[(a) () Within days from the filing of the report required by of this subtitle, the Administrator shall cause notice to be published in a newspaper of general circulation in the county in the State within which is located the last known address of any person to be named in the notice. () If an address is not listed or if the address is outside the State, the notice shall be published in the county within which the person who held the abandoned property has the principal place of business in this State. (b) The published notice shall be entitled Notice of Names of Persons Appearing to Be Owners of Abandoned Property and shall contain: () The names in alphabetical order and last known addresses, if any, of persons listed in the report and entitled to notice in the county specified in this section; () A statement that information concerning the amount or description of the property and the name and address of the person who held the property may be obtained by any person who possesses an interest in the property, by addressing an inquiry to the Administrator; and () A statement that a proof of claim may be presented by the owner to the Administrator. SENATE BILL 0 (d) Within days from the receipt of the report required by of this subtitle, the Administrator shall mail a notice to each person who has an address listed in the report who appears entitled to property valued at $0 or more and presumed abandoned under this subtitle. (e) The mailed notice shall contain: () A statement that, according to a report filed with the Administrator, property is being held to which the addressee appears entitled; () The name and address of the person who held the property and any necessary information regarding any change of the name or address of the holder; and () A statement that a proof of claim may be presented by the owner to the Administrator. Article Courts and Judicial Proceedings. (a) State. Each circuit court judge shall have one law clerk, to be employed by the 0 0 (b) The budget for the Administrative Office of the Courts shall include funds to employ one law clerk for each circuit court judge. [() (i) Except as provided in subparagraph (ii) of this paragraph, the increase in the amount of a base grant for student transportation that is based on the increase in the private transportation category of the Consumer Price Index may not be less than percent nor more than percent of the amount of the grant for the previous year. (b) () Except as provided in paragraph () of this subsection, the Maryland School for the Deaf shall receive an appropriation equal to or greater than the sum of: product of: (i) % of the prior year appropriation multiplied by the

() The minimum appropriation required under paragraph () of this subsection may be reduced to the extent reductions are made to the administrative expenses of the Maryland School for the Deaf.. (a) () Per pupil basic current expense figure means the figure calculated for each fiscal year by the Department in accordance with 0 of this article. (b) () Except as provided in paragraph () of this subsection and subsection (c) of this section, the Maryland School for the Blind shall receive an appropriation equal to or greater than the sum of: product of: (i) % of the prior year appropriation multiplied by the 0 and. The sum of the weighted enrollment growth plus one; 0. The sum of the growth in the per pupil basic current expense figure plus one; and (ii) % of the prior year appropriation multiplied by the sum of the weighted enrollment growth plus one. (c) The prior year appropriation used to calculate the fiscal year 000 appropriation to the Maryland School for the Blind shall be $,,.. () Nonpublic general education school means a nonpublic school approved under COMAR A.0. pursuant to 0 of this article and operated in

SENATE BILL 0 0 0 conjunction with residential or nonresidential child care programs licensed or approved by the Department, the Department of Health and Mental Hygiene, the Department of Human Resources, or the Department of Juvenile Services. () Nonresidential child care program means a program that: (i) Provides services for children in a nonresidential setting, designed to achieve objectives related to the needs of children at risk of out of home placement; and (ii) Is licensed or approved by the Department of Health and Mental Hygiene, the Department of Human Resources, or the Department of Juvenile Services. () Residential child care program means a program that: (i) Provides care for children hours a day within a structured set of services and activities designed to achieve objectives related to the needs of the children served; and (ii) Is licensed by the Department of Health and Mental Hygiene, the Department of Human Resources, or the Department of Juvenile Services. (b) () The Department of Education, as the fiscal agent of the Children s Cabinet Fund under Title, Subtitle of the Human Services Article, shall administer and implement a redesigned rate setting process for nonpublic general education schools, residential child care programs, and nonresidential child care programs. () The Department of Human Resources, the Department of Juvenile Services, the Department of Budget and Management, the Department of Health and Mental Hygiene, and the Governor s Office for Children shall participate with the Department in the development and implementation of rates in programs licensed or approved by those agencies to the extent required by federal and State law. (c) () A decision as to the amount or implementation of rates established under this section may be appealed by sending a written request for appeal to the Children s Cabinet. () The request shall set forth the specific objections to the decision as to the amount or implementation of rates established under this section. () The Children s Cabinet or designees shall issue a final, binding opinion upholding, reversing, or modifying the rates set by the Interagency Rates Committee within 0 days after receipt of the request for appeal.

(b) [() Subject to paragraph () of this subsection, beginning in fiscal year 00, the Governor shall appropriate at] THE DEPARTMENT SHALL DETERMINE: () THE TOTAL TRANSPORTATION, BOARDING, AND ADMINISTRATIVE COSTS OF A PROGRAM TO BE PAID BY THE COUNTY BOARDS UNDER THIS SECTION EQUAL TO: (I) AT least $,000,000 [to the Department] in order for a program to serve up to 0 students[.]; AND [()] (II) For each additional students enrolled in a program, [as reported by the Department, the Governor shall appropriate] an additional $0,000; AND () A PER PUPIL SHARE OF THE TOTAL COSTS DETERMINED UNDER ITEM () OF THIS SUBSECTION. [() The total amount of funds appropriated under this subsection may not exceed $,000,000 for any fiscal year.] (C) EACH COUNTY BOARD SHALL PAY TO THE DEPARTMENT THE PER PUPIL SHARE DETERMINED UNDER SUBSECTION (B) OF THIS SECTION FOR EACH STUDENT WHO PARTICIPATES IN A PROGRAM BUT IS DOMICILED IN THE COUNTY. [(c)] (D) This section may not be construed to prohibit a program from receiving funds from private, federal, or other sources. 0. SENATE BILL 0 0 0 full time equivalent student to the year public institutions of higher education in the State as designated by the Commission for the purpose of administering the Joseph A. Sellinger Program under Title of this article in the same fiscal year. (ii) For purposes of this subsection, the State s General Fund appropriation per full time equivalent student to the year public institutions of higher education in the State for a fiscal year shall include noncapital appropriations from the Higher Education Investment Fund] AN AMOUNT EQUAL TO NOT LESS THAN $,00 PER FULL TIME EQUIVALENT STUDENT.. (a) The Maryland Higher Education Commission shall determine which institutions are eligible for aid under this subtitle. (b) To qualify for State aid under this subtitle, an institution of higher education shall HAVE A TOTAL ENDOWMENT OF LESS THAN $,000,000,000 AND SHALL: () Be: (i) A nonprofit private college or university that was established in the State before July, 0; (ii) A nonprofit private institution of higher education that formerly received State aid as a component of a private college or university that was established in this State before July, 0; or (iii) A private nonprofit institution of higher education that is established in this State and grants an associate of arts degree; () Be approved by the Maryland Higher Education Commission; () Be accredited by the Commission on Higher Education of the Middle States Association of Colleges and Schools; () Have awarded the associate of arts or baccalaureate degrees to at least one graduating class; () Maintain one or more earned degree programs, other than seminarian or theological programs, leading to an associate of arts or baccalaureate degree; and () Submit each new program and each major modification of an existing program to the Maryland Higher Education Commission for its review and recommendation as to the initiation of the new or modified program.

(a) [The] FOR EACH FISCAL YEAR, THE Maryland Higher Education Commission shall compute the amount of the annual apportionment for each institution that qualifies under this subtitle by multiplying the number of full time equivalent students enrolled at the institution during the fall semester of the fiscal year preceding the fiscal year for which the aid apportionment is made, as determined by the Maryland Higher Education Commission by[: () In fiscal year 00, an amount not less than % of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the preceding fiscal year; () In fiscal year 0, an amount not less than.% of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in the State for the same fiscal year; () In fiscal year 0, an amount not less than % of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the same fiscal year; () In fiscal year 0, an amount not less than.% of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the same fiscal year; () In fiscal year 0, an amount not less than % of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the same fiscal year; () In fiscal year 0, an amount not less than.% of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the same fiscal year; and () In fiscal year 0 and each fiscal year thereafter, an amount not less than.% of the State s General Fund per full time equivalent student appropriation to the year public institutions of higher education in this State for the same fiscal year] AN AMOUNT NOT LESS THAN $. Article Environment. (f) There is a Maryland Oil Disaster Containment, Clean Up and Contingency Fund for the Department to use to develop equipment, personnel, and plans; for contingency actions to respond to, contain, clean up, and remove from the land and waters of the State discharges of oil, petroleum products, and their by products into, upon, or adjacent to the waters of the State; and restore natural

SENATE BILL 0 0 0 resources damaged by discharges. THE FUND MAY ALSO BE USED BY THE DEPARTMENT FOR WATER POLLUTION CONTROL PROGRAMS. The cost of containment, clean up, removal, and restoration, including attorneys fees and litigation costs, shall be reimbursed to the State by the person responsible for the discharge. The reimbursement shall be credited to the Fund. The Fund shall be limited in accordance with the limits set forth in this section. To this sum shall be credited every license fee, fine, if imposed by the circuit court for any county, and any other charge related to this subtitle. To this Fund shall be charged every expense the Department of the Environment has which relates to this section. (g) Money in the Fund not needed currently to meet the Department of the Environment s obligations in the exercise of its responsibility under this section shall be deposited with the State Treasurer to the credit of the Fund, and may be invested as provided by law. Interest received on the investment shall be credited to the Fund. The Secretary of the Environment shall determine the proper allocation of the moneys credited to the Fund only for the following purposes: () Administrative expenses, personnel expenses, and equipment costs of the Department related to the purposes of this section[.]; () Prevention, control, containment, clean up, and removal of discharges into, upon, or adjacent to waters of the State of discharges of oil, petroleum products and their by products, and the restoration of natural resources damaged by such discharges[.]; () Development of containment and clean up equipment, plans, and procedures in accordance with the purposes of this section[.]; () Paying insurance costs by the State to extend or implement the benefits of the Fund; AND () EXPENSES RELATED TO THE DEPARTMENT S WATER POLLUTION CONTROL PROGRAMS. (a) For fiscal year 0 [and fiscal year 0], the Governor shall include at least $,000,000 in the annual budget in appropriations for activities aimed at reducing tobacco use in Maryland as recommended by the Centers for Disease Control and Prevention, including: () Media campaigns aimed at reducing smoking initiation and encouraging smokers to quit smoking; () Media campaigns educating the public about the dangers of secondhand smoke exposure;

SENATE BILL 0 () Enforcement of existing laws banning the sale or distribution of tobacco products to minors; and () Promotion and implementation of smoking cessation programs; () Implementation of school based tobacco education programs. 0 0 (b) For fiscal year [00] 0 AND EACH FISCAL YEAR THEREAFTER, the Governor shall include at least [$,000,000] $,000,000 in the annual budget in appropriations for the purposes described in subsection (a) of this section.. (II) For fiscal year [0 and fiscal year 0] 0 AND EACH FISCAL YEAR THEREAFTER, the Governor shall include at least $,0,000 in the annual budget in appropriations for the Statewide Academic Health Center Tobacco Related Diseases Research Grant under this section.. (a) () (I) FOR EACH OF FISCAL YEARS 0 AND 0, THE GOVERNOR SHALL INCLUDE AT LEAST $0,000 IN THE ANNUAL BUDGET IN APPROPRIATIONS FOR THE STATEWIDE ACADEMIC HEALTH CENTER NETWORK GRANT UNDER THIS SECTION. (II) For fiscal year [0 and fiscal year 0] 0 AND EACH FISCAL YEAR THEREAFTER, the Governor shall include at least $,00,000 in the

SENATE BILL 0 0 0 annual budget in appropriations for the Statewide Academic Health Center Network Grant under this section. 0. (a) In fiscal year 00, the Governor shall include in the State budget an appropriation in the amount of $,000 for the Child Abuse Medical Providers (Maryland CHAMP) Initiative. (b) In each fiscal year beginning with fiscal [00] 0, the Governor shall include in the annual budget bill submitted to the General Assembly a General Fund appropriation for the Child Abuse Medical Providers (Maryland CHAMP) Initiative in an amount not less than the amount of the General Fund appropriation for the Initiative as approved in the State budget as enacted by the General Assembly for the prior fiscal year[, increased by not less than the percentage by which the projected total General Fund revenues for the upcoming fiscal year exceed the revised estimate of total General Fund revenues for the current fiscal year, as contained in the report of the estimated State revenues submitted by the Board of Revenue Estimates to the Governor under (b) of the State Finance and Procurement Article].. [(c) The Governor shall include in the annual budget State general funds of at least $0,000 to cover the administrative and food costs of the Program.].. (b) () The Department may impose a quality assessment on each freestanding nursing facility subject to this section. () The amount assessed in the aggregate on all nursing facilities may not exceed [%] % of the operating revenue for all nursing facilities subject to this section for the previous fiscal quarter. [() The aggregate annual assessment may not exceed the amount necessary to fully fund the nursing facility payment system taking into consideration any other revenue source or cost savings the Department determines could be used to reduce funding shortfalls.] [()] () The assessment authorized by this section shall be paid by each nursing facility in accordance with this section. (c) () On or before the 0th day after each quarter of the State fiscal year, each nursing facility subject to this section shall pay to the Comptroller an amount determined by the Department based on an amount per non Medicare day of service for the previous fiscal quarter.

SENATE BILL 0 () The assessment shall be based on an amount per patient day, not including Medicare days[, necessary to fully fund the nursing facility payment system as provided under subsection (b)() of this section]. (d) () All amounts collected by the State Comptroller under this section shall be distributed to a special fund, to be used by the Department only to fund reimbursements to nursing facilities under the Medicaid program. Article Insurance. (d) () Notwithstanding subsection (c) of this section, a nonprofit health service plan that is subject to this section and issues comprehensive health care benefits in the State shall: (i) offer health care products in the individual market; 0 0 (ii) offer health care products in the small employer group market in accordance with Title, Subtitle of this article; (iii) subsidize the Senior Prescription Drug Assistance Program established under Subtitle, Part II of this title; (iv) subsidize the [Maryland Pharmacy Discount Program] KIDNEY DISEASE PROGRAM ESTABLISHED under [.] TITLE, SUBTITLE of the Health General Article; and (v) support the costs of the Community Health Resources Commission under Title, Subtitle of the Health General Article, including:. operating grants to community health resources;. funding for a unified data information system;. the documented direct costs of fulfilling the statutory and regulatory duties of the Commission; and
