Eah of the Obligors (other than Obligor 1 if it is a shelf ompany) hereby agrees and aknowledges to the CRA that the provision of any redit report by the CRA to the HKMC (or the Insurer, where appliable) or the use of any suh redit report by the HKMC (or the Insurer, where appliable) shall not be made the basis of any omplaint, laim, suit, demand, ause of ation or other proeeding against the CRA by him/her or any third party, and further agrees that a opy or an eletroni reord of this Appliation Form bearing the signatures of the relevant Obligors shall, for the purpose of paragraph 12 above and this paragraph, have the same effet as if it were the original thereof. 14. The loan in relation to whih this appliation is made will be seured by an equitable mortgage or a first legal harge/mortgage over the Property. 15. The Lender, the HKMC (or the Insurer, where appliable) and the mortgage reinsurers will rely on the information ontained herein to approve this appliation and the relevant appliation for mortgage insurane / reinsurane overs and eah of the Obligors has a ontinuing obligation to amend or supplement the information/douments provided in this appliation if any of the material fats whih eah of the Obligors has dislosed herein should hange prior to the drawdown of the loan herein applied for. 16. In the event any payments on the loan under this appliation beome delinquent, the Lender may, in addition to all rights and remedies, report the name(s), aount(s) and other information of eah of the Obligors to the CRA either by itself or through its relates bodies; 17. Eah of the Obligors will provide further information and furnish other douments as the Lender and the HKMC (or the Insurer, where appliable) may require from time to time, failing whih the grant of loan may be anelled. 18. By making any intentional or negligent misrepresentation(s) or false delaration, providing false information and/or omitting to provide relevant information in onnetion with this appliation, eah of the Obligors (and, if relevant, the shareholders, diretors and/or authorised representatives of Obligor 1 if it is a shelf ompany) may inur ivil and/or riminal liability. In addition, the appliation for the loan or the mortgage insurane over may be rejeted and, if granted, the Lender and the HKMC (or the Insurer, where appliable) reserve the right to anel the loan and the mortgage insurane over or, if onsidered appropriate, impose additional premium or onditions thereon. 19. Eah of the Obligors shall keep the Lender informed of any hange of fats or irumstanes whih may render any information, statements, representations and/or partiulars given hereunder, inorret or untrue before the drawdown and eah of the Obligors understands the non- dislosure of any suh fats or irumstanes may amount to making intentional or negligent misrepresentation(s) and/or providing fraudulent information as mentioned in paragraph 18 above. Additional Delaration and Undertaking in relation to a Non Owner-Oupied Property Loan 20. In respet of a Non Owner-Oupied Property Loan and where Obligor 1 is a shelf ompany, eah of the Obligors hereby agrees, delares, onfirms, aknowledges and undertakes that: (a) Obligor 1 is not and will not at the time of drawdown of the loan be engaged in any business ativities other than the holding of the Property and the letting thereof; and (b) the relevant mortgage will be registered with the Hong Kong Companies Registry (for Hong Kong inorporated ompany) or that other similar registration will be ompleted (for foreign inorporated ompany) within the appliable time limit, and doumentary evidene of any suh registration shall be provided to the Lender and/or the HKMC (or the Insurer, where appliable) within a reasonable time. Handling of Personal Data (where appliable) 21. In relation to personal data and any other information provided on any other person(s) other than the Obligors (if any), the relevant Obligor(s) hereby represent(s) and warrant(s) that he/she/they have obtained the onsent of, and is/are duly authorised by, suh person(s) to dislose suh personal data and information to the Lender and the HKMC (or the Insurer, where appliable) in this Appliation Form or in any other doument, media, reord or forms submitted or to be submitted to the Lender and the HKMC (or the Insurer, where appliable), and to provide the aknowledgement, agreement and authorisation referred to in this Delaration on his/her behalf, and for suh personal data and information to be provided to the HKMC (or the Insurer, where appliable) by the Lender in onnetion with the appliation for the loan and the mortgage insurane / reinsurane overs, and that the Lender and the HKMC (or the Insurer, where appliable) may rely on suh aknowledgement, agreement and authorisation referred to in this Delaration as if it is given diretly by suh individual to the Lender and the HKMC (or the Insurer, where appliable). 22. For the purpose of the Lender s appliation for the mortgage insurane / reinsurane overs, the Obligor(s) hereby authorise(s) the Lender to provide information (inluding douments) and to make representations and statements to the HKMC (or the Insurer, where appliable) based on and relying upon the douments, information, representations and statements given/made by the Obligor(s) in this Appliation Form (inluding his/her/their personal data). 23. The Obligor(s) has(have) read and understood the ontents of the personal information olletion statements (Lender s PICS) of the Lender in relation to the Personal Data (Privay) Ordinane (whih aompanies this Appliation Form or whih has been provided by the Lender to the Obligor(s) and to eah individual whose personal data may be provided through the Obligor(s)) and hereby onsent(s) to the olletion, handling, use, dislosure and transfer by the Lender and the HKMC (or the Insurer, where appliable) of his/her/their personal data in the manner set out in the Lender s PICS. 24. The original (as well as opies) of this Appliation Form and all douments provided in relation to this appliation may be retained by the Lender and/or the HKMC (or the Insurer, where appliable) (as appliable) for their reords in aordane with their respetive data/doument retention poliy and the Personal Data (Privay) Ordinane even if the loan under this appliation is not approved by the Lender. 25. The Obligor(s) has (have) read and understood the ontents of the personal information olletion statements of the HKMC (HKMC s PICS) in relation to the Personal Data (Privay) Ordinane (whih aompanies this Appliation Form or whih has been provided by the Lender at the website (https://www. s.om/global/av/hk-personal-information-olletion-statement.pdf)) and hereby onsent(s) to the olletion, handling, use, dislosure and transfer by the HKMC of his/her/their personal data in the manner set out in the HKMC s PICS. Eah of the Obligors understands that he/she an all the Lender s ustomer servie hotline at 2886 8868 if he/she has any queries in relation to the HKMC s PICS. 26. Eah of the Obligors aknowledges and agrees that: (i) the following terms & onditions have been provided and made available to him/her/it/them at any of the Lender s branhes and/or on website at http://www.s.om/hk: (a) the Mortgage Faility Terms; (b) Additional Terms and Conditions where part of the Faility is insured under Mortgage Insurane Programme Relating to Residential Mortgage, Equitable Mortgage and Relevant Legal Charge; () Client Terms and the appliable douments referred to in Part A thereof (banking agreement); and (d) If the Obligor(s) is/are applying for the Home BonusPak, Home BonusPak Terms and Conditions, the Priority Banking / Premium programme / Easy Banking Terms and Conditions (inluding Important Notes on Appliation), the Credit Card Terms and the Terms and Conditions for Standard Chartered Credit Card Appliation and Highlights of Credit Card Terms. The above terms and onditions shall olletively be referred to as the relevant T&Cs. (ii) eah of the Obligors has read and understood the relevant T&Cs and agrees to be bound by them; (iii) eah of the Obligors is further bound by any variation the Lender makes to the relevant T&Cs. In partiular, eah of the Obligors understands that by entering into the relevant T&Cs, eah of the Obligors gives indemnities, authorisations, onsents and waivers and agrees to limitations on the Lender s liability as set out in the relevant T&Cs; and (iv) Credit Card Appliation Delaration To: Standard Chartered Bank (Hong Kong) Limited (hereinafter alled the Bank, we, us or our inluding our suessors and assigns) By signing this appliation: you (being the person named as the appliant in the appliation) represent and warrant that all information (inluding any douments) you have given to us (being eah member of the Standard Chartered Group identified in the appliation or the approval as the person providing the faility, produt or servie to you, and its suessors and assigns) in onnetion with this appliation is orret, omplete and not misleading important note: if this is not the ase you may be personally liable.
