CITI MOBILE PAYMENT & TRANSFER CAMPAIGN TERMS & CONDITIONS The Campaign Period This "Citi Mobile Payment & Transfer Campaign ( Campaign ) organized by Citibank Berhad (Company No. 297089-M) ( Citibank ) will run from 2 October 2017 to 31 December 2017 (both dates inclusive) ( Campaign Period ). Eligibility 1. The Campaign is only open to Citibank customers who:- a) have a valid Citibank Credit Card(s) and/or Citibank Debit & ATM Card(s) (including Ready Credit Debit & ATM Cards) issued by Citibank in Malaysia; and b) are registered users of Citibank s Citi Mobile app, who performs bill payments or fund transfers via Citi Mobile. (hereinafter, referred to as Eligible Persons or each, an Eligible Person ) NOTE: Citi Mobile App can be downloaded from Apple App Store for IOS users and Google Play Store for Android users. 2. The following persons are NOT eligible to participate in this Campaign: a) Any person who is not a resident of Malaysia; b) Permanent and/or contract employees of Citibank (including its subsidiaries and related companies) and their respective immediate family members (meaning spouses, children, parents, brothers and sisters); c) Any person who has a Citibank Credit Card(s) and/or Citibank Debit & ATM Cards (including Ready Credit Debit & ATM Cards) not issued in Malaysia; d) Any person whose account(s) is not in good standing, including being overdue in payment, under any restructured payment plan or re-write plan or has exceeded its credit limit (where applicable) or is in default of any facilities granted by Citibank or terms and conditions governing such account(s) at any time during the Campaign Period, subject to Citibank s discretion; and/or e) An person whose Citibank Credit Card(s) and/or Citibank Debit & ATM Cards (including Ready Credit Debit & ATM Cards) account(s) have been closed or terminated for any reason whatsoever within the last six (6) months prior to the commencement of this Campaign and before any Prize (defined below) are awarded; and/or f) Any person who has committed or is suspected of committing any fraudulent or wrongful acts in relation to any Citibank services or facilities, including Citibank Online (accessible via http://www.citibank.com.my ) and Citi Mobile. The Campaign 3. Subject to these terms and conditions, each Eligible Person will be eligible to win a maximum of one (1) Monthly Prize and/or one (1) Grand Prize throughout the Campaign Period. The Prizes are described in Table A below:- Table A: Monthly Prizes and Grand Prize Type of Prizes No. of Winners Monthly Prize: Thirty five (35) 1 x RM100 Lazada e-voucher monthly Grand Prize: 1 x Samsung Galaxy S8 (RRP: RM3,299) Three (3) 1
(Collectively, the Grand Prize(s) and Monthly Prize(s) shall be referred to as the Prizes ) 4. There will be three (3) Grand Prizes and a total of one hundred five (105) Monthly Prizes throughout the Campaign Period, bringing the total of one hundred eight (108) Prizes. 5. Citibank will notify Eligible Persons/ Eligible Person if they have won a Prize. Winners will receive the Prize within 8-12 weeks from the end of the Campaign Period. Winner Selection Process Monthly Prize 6. To stand a chance to win a Monthly Prize, an Eligible Person is required to:- a) Log on tociti Mobile, accessible via smartphones or mobile devices; and b) perform bill payments or fund transfers. 7. At the end of the Campaign Period, each serial number based on the sequence of the transaction was made will be assigned during a Campaign Month (as defined in Table B below) shall enable a Eligible Person a chance to be shortlisted for a prize of that particular Campaign Month. For example, an Eligible Person s Serial Number given in October 2017 will enable him/her a chance to be shortlisted for the Monthly Prizes. 8. For Monthly Prizes at the end of a Campaign Month, the total number of Serial Numbers assigned to all Eligible Persons during the Campaign Month will be divided by 100 in order to return the multiplier number used to select 100 Eligible Persons ( Shortlisted Participants or each a Shortlisted Participant ) to win the Monthly Prizes of the Campaign Month (as defined in Table B below):- Table B: Campaign Month Campaign Month Dates Campaign Month 1 2 nd October 2017 to 31 st October 2017 Campaign Month 2 1 st November 2017 to 30 th November 2017 Campaign Month 3 1 st December 2017 to 31 st December 2017 Example: If the total number of Serial Number assigned for Campaign Month 1 is 150,000, the multiplier will be 150,000/100= 1,500. As such, Serial Number which are multiple of 1,500 will be selected i.e. 1,500, 3,000, 4,500, 6,000 150,000, will be selected and Participants who are assigned these Serial Number will be shortlisted. 9. The Shortlisted Participants for October 2017 will be sent an SMS containing a question and instructions to reply ( SMS Q&A ), at the latest telephone numbers furnished to Citibank as shown in Citibank s records on a selected day on any day that Citibank in Kuala Lumpur is open for business. 10. The 35 Shortlisted Participants who respond with the correct answer to the SMS Q&A in the fastest time within eight (8) hours after the SMS Q&A was sent ( Winners ) will win the Monthly Prizes. 11. This will be repeated for November and December 2017 Shortlisted Participants to select the winners of the November and December Monthly Prizes respectively. 12. Winners will be notified by SMS orcall. They will be directed to access their message on Citibank Online to retrieve the Lazada unique e-voucher codes. 2
Grand Prize 13. To qualify for the Grand Prizes, Eligible Persons have to make a bill payment or fund transfer via Citi Mobile for 2 consecutive months during the Campaign Period. At the end of the Campaign Period, the shortlisted monthly prize serial number will be put back into the pool for selection of Grand Prize. The total Serial Number assigned to Eligible Persons (who meets the qualifying criteria) during the Campaign Period will be divided by 20 in order to return the multiplier number used to select 20 Eligible Persons ( Shortlisted Participants ) to win the Campaign Grand Prizes. To be in line to win the Campaign Grand Prizes:- a) The Shortlisted Participants will be sent first SMS containing a question and instructions to reply ( SMS Q&A ), at the latest telephone numbers furnished to Citibank as shown in Citibank s records on a selected day on any day that Citibank in Kuala Lumpur is open for business; b) The Shortlisted Participants who responds with the correct answer to the first SMS Q&A within eight (8) hours after the SMS Q&A was sent will be sent second SMS containing another question and instructions to reply ( SMS Q&A ); and c) The first (3) Shortlisted Participants with the correct answers to the 2 x SMS Q&As ( Winners ) in the fastest time within eight (8) hours after the second SMS Q&A will win the Grand Prizes. 14. For the avoidance of any doubt, SMS telco charges are borne by Participants or Eligible Persons and Citibank shall not be responsible for any delay or failure of SMS transmission which are not under Citibank s reasonable control. 15. The following additional terms and conditions will apply to the Prizes: a) The Prizes are subject to availability and provided on an As Is basis. If the participating merchant or supplier is unable to supply any Prize(s) to Citibank, Citibank reserves the right at its discretion to substitute any Prize(s) with other products or vouchers of approximately equivalent value at any time with prior notice. In particular, in the event Citibank merchant(s) and/or dealer(s) is unable to supply the same model as described herein due to reasons which include but not limited to manufacturer(s) recall or damaged, lost or stolen during storage and delivery, Citibank reserves the right to substitute the Prizes with another model(s) of a similar value at its absolute discretion, with adequate prior notice on the Citibank s website or any other methods as it deems fit The title in the Prize(s) and any risk or loss or damage to the Prize(s) passes to the Winners upon delivery of the Prize(s) to the Winners. Citibank is not responsible for or obliged to recognize or replace any defective, lost or damaged or stolen Prize(s); b) To the fullest extent permitted by law, Citibank expressly excludes and disclaims any representations, warranties or endorsements, expressed or implied, written or oral, including but not limited to, any warranty of quality, merchantability or fitness for a particular purpose in respect of the Prize(s); c) To the fullest extent permitted by law, by participating in this Campaign, each and every Participant is agreeing that he/she will not hold Citibank and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Citibank may engage for the purposes of this Campaign), liable for any loss or damages that he/she may incur, in connection with this Campaign and the use of the Prize(s) by the Eligible Person, Participant and/or any other persons; d) Where the Prize(s) to be redeemed under this Campaign are in the form of certificates/vouchers issued by participating merchants or suppliers, the Prize(s) are valid for use until the date specified on the certificates/vouchers and are subject to the relevant 3
terms and conditions applicable to using them. If they remain unused or unredeemed after any specified date, these certificates/vouchers will lapse and will not be replaced. e) In that respect, each and every Eligible Person and/or Participant understands that the terms and conditions specified in the Prize(s) (where the Prize(s) are in the form of certificates/vouchers) are beyond our control and are determined by the participating merchants or suppliers. Any dispute(s) arising out of the terms and conditions applicable to such Prize(s) must be settled directly by the relevant Participant and the participating merchants or suppliers. Citibank is not responsible for investigating or resolving any disputes between any Participant and the participating merchant or supplier and is not responsible for replacing or canceling any redemption as a result of such dispute(s). f) Prizes are not exchangeable for cash, credit or kind, in part or in full. g) To avoid any doubt, if the Prize(s) (where the Prize(s) are in the form of certificates/vouchers) are used for a value less than the amount stated on them, the difference will not be refunded to the Participant. If the value of the Prize(s) is less than the value of the item(s) purchased, the Participant must pay the difference. h) To avoid further doubt, where Prize(s) are in the form of certificates/vouchers for dining, travel and/or hotel accommodation purposes issued, such Prize(s) do not constitute a reservation. Participants will have to make their own reservations based on the terms and conditions applicable to using them. i) In the event of late fulfillment of the Prize(s) or queries in relation to the Prize(s), Winners may contact CitiPhone, at the following telephone numbers: 03-2383 0000 (Kuala Lumpur), 04-296 0000 (Penang), and 07-268 0000 (Johor Bahru) to commence and inquiry; Miscellaneous 16. In the event that a Prize is awarded to Eligible Person who or in the event that Eligible Person: a) is not eligible to participate in the Campaign and/or receive the Prize; and/or, b) has committed or is suspected of committing any misconduct, fraudulent or wrongful acts, Citibank reserves the right to disqualify such Eligible Person from participating in the Campaign and/or receiving the Prize. 17. To the fullest extent permitted by law, by participating in this Campaign, each and every Eligible Person is agreeing that he/she will not hold Citibank and its officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that Citibank may engage for the purposes of this Campaign), liable for any loss or damages that he/she may incur, in connection with the Campaign. 18. Citibank reserves the right to cancel, revise, terminate or suspend the Campaign with notice. For the avoidance of doubt, any cancellation, revision, termination or suspension by Citibank of the Campaign shall not entitle any Eligible Person to any claim or compensation against Citibank for any and all loss or damage suffered or incurred by the Eligible Person as a direct or indirect result of the act of cancellation, revision, termination or suspension. 19. Citibank will not be liable for any damage, loss, cost or expenses suffered by an Eligible Person at any time from any cause due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, technical or system failure or any event beyond the reasonable control of Citibank. 4
20. Citibank will not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm, epidemic, pandemic, technical or system failure or any event beyond the reasonable control of Citibank. 21. Citibank reserves the right as it deems fit to vary or change any of these terms and conditions with notice. These terms and conditions may be varied or changed by Citibank by way of posting on Citibank Facebook Webpage or in any other manner deemed suitable by Citibank. The Eligible Persons who had participated in the Campaign are deemed to have accessed Citibank Facebook Webpage and/or Citibank s website at www.citibank.com.my ( Website ) and to have knowledge of and to have agreed to any changes or variations to these terms and conditions. The Eligible Persons agree that their continued participation in the Campaign will constitute their acceptance of these terms and conditions (as varied or changed). 22. Any term and condition applicable to this Campaign which is illegal, prohibited or unenforceable under any law or regulation shall be ineffective to the extent of such illegality, voidness, prohibition or unenforceability without invalidating the remaining provisions. 23. These terms and conditions are governed by and construed under the laws of Malaysia. 5
