, under various arbitration rules (such as ICSID, UNCITRAL, PCA, ICC, LCIA) and in various industry sectors (including construction, telecom and energy). Prior to joining Lazareff Le Bars, Lucian acquired experience in arbitration and EU litigation, while practicing at different international law firms in Paris, as well as at the EU General Court in Luxembourg and within the Legal Service of the European Commission in Brussels. Lucian holds a dual civil law/common law bachelor s degree from the University of Toulouse and the University College Dublin. In addition, he obtained a Master s degree in International and European Law from the University of Toulouse, as well as an LL.M. in International Dispute Resolution from Queen Mary University of London. Lucian is a lecturer at the University of Toulouse where he teaches international arbitration and EU law. He is a member of the Paris and Bucharest Bars.

Adrian is a member of the Administrative Council of the Bucharest International Arbitration Court (BIAC) and is a listed arbitrator of the institution. Adrian holds advanced degrees from University College London in the UK and Mount Allison University in Canada and is currently a Doctoral Researcher in Public Law at University of London s School of Advanced Studies.
