HOMER BOOGIE JOSEPH COMMUNITY CENTER FACILITY USE AGREEMENT General Provisions The Homer Boogie Joseph Community Center, formerly known as the Cornland Community Center, located at 366 NW 2 nd Street, Reserve, Louisiana, is a Parish-owned facility available for use as an educational, instructional, and training outlet and resource center for residents of St. John the Baptist Parish. Individuals or partners interested in providing like programming at the Center must be residents, non-profit social groups, or non-commercial entities domiciled in St. John the Baptist Parish. The Center is not available for social, religious, or political gatherings. Request Provisions The use of the Center shall be based on a properly documented Homer Boogie Joseph Community Center Facility Use Agreement available from the Department of Health & Human Services and can be downloaded from the Department s webpage on the Parish s website. This agreement shall contain and is not limited to the following: 1. A hold harmless statement having the effect of holding St. John the Baptist Parish free from any liability that may arise while the facility is in use. 2. User (herein referred to as Occupant ) acknowledging receipt and agreement to the terms and guidelines indicated in the Facility Use Agreement. 3. Occupant shall assume all responsibility for damages and maintenance expenses incurred directly or indirectly resulting from use. Policy on Use of Facility 1. The Center shall be reserved based on the Facility Use Agreement. 2. A visual inspection by both the Parish and Occupant shall take place prior to and after the event. An inspection checklist shall be signed by both parties and attached to the Facility Use Agreement. 3. Should occupant be allowed to bring property on the premises, the Parish assumes no responsibility for such property. Occupant shall remove all such property upon departure. 4. Individuals must be 21 years of age or older to reserve the facility. Unsupervised events for underaged groups are prohibited. 5. The Parish reserves the right to have access to the premises and have a representative present at all times. 6. The Parish has the right to prohibit use of the facility that when such use violates federal, state and/or local laws. 7. The maximum occupancy capacity for the facility is in accordance with the State Fire Marshall and shall be adhered to.
8. Occupant agrees to use the facility s kitchen and its equipment only for serving light refreshments and not for food preparation of any kind. Food and beverages are prohibited in the computer lab. 9. St. John the Baptist Parish Department of Health and Human Services may cancel an agreement within 14 days if it so chooses without liability for any damages that might be sustained for such cancellation. 10. St. John the Baptist Parish reserves the right to refuse any request for use of the facility which is made for the purpose of commercial ventures or business profit. 11. St. John the Baptist Parish reserves the right to cancel an event at any time if it is found not to conform to the Homer Boogie Joseph Community Center Facility Use Agreement. 12. St. John the Baptist Parish reserves the right to refuse to accommodate anyone who has failed to follow the Homer Boogie Joseph Community Center Facility Use Agreement. Facility Use Agreement Statements 1. Occupant will use the Homer Joseph Boogie Center located at 366 NW 2 nd Street, Reserve, Louisiana for the sole benefit of the Occupant and its members, guests or invitees. The Department of Health and Human Services will make available the above-mentioned facility to the Occupant who is a non-commercial or not-for-profit entity. 2. In consideration of the agreement in this restricted document, it is mutually agreed that the abovementioned facility shall be used and maintained by the Occupant subject to the following terms and conditions: 3. Occupant agrees that while the facility is being used, Occupant shall be responsible for any damage to the facility, furniture, fixtures, or supplies. Occupant is liable and agrees to pay for any damages that occur while using the facility. 4. Occupant under no circumstances shall remove any furniture, equipment, or supplies from the facility. 5. Occupant shall comply with all laws, rules, regulations and requirements regarding Parish Government facilities. Occupant shall hold harmless St. John the Baptist Parish Government from all of said matters including code enforcement violations originated by Occupant, its members, guests, or invitees. 6. Occupant agrees to indemnify and hold harmless St. John the Baptist Parish Government from and against any and all claims, demands, actions, suits or causes of action, including counsel fees and other costs defending against the same for loss, damage, or personal injury including death arising from the use of Homer Joseph Boogie Center by the Occupant, its members, guests, or invitees. 7. Occupant, its members, guests, or invitees may not sell goods or services of any kind in the facility or on its premises. 8. Occupant, its members, guests, or invitees may not charge admission either by fee, ticket, or request monetary donations.
9. Usage of the facility s kitchen and its equipment is permissible only for serving light refreshments and not for food preparation of any kind. 10. Occupant agrees not to apply any tape, nails, or temporary fixtures to walls or ceilings while using the facility. 11. Occupant agrees that tobacco, alcohol, firearms or illegal drugs shall not be used by Occupant, its members, guests, or invitees in the facility or on the property. 12. Occupant agrees to provide supervision and to oversee that said activities are carried out in a safe and orderly manner in all areas of the facility defined as part of this Agreement. 13. Occupant agrees that use of facility telephones shall be limited to emergency calls only. 14. Occupant agrees that the use of this facility for said occasion is not a profit venture of any kind for the Occupant, its members, guests, or invitees. 15. Occupant agrees to conduct an inspection of the facility with a Department of Health and Human Services representative noting conditions of all facilities, furniture, fixtures, and supplies. Also, to conduct a final inspection upon conclusion of event with Health and Human Services Department representative for no other purpose but to identify that facility, fixtures, furniture, and supplies are in the same condition as when first occupied by the Occupant, its members, guests, and invitees. And if found to be contrary, that a fee determined by the Parish be fixed and charged to Occupant for proper restoration thereof. 16. Occupant agrees to obtain permission from the Health and Human Services Department before moving any fixture, supplies, or articles of furniture at Homer Joseph Boogie Center that are provided by the Health and Human Services Department. Occupant shall then be responsible for arranging the room into their desired configuration and returning the room to its original configuration. 17. Occupant agrees to see that the Homer Joseph Boogie Center, its fixtures and furniture are left in a clean and sanitary condition. Occupant is responsible for clean-up immediately following event. 18. Upon the signing and acceptance of this Facility Use Agreement, the time period indicated above will be held for said occasion. If Occupant wishes to cancel agreement, cancellation should be done 14 days in writing prior to execution date of said occasion. 19. When using the facility, use of motor vehicles will be limited and operated on designated roadways and vehicles must be parked in designated parking areas only.

Release and Indemnity Agreement I, for and on behalf of (hereinafter referred to as indemnitor) for and consideration of the use of the Homer Boogie Joseph Community Center (including, by way of illustration, parking area, building, and grounds) located at 366 NW 2 nd Street in Reserve, Louisiana on or about the day of 20, do hereby release, remise, discharge, and forever acquit the St. John the Baptist Parish and its agents, employees, and representatives (hereinafter referred to as indemnitee) who are connected or in any way involved with said facility or the use thereof, from any and all liability or fault of any kind or nature whatsoever, arising out of or in anyway connected with said use of said facility, even if caused by the fault or negligence of indemnitee. Indemnitor further agrees to hold harmless and indemnify the indemnitee from any and all claims, suits, costs, or expenses of any kind of nature, including but not limited to settlement amounts, or in any way connected with any accidents, occurrences, or other incidents which happen during or associated with the use of the facility by indemnitor or any of its agents, employees, or other representatives, even if such accidents, occurrences, or other incidents arise out of the fault or negligence of indemnitee. In addition, agrees to pay all costs associated if collection efforts are necessary.
