Excluding Mechanical and/or Electrical Derangement. Including the Period During Loading and Unloading. In the event of a claim, Chubb will pay the cost of Airfreighting damaged goods to Manufacturers for Repair and Return, or Airfreighting replacement goods from suppliers, up to a maximum of 2,500 any claim. Excluding shipments to, from or via Afghanistan, Cuba, North Korea, Iran and Iraq TERMINATION OF TRANSIT CLAUSE (TERRORISM) This clause shall be paramount and shall override anything contained in this insurance inconsistent therewith 1. Notwithstanding any provision to the contrary contained in this policy or the clauses referred to therein, it is agreed that in so far as this policy covers loss or damage to the Subject Matter Insured caused by any terrorist or any person acting from a political motive, such cover is conditional upon the Subject Matter Insured being in the ordinary course of transit and, in any event, SHALL TERMINATE: Either 1.1 As per the Transit clauses contained in the policy, or 1.2 On delivery to the Consignee s or other final warehouse or place of storage at the destination named herein, 1.3 On delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either for storage other than in the ordinary course of transit for allocation or distribution, or 1.4 In respect of Marine transits, on the expiry of 60 days after the completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge, 1.5 In respect of air transits, on the expiry of 30 days after unloading the Subject Matter Insured from the aircraft at the final place of discharge whichever shall first occur 2. If this policy or the clauses referred to therein specifically provide cover for Inland or other further transits following on from storage, or termination as provided for above, cover will re-attach, and continues during the ordinary course of transit terminating again in accordance with clause 1. 3. RELATING TO TRANSITS IN THE INSURED S OWN VEHICLES Theft or from vehicles owned and/or operated by the Insured is covered when left unattended provided:- (a) such vehicles are garaged in a building or parked in a fully enclosed yard, which is securely closed and locked or under constant surveillance, or on a guarded security lorry park, and (b) such vehicles have all the openings closed and securely locked and all keys removed, so far as local fire regulations permit (c) Each vehicle is fitted with an alarm approved by Chubb and set when unattended Nevertheless between 0600 and 2100 hrs only where the Insured is unable to comply with the requirements of (a) above, theft of or from the vehicles is covered unless consequent upon the failure of the insured to take all reasonable safety and security precautions. Excluding theft by employees. CONDITIONS WHICH FORM PART OF THIS POLICY 1. This contract is to insure the subject matter specified for the transits and on the conditions named shipped by or for account of the Insured or the insurance of which is under their control as selling or purchasing agent unless elsewhere prior to inception of this contract or to insurable interest being acquired by the Insured or Assignee. 2. It is a condition of this contract that the Insured are bound to declare hereunder every consignment without exception, Chubb being bound to accept up to but not exceeding the amount specified in clause 3 below. 3. This contract is for an open amount but the amount declarable may not exceed the limit in respect of any one conveyance shown overleaf. 4. Chubb s liability in respect of any one accident or series of accidents arising from the same event in any one location during the normal course of transit shall not exceed double the limit referred to in clause 3 above. 5. The Basis of Valuation shall be Cost of Insurance and Freight plus 10% in respect of Exports and Imports, and invoice Value in respect of UK and FOB sendings, unless otherwise agreed. 6. The Institute Clauses referred to herein are those current at the inception of this contract but should such clauses be revised during the period of this contract, and provided that Chubb shall be given at least 30 days notice thereof, then the revised Institute Clauses shall apply to risks attaching subsequent to the said notice. 7. This contract may be cancelled by either Chubb or the Insured giving 30 days notice in writing to take effect from date of notification but risks covered by Institute War Clauses may be cancelled at least 7 days notice and risks covered by Institute Strikes Clause may be cancelled at 7 days notice, or at 48 hours in respect of shipments to or from USA. Notice shall commence from midnight of the day when it is issued but cancellation shall not apply to any risks which have attached in accordance with the cover granted hereunder before the cancellation becomes effective. 8. ON ARRIVAL OF GOODS The goods should be examined prior to a receipt being given to the carriers. If there is any sign of damage or loss, clause the receipt or ask the Carrier for a Certificate of Short-landing and immediately: In UK advise Chubb Marine Claims Dept., 106 Fenchurch Street, London EC3M 5ND, tel: 020 7956 5000 Abroad advise Chubb Marine Claims Dept tel +44 20 7956 5000 or advise the nearest Chubb settling agent or Lloyd s Agent Immediately hold the Carriers and/or Port Authorities responsible and invite them to attend an inspection of the goods, having the surveyor also present. Except on the instruction of the surveyor this inspection should not be deferred until the goods reach your warehouse. Do not allow the goods to remain on the quay or in transit sheds. Bring the goods into the safety of your warehouse as quickly as possible. When the goods reach your warehouse, they should be immediately unpacked and inspected whether or not there are external signs of loss or damage. If the loss was not immediately apparent give notice in writing to the carriers within 3 days of delivery. The Consignee or their Agents are recommended to make themselves familiar with the Regulations of the Port/Airport Authorities at the Port/Airport of discharge. When making your claim, always send the following: The surveyors report A copy of the invoice Bill of lading and /or consignment note Copies of your letters to the Carriers and their replies Claused delivery receipt or Short-landing certificate, when applicable Repairs estimates Original Insurance Policy or Certificate of Insurance Do not delay notifying your claim CCI\OMC\MARINE CARGO\08\2C CCIOMC2C Page 5 of 5
