CYBER LIABILITY RISK SCENARIOS The following summaries of relevant data breach scenarios illustrate the benefits of specific coverage components within our Cyber Liability form. I. Privacy Regulatory Defense and Penalties II. Breach Event Costs A physician s practice was investigated by the attorney general after being alerted to allegations of improperly stored patient records. The investigation revealed that there were numerous Health Insurance Portability and Accountability Act (HIPAA) violations in connection with over 8,000 patient records. The practice s cyber liability insurance policy covered fines and penalties imposed against the practice and defense costs incurred to respond to the investigation. The total claim amounted to over $100,000. A regional life insurance company moved to new offices. During the office relocation, several laptops, desktops and printers were stolen. While the desktops were secure and did not contain personal data, one of the laptops did contain personally identifiable information (PII) and protected health information (PHI) of over 36,000 individuals. Forensic investigations, legal fees, and notification expenses totaled over $200,000 and were covered under the company s cyber liability insurance policy. III. Security and Privacy Liability & Regulatory Defense Costs The employee of an accounting and tax service company took work home on the weekends. To do this, he stored client information, including names, dates of birth, and social security numbers, onto a flash drive. However, the employee did not take precautions to encrypt or otherwise protect the client information. The employee's work laptop and flash drive containing this sensitive information was stolen from the employee's car. Several clients sued the company for breach of personal information. Defense fees exceeded $200,000. The scenarios are examples of the types of claims and associated costs commonly seen and do not represent a comprehensive explanation of any one particular claim. While the subject coverage is designed to address certain risks and associated costs, coverage may not be available in all circumstances. Each reported claim will be evaluated on a case-by-case basis. The actual policy or endorsement language should be referenced to determine coverage applicability and availability.
