ITI LIMITED SCOPE COMPLEX, NEW DELHI SCOPE OF WORK AND TERMS AND CONDITIONS FOR PROVIDING HOUSE KEEPING SERVICES FOR ITI LIMITED GUEST HOUSE AT ASIAD GAMES VILLAGE, NEW DELHI TERMS AND CONDITIONS OF CONTRACT ITI is having its Guest House at Asiad Village, Khel Gaon New Delhi spread over in three flats viz., two flats at C-17 & C-18 having 5 rooms with basement and one flat at No. 617, Padam Bhadur Mal Block having 3 Rooms, consisting of attached bath, drawing-cum-dinning, lobby, kitchen, verandahs, garden etc. Presently, the Guest Houses are being maintained by ITI itself. Through this tender, ITI is exploring the possibility of outsourcing the house keeping services, ITI will think over the giving the work to a successful outside party as per tender terms. It may be noted that ITI reserves the right to award or cancel the work as per its viability and wish. 1. Following details are to be provided in the Technical Bid Commercial Conditions 1.1 Name and Address of the Agent (With Contact Numbers) 1.2 Name and Address of the proprietor of the Agency(With Contact No. and Address) 1.3 List of reputed clients (With full address and telephone Numbers) 1.4 PAN Number, Copy of Income Tax Return for last financial year (Copy to be enclosed) 1.5 Service Tax Registration No. (15 digit) and copy of Service Tax Return for last one year (copy to be enclosed). 1.6 The Agent should have provided services to Govt/ Public Sector Undertaking/Reputed Private Sector for last one year and should be financially strong. Satisfactory Certificate should be enclosed in the bid. 1.7 Photocopies of Registration Certificate for Service Tax, PAN No. Should be enclosed. 1.8 EMD of Rs 7500.00 (Rupees Seven Thousand Five Hundred only) is to be enclosed alongwith PART-A in favour of ITI Limited payable at New Delhi. 2. FINANCIAL BID (AS PER PART B) The Financial bids of only those bidders will be opened who qualify the commercial conditions as above. ITI reserves the right to offer the work to the party found suitable technically and commercially. Agency will be evaluated independently for each jobs as per Financial Bid Part-B. 3. DEPOSIT OF EARNEST MONEY 3.1 The bidder will have to deposit earnest money of Rs 7500/- (Rupees Seven Thousand Five Hundred only) by way of Demand Draft/Pay Order in favour of ITI Limited, New Delhi payable at New Delhi. The earnest money deposited will be refunded to bidders whose offers are not accepted within 90 days from the date of opening of tender. Earnest money of the bidder whose tender is accepted will be kept as interest free security deposit till successful completion of the contract. Tenders without the Earnest Money shall be rejected. The earnest money will be forfeited in case the agency does not starts the work after offering the tender or lefts out the work any time in the intermission of contract period. 4 SCOPE OF WORK 4.1 Providing House Keeping Services consisting of making of rooms, Gardening, Cleaning of office vehicles and allied services etc as per Annexure-I enclosed. 4.2 Ensuring judicious use of electricity, house keeping, cooking, allied services and sanitation work etc. 4.3 Reporting to officer in charge of Guest House for any Guest house related jobs. 4

5 TERMS & CONDITIONS 5.1 The Agency based in Delhi/NCR will only be eligible for submission of tender. 5.2 The personnel deployed for various jobs should be smart, literate, disciplined and wear proper & complete uniform. The agency should provide the complete detail of the personnel deployed along with the Police Verification. 5.3 All Acts, Laws or other statutory regulations applicable or which might become applicable to the Union Territory of Delhi/NCR, as the case may be, such as ESI, Industrial Disputes Act 1947. Provident Fund Act etc., shall be complied with by the agency. 5.4 Against all losses or damages incurred or liability arising out of or during the course of employing persons or out of his relations shall be indemnified by the agency to ITI. 5.5 All disputes arising between Agency and their employees and all losses, damages and claims of the employees to the company indemnified shall be borne by the agency. 5.6 The Agency shall not sub let, transfer or assign the contract or any part of the contract without written permission of ITI. 5.7 The agency will be responsible for providing 24 hour service at the Guest House. The entire inventories will be handed over to the agency and will be checked quarterly. The damages will be liable to be deducted from the bill of the agency. 5.8 ITI reserves right to enter into another contract simultaneously at any time during current period of the contract with one or more agencies as it may deem fit and necessary. 5.9 ITI reserves the right either to accept or reject any tender without assigning any reasons. 5.10 In case of any dispute or differences between the company and the agency with regard to any matter including interpretation or implementation of any above clause the same shall be referred to Dy Gen Manager, BC ITI Ltd, Business Co-ordination Office, New Delhi whose decision shall be final and binding. 5.11 If the agency is dis-satisfied with the decision of Dy Gen Manager, BC ITI Ltd and if within a reasonable period such mutual decisions/discussions do not result in any settlement, all such disputes claim etc shall be resolved through arbitration to be conducted under the provision of Arbitration and Concilliation Act, 1996. Such arbitration proceeding shall be conducted in Delhi only. 5.12 The agreement and all matters connected therewith shall be to the exclusive jurisdiction of the courts in Delhi only. 5.13 Tender document will not be sold /entertained from those parties who have earlier accepted the offer but not commenced the work or left in between. 5

6 NUMBER OF PERSONNEL Sufficient number of personnel required for the house keeping & allied services will be provided by agency so that the services are not affected which will work along with the regular staff of ITI Ltd deployed in the Guest House as per Annexure I. (a) One person will be deployed by the agency round the clock at C-17 & C-18, Asiad Village to manage the work of House Keeping and Allied Services from 6:30 AM to 10:30 PM and will stay in the Guest House only (b) One person will be deployed by the agency round the clock at 617, Asiad Games Village to manage the work of House Keeping & Allied Services from 6:30 AM to 10:30 PM and will stay in the guest house only. (c) Agency will deploy part time manpower at C-17, C-18 & 617 Asiad Village from 6:30 AM to 14:30 PM for sanitation, cleaning of Guest House, cleaning of cars and for gardening etc as per scope of work at Annexure I.. 7 DURATION OF CONTRACT The contract will be valid for One year. The same can be contracted extended for another period of one year on the basis of satisfactory performance of the agency during first year with mutual consent with escalation of 5 % on same terms and conditions. 8 CONTRACT PERFORMANCE GUARANTEE & SECURITY DEPOSIT The Contract Performance Security shall be 10% (Ten Percent) of total one year Bill before tax and will be deducted in five equal installments. EMD will be adjusted with security deposit. 9. PERFORMANCE The overall performance of agency will be watched closely for initial 3 months. In case services are found unsatisfactory, the contract shall be terminated with immediate effect without any notice. The decision of Officer-in-Charge shall be final and binding on the agency. No such activity that may harm the image of company by any manner will be allowed in the guest house. No trespassers, unauthorized entry will be allowed. Such incidents will be brought to the notice of Incharge of Guest House/CM (BC&PR) immediately. 10. TERMINATION OF THE CONTRACT/CEASE The company/agency shall have the right to terminate the contract on one month s notice on either side. 6

11. BILLING & PAYMENT The bill in duplicate shall be submitted by 10th day of each month. Payment will be made to the party as per contract after satisfactory service certificate by Guest House In-Charge. The Contractor will also submit a Certificate mentioning that it has complied with all labour laws applicable as on date, paid to the its employees during last month along with ESI, PF Numbers of the employees and contribution made and proof of deposits through challan copies. 12 PERSONNELS CONDUCT/BEHAVIOUR/QUALITY All personnel deployed shall be well behaved, courteous and soft spoken. In case any person is found misbehaving with ITI Limited staff and visitors or found to be in inebriated (intoxicated or otherwise), he shall be removed from duty immediately and has to be replaced within 24 hours of such notice from ITI Limited. After that penalty will be imposed till the replacement is provided. 13. PENALTY Good prompt services and quality of food is the essence of contract. In case of any laxity, disruption in service, penalty may be imposed @Rs.500/- per day. 14. PAYMENT OF SALARY TO THE PERSONNEL DEPLOYED The agency is supposed to make the monthly payment to their employees as per Minimum wages Act and other statuary obligation applicable in Delhi/NCR Region. The payment will be made to personnel deployed on the first of the following month irrespective of the fact that the payment from the ITI Limited is held up because of any reasons. In such cases the same is not made continuously for two months and ITI Ltd. on receipt any complaint from any personnel deployed, then adhoc payment as decided by the management will be made to the concerned personnel with intimation to the Agency. The payment will be deducted from the bill pending with ITI Ltd. In Case the payment is not made continuously for three months ITI Ltd. reserves right to cancel the contract without giving any notice and EMD will be forfeited and the payment of personnel will be made from the final bill. 15.
