Important Account Information for Our Members

COMMUNITY FINANCIAL CREDIT UNION MasterCard CARD HOLDER AGREEMENT

Transcription:

Introduction A number of services for American Lake Credit Union members can be initiated electronically. You may participate in the Direct Deposit program, for example, and have your Social Security, retirement, or paycheck come directly to AMERICAN LAKE Credit Union for deposit to your account. You may elect to have payments deducted from your account for several purposes - insurance premiums or loan payments, as an example. Or you might have an automated teller machine (ATM) access card. This ATM card allows users to engage in transactions through the Exchange, ACCEL, and Plus System ATM networks and selected American Express machines. Visa Debit Cards allow you to make purchases at participating financial institutions, and use the Visa ATM Network and the ATM networks listed above. Our audio response system allows you to check account balances, make withdrawals, and transfer funds by entering commands on your touch-tone phone. Transactions initiated electronically are known as part of the Electronic Fund Transfer (EFT) system. American Lake Credit Union is pleased to tell you about the rights and responsibilities -- yours and ours - - associated with EFT transactions. Some of the wording we use in this EFT information brochure and some of the terms we must abide by are dictated by federal law. Current EFT services available to members Exchange Card Visa Debit Card Direct Deposits Pre-authorized payments Transfer of Funds Audio Response Fees and limitations on transfers There are fees for some EFT transactions, such as charges for cash withdrawals from ATMs, or for replacement cards, or Personal Identification Numbers (PINs), and research or photocopies of records. You may obtain a current schedule listing all service charges/fees and their amounts from the credit union. Statements, receipts, and notices you will get about your transfers Statements: American Lake Credit Union will furnish a monthly statement to members with activity on their transaction accounts (draft accounts). All members will get quarterly or annual statements. Receipts: The Exchange, ACCEL, Visa and Plus System ATM networks issue a receipt for every transaction. Trace Numbers: When transferring funds or making withdrawals. Notice of deposits to your account: If you have arranged to use Direct Deposit at least once every 60 days from the same person or company, and that person or company does not give you notice of such deposit, you can call us at (253) 584-0079 in Tacoma or (800) 244-0874. We ll tell you whether the deposit has been made. Notice of amount of payment from your account: If you have arranged to have regular payments in varying amounts made from your account, the company you are going to pay will tell you -- 10 days before each payment -- when it will be made and how much it will be. You also may choose to get this notice only when the payment would differ by more than a certain amount from the previous payment, or when the amount would fall outside certain limits that you set. Stopping pre-authorized payment from your account If you have told us in advance to make regular payments from your account, you can stop any of these payments. Call us at (253) 584-0079 in Tacoma or (800) 244-0874, or write to us at 9900 Veterans Drive SW, Tacoma, WA 98493. We must receive your request three business days or more before the payment is scheduled to be made. If you call, we also require that you put your request in writing and get it to us within 14 days after you call. We will charge you for each stop-payment order you give and will tell you

the amount of the fee when you call. If you tell us to stop payment in this way, and we fail to do so, we ll be liable for your losses or damages in accordance with the law. Our liability if we do not make transfers as agreed If we do not make a transfer to or from your account according to properly given instructions, we will be liable for your losses or damages. However, there are some exceptions. We will not be liable for instance: (1) If, through no fault of ours, your account does not contain enough funds to complete the transfer; (2) If circumstances beyond our control, such a fire or flood, prevent the transfer despite reasonable precautions that we have taken; (3) If reauthorization for transfers has been evoked by law (in case of death of incompetency, for example); (4) If the ATM machine where you are making the transfer does not have enough cash; (5) If the ATM machine was not working properly and you knew about the breakdown when you started the transaction; (6) If the account is dormant; (7) If incomplete or inaccurate information on your Direct Deposit or Payroll Deduction is revealed; (8) If your card or PIN has been reported lost or stolen, or if the Credit Union suspects fraud or misuse. (9) There may be other exceptions stated in our agreements with you. The law limits our liability. We will be liable only for some kinds of losses and damages. Card Use -You may use your card to obtain cash advances from ATMs of this Credit Union, ACCEL, The Exchange, the Plus Systems, and such other machines or facilities as we may designate from time to time. You may use your Visa Debit Card to buy goods and services any place Visa is honored. Funds to cover your card transactions will be deducted from your account. If the amount of money in your Share Draft Account will not cover the transaction amount (Share Draft Clearing, ATM cash withdrawal, Visa Purchases) we will then access funds from your Share account. (1) At most ATM locations, you may: (2) Withdraw cash from your Share Draft Account (3) Transfer funds from your Shares to your Share Draft Account. Some ATMs or networks allow withdrawals only. by sending you the advance written notice required by law. Your use of the Visa Debit Card thereafter will indicate your agreement to those terms. Acknowledgment and acceptance Acceptance, retention, or use of your Exchange Card, or Visa Debit Card indicates your agreement to the terms and conditions contained in this Agreement. You further acknowledge receipt of a copy of this Agreement and the disclosure statement made pursuant to the Electronic Funds Transfer Act. The Electronic Funds Transfer Act governs certain electronic fund transactions to and from your interestbearing Share Draft account (checking) and certain transactions with your credit accounts at American Lake Credit Union. These disclosures set forth your and our rights and responsibilities concerning the electronic funds transactions that are covered by the Act. Disclosure information These disclosures are part of your Exchange Card and Visa Debit Card Agreement. They also govern the electronic fund transactions made at the credit union or at ATMs by use of your Visa Debit Card or Exchange Card. Liability for Unauthorized Transactions Tell us AT ONCE if you believe your card or PIN has been used by someone without your permission or has been lost or stolen. Telephoning is the best way for you to keep your possible losses down. If you contact us within two business days of learning of the loss or theft of your card, you can lose no more than $50 if someone does use your card without permission. If you do not contact us within two business days and we can prove we could have stopped someone from using your card without your permission if you had told us, you may be obligated for up to $500 for the unauthorized use of your card. If your Share Draft Account statement shows transactions you did not make, contact us at once. If you do not tell us within 60 days of the mailing date of your statement and we can prove that we could have stopped someone from taking the money if you had told us in time, you may be obligated for all unauthorized use of the card after 60 days. Should some emergency such as extended travel or hospitalization prevent your contacting us, a reasonable extension of time will be allowed. The liability stated above does not apply to the unauthorized use of your card in credit transactions. (7) Telephone number for reporting unauthorized transactions. If you believe your card or PIN has been or may be used by someone without your permission or has been lost or stolen, call (253) 584-0079 in Tacoma or 1-800-244-0874. After hours, report lost Exchange Cards to 1-800-854-6219 and lost Visa Debit Cards to 1-800-336-8472 and 1-800-854-6219. (8) Business Days. The business days for your credit union are Monday through Friday. The ATMs operate seven days a week, 24 hours a day. Holidays are not included. (9) Verification. All deposits are subject to verification and funds availability (Regulation CC). (10) Charges for electronic funds transactions. There are no additional charges for electronic debits and credits, but your normal account charges will continue to apply. (11) Right to receive documentation of transactions. a) Receipts for ATM transactions will be made available in the form of a written acknowledgment at the time you complete any transaction using any ATM. b) Periodic statements. We will mail or deliver to you monthly Share Draft Account Statements.

(7) Disclosure of account information to third parties. We will disclose information to third parties about your accounts or the transactions you make: a) In order to verify the existence and condition of your account for a third party, such as a credit bureau or merchant; or b) In order to comply with government agency or court orders; or (8) If you give us written permission. Error question. IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR ELECTRONIC TRANSACTIONS: Telephone us at (253) 584-0079 as soon as you can if you think your statement is wrong or if you need more information about a transaction listed on the statement or receipt. We must hear from you no later than 60 days after we have sent or delivered to you the first statement on which the problem or error appeared. (a) Tell us your name and account number. (b) Describe the error or the transaction you are unsure about and explain as clearly as you can why you believe it is an error or why you need more information. (c) Tell us the dollar amount of the suspected error. If you tell us orally, we may require that you send us your complaint or question in writing within 10 business days. We will tell you the result of our investigation within 10 days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate your complaint or question. If we decide to do this, we will re-credit your account within 10 business days for the amount you think is in error, so that you will have the use (d) of the money during the time it takes us to complete our investigation. If we ask you to put your complaint in writing and we do not receive it within 10 business days, we may not re-credit your account. If we decide that there was no error, we will send you a written explanation within three business days after we finish our investigation. You may ask for copies of the documents that we used in our investigation. You may terminate this agreement at any time by giving the credit union written notice thereof and returning to the credit union all cards issued to you; provided, however, that such termination shall have no effect on your liability for transactions occurring prior to delivery of such written notification to the credit union. (9) Other agreements. Other agreements you have with us, such as your account agreements, continue to govern the use of your accounts, but we will not enforce any part of those agreements that cover transactions governed by the Electronic Funds Transfer Act, when to do so would be contrary to these disclosures or would be in violation of the Act. (10) Amendment of these disclosures. We may amend these disclosures by mailing notice to the holder of the account covered by these disclosures at least 21 days before the effective date set by the notice. Each account will be governed by the disclosure as amended, unless the account is closed before the effective date of the amendment.
