BACKGROUND: As part of the City s focus on maintaining and providing affordable housing, in October 2016 the City issued a Request for Proposals soliciting qualified firms to provide professional planning and economic analysis services for a Housing Fee Study. The City has adopted an Affordable Housing Linkage Fee and requires major developers to construct affordable housing units through various development agreements. However the City does not have a consistent mechanism to ensure that all new development contributes a fair share towards to the affordable housing stock. Three firms responded with quality proposals and after interviews with each firm, staff is recommending Economic & Planning Systems, Inc. (EPS) of Oakland, California to complete the study. ANALYSIS: EPS has worked on numerous housing studies in a variety of jurisdictions in Sonoma County and is well-equipped to complete this project for Rohnert Park in a quality, costeffective, and timely manner. In addition to conducting an analysis and nexus study to establish an inclusionary housing in-lieu fee and identify revisions to the City s Inclusionary Housing Ordinance, EPS has also proposed a Commercial Linkage Fee Nexus Analysis to update the City s current Affordable Housing Linkage fee. City staff believes these additional tasks will provide significant value and useful additional guidance on how to maximize the production of affordable housing in Rohnert Park. The cost of the proposed services is $48,655. A budget amendment of $80,000 in total is proposed to account for staff time, City Attorney review and other associated expenditures required for this project. ITEM NO. 7C1 Develop a Vibrant Community by developing financial sources for more diverse housing affordable to a broader spectrum of the community. OPTIONS CONSIDERED: Option 1. Adopt the resolution to authorize the City Manager to approve the consultant services agreement with ESA. This is the recommended option. Option 2. Do not approve the resolution. The City may elect to use current City staff to conduct the Housing Fee Study. This option is not recommended as the current workload of Development Services exceeds the staffing capacity to perform this work at this time and because staff does not have the specialized expertise that EPS will bring to the assignment. Additional delay on conducting an updated fee study to justify the Inclusionary Housing In- Lieu Fee would stall the City s efforts to fulfill its housing affordability goals. FISCAL IMPACT/FUNDING SOURCE: The Housing Fee Study is proposed to be funded by an assignment of fund balance in Acct. #001-0000-256-2555 which is restricted for housingrelated uses. The original funding source for this account is revenue from the existing Inclusionary Housing In-Lieu Fee. Rohnert Park Municipal Code, Sec. 17.07.020 N Inclusionary Housing authorizes the establishment the inclusionary housing in-lieu fee, which can be used for reasonable expenses for administering the process of calculating, collecting, and accounting for inclusionary fees and any deferred city fees. The housing consultant and associated costs for this proposed Housing Fee Study are authorized uses of these monies. The Housing Fee Study is proposed as a new budget line item (Acct. #001-1600-400-6331) with an appropriation of $80,000 in the Development Services operational budget. This will include the consultant contract costs and associated staff time and materials. The attached resolution authorizes the Finance Director to effectuate the necessary budget amendment, proposed appropriations and funding transfers needed for this Housing Fee Study project. RESOLUTION NO. 2017-014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ROHNERT PARK AUTHORIZING THE CITY MANAGER TO EXECUTE CONSULTANT SERVICES AGREEMENT WITH ECONOMIC & PLANNING SYSTEMS, INC. (EPS) FOR A HOUSING FEE STUDY AND AUTHORIZING FINANCE DIRECTOR TO EFFECT RELATED ACTIONS WHEREAS, the City desires to update its programs for the creation and preservation of affordable housing, including fee programs and municipal code updates; and WHEREAS, pursuant to Section 3.6.6 of the City s Purchasing Policy, City staff issued a Request for Proposals in October 2016 for professional planning and economic analysis services for an housing in-lieu fee study and received three responsive proposals; and WHEREAS, City staff evaluated the three proposals and interviewed each proposing firm, and recommends Economic & Planning Systems, Inc. (EPS) of Oakland, California as the most qualified firm to complete the study; and WHEREAS, the City and EPS desire to enter into a Consultant Services Agreement ( Agreement ) for the Housing Fee Study. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Rohnert Park that it does hereby authorize the City Manager to execute Consultant Services Agreement by and between Economic & Planning Services, Inc., a California Corporation, and the City of Rohnert Park, a municipal corporation, for consultant services in an amount not to exceed Forty Eight Thousand Six Hundred Fifty Five Dollars ($48,655.00). BE IT FURTHER RESOLVED that the City Manager is hereby authorized and directed to take all actions to effectuate the Consultant Services Agreement for and on behalf of the City of Rohnert Park, including execution, if necessary, in substantially similar form to the Agreement attached hereto and incorporated by this reference as Exhibit A, subject to minor modifications by the City Manager or City Attorney. BE IT FURTHER RESOLVED that the Finance Director is authorized to amend the Development Services budget, make appropriations and transfer funds as necessary to cover the costs of Housing Fee Study.
