Rock and Roll Holiday December 10, 2016 The is one of Delray s longest running community events. It is free to the public, and attracts thousands of people from Delray Beach and the surrounding areas, lining up along Atlantic Avenue. Approximately 8:30 pm. Atlantic Avenue from the Intracoastal Waterway, west to SW 5th Avenue. (approximately one mile) Delray Beach Tennis Center Parking Lot, 201 W Atlantic Ave, Delray Beach or roaming the parade route. Limited space available at Veterans Park, please call for details. Stationary booths, food trucks, roaming carts, and stationary carts. Booths, trucks and stationary carts will be located in the Tennis Center Parking Lot. Roaming carts can walk the length of the parade staying only on Atlantic Avenue. Initials Rules Application Deadline: November 16, 2016 1) Set up time is 4:00 pm until 5:30 pm. The event ends approximately 8:30 pm. s must breakdown immediately after the last float/entry passes the location. 2) Opportunities are limited to stationary booths, food trucks, roaming carts, and stationary carts. 3) Booth spaces are limited to 10 x10 and must be contained within. must supply own tables, chairs, tent, electricity, lights etc. Electric will not be supplied. Tents must be weighed down with weights, not stakes! 4) Please bring your own dolly or handcart. You are responsible for your own set up and break down. You will not be able to drive up to your space. 5) Only items listed and approved on this application will be allowed to be sold at the event. 6) Alcoholic beverages, sold or consumed, is prohibited. Violations will not be tolerated and will result in immediate removal from the parade and future events thereafter. 7) The Special Event Supervisor reserves the right to remove or prohibit any exhibit, which, in his/her opinion is not suitable for the Holiday Parade. Prohibited are: 1. Burning (open fires, candles, incense, etc.) 2. Alcoholic beverages sold or consumed. 3. Excessive noise, as determined by designated staff. 8) You, your staff and your booth must remain neat, clean and kept in an orderly fashion. Exhibits and displays must be contained within booth space. No selling/soliciting outside booth space. Conduct and displays must be appropriate. 9) You and your staff must wear appropriate event credentials at all times. 10) The event staff will not be liable for any losses or damages of any kind that occurs at your booth. 11) You are responsible for the removal of all items and refuse from your tent. If City employees must clean or dispose of your garbage or if pavement is damaged or soiled, you will be charged a cleaning fee. 12) Failure to comply with the above will result in denial of all future event vendor opportunities. 13) At various times, the City of Delray Beach videotapes & photographs events to be submitted to the local media, and other publications. By participating in the City of, I/we hereby authorize the City of Delray Beach to reproduce, copy, exhibit, publish, broadcast or distribute any and all such tapes or photographs. 14) All vendor applications will be reviewed to ensure your product or service is the right fit for the event. We will limit the number of vendors selling similar items. Applications are subject to written acceptance by the Delray Beach Parks & Recreation Department s Special Event Supervisor. 15) No subcontracting on this Permit or any other permit associated with the rental/special event is allowed without written permission from park management. 16) No refunds will be given if Holiday Parade is canceled due to weather or circumstances beyond the control of sponsor(s). The City of Delray Beach shall not be held liable for loss or damage suffered as a result of any delay, interruption, or failure in performance, to include loss of facility and/or equipment use, under this Park Permit, resulting directly or indirectly from natural disasters or unforeseen circumstances. This also includes any action taken by any agency with jurisdiction in this park and/or activity, including but not limited to municipal, state, and/or federal agency, etc. 17) LIABILITY INSURANCE: A Liability Insurance Policy shall be provided with minimum limits of Two Hundred Fifty Thousand Dollars ($250,000) per occurrence combined single limit for bodily injury liability and property damage liability and shall contain minimum limits of Three Hundred Thousand Dollars ($300,000) per aggregate. Said insurance policy shall specifically protect the City of Delray Beach by naming City of Delray Beach as an additional insured under the Liability Policy as well as on any Excess Liability Policy coverage. The official title of the certificate holder is City of Delray Beach. This official title shall be used in all insurance documentation.

TO CITY OF DELRAY BEACH: In consideration of the opportunities afforded to me and/or my group by this Permit, I, the undersigned participant, freely agree to and make the following contractual representations and agreements: I, the undersigned, do hereby knowingly, freely, and voluntarily assume all risk and liability for any damage or injury that may occur as a result of my and/or my group s use of the park facility identified herein during the time period I and/or my group are using same and further agree to release, waive, discharge, and covenant not the sue the City of Delray Beach, its officers, agents, employees, and volunteers (all for the purposes herein referred to as Releasees ) from any and all liability or claims that may be sustained by me directly or indirectly in connection with, or arising out of, my or my group s use of the park facility as described herein, whether caused in whole or in part by the negligence of the City of Delray Beach or the Releasees. I further agree to indemnify and hold the City of Delray Beach, its officers, employees, and agents harmless from and against any claim, demand, or cause of action or whatsoever kind or nature, including attorney s fees, costs, and expenses, resulting from losses sustained by third parties arising out of actions or alleged actions in connection with this Permit. I agree that I have read this form, fully understand its terms, and understand that I, or anyone who may claim to have rights on my behalf, have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of any and all liability to the greatest extent allowed by law and agree that, if any portion of this contract is held to be invalid, the balance notwithstanding shall continue in full legal force and effect. NOTICE: This document is deemed a public record under the laws of the State of Florida and can be inspected by anyone, including vendors and caterers, who may solicit business from this record.
