Professionals You will have to provide proof of your professional status. Students You will have to visit your branch once a year to update your file. These annual interest rates apply when the promotional rate is not granted, when it is lost or once the promotional period has expired in cases where the promotional rate was granted: Purchases: 19.99% Balance transfers: 21.99% after the promotional period. Cash advances: 21.99% after the promotional period. Promotional rate: The promotional rate on balance transfers and cash advances is 3.9%, applicable to the first 6 billing cycles. The granting of the 3.9% promotional rate on balance transfers and cash advances is subject to a separate credit approval. The card could be issued without the promotional rate. This promotional rate is not available for the OVATION Gold card for students. Loss of promotional rate: You will lose the promotional rate and the interest rate will be set at 19.99% for purchases and 21.99% for balance transfer and cash advances, if you fail to comply with one of the conditions set forth in the Agreement governing the use of the MasterCard credit card, namely if you fail to make the minimum payment by the due date. Interest-free/ grace period Minimum payment Foreign currency conversion You benefit from a grace period of at least 21 days if you pay your full balance at the latest on the date indicated on your monthly statement of account. No grace period applies to balance transfers and cash advances. Your minimum payment will correspond to 3% of your account balance plus any amount already due or $10, whichever amount is greater (unless your account balance is lower than $10, in which case you must pay the entire balance). Terms and Conditions Definitions Account: means the MasterCard account held by the Cardholder with the Bank; Agreement: means the Agreement Governing the Use of the MasterCard Credit Card as well as any amendments, where applicable; Authorized User: means a person to whom the Bank, at the request of the Cardholder, has issued a Card that is related to the Account; Bank: means National Bank of Canada, its successors and assigns, where applicable; Card: means a MasterCard credit card issued by the Bank at the request of the Cardholder that is related to the Account, in particular, any card issued to an Authorized User; Primary Cardholder: means the person who holds the Account, whose name appears on the statement of Account and to whom a Card is issued. The terms Cardholder, you and your refer to the Primary Cardholder and not the Authorized User. Opening of the Account and Issuance of the Cards The Cardholder requests that an Account be opened and a Card be issued in his name and in the name of an Authorized User, where applicable, as well as the renewal or replacement of such Cards, when necessary. Compliance with the Agreement Should the Bank agree to issue a Card at the Cardholder s request, the Cardholder acknowledges that the first use of the Account or of the Card after the Agreement or a notice of renewal or amendment is sent will confirm the Cardholder s agreement to be bound by the Agreement. The Cardholder is liable for all the obligations set out in the Agreement, including the indebtedness resulting from the use of the Account or of the Card by an Authorized User. Should the Cardholder request the issuance of a Card for an Authorized User, the Cardholder undertakes to remit the Card and a copy of the Agreement to the Authorized User as well as any replacement or amendment to the Agreement. The Authorized User undertakes to read the Agreement remitted to him by the Cardholder at the same time as the Card as well as any subsequent amendment notice to the Agreement which the Cardholder will remit to him. The Authorized User acknowledges that the first use of the Card following receipt of the Agreement or of a notice of amendment will confirm the Authorized User s agreement to be bound by the Agreement. In particular, the Cardholder and the Authorized User must notify the Bank immediately in the event a Card or a MasterCard cheque is lost or stolen or if they have reason to believe that a third party is using their Card number without authorization. They must also cooperate in any investigation in this respect. Furthermore, the Cardholder and the Authorized User must protect their password and keep it confidential at all times. They must notify the Bank immediately if the password s protection or confidentiality is compromised or if they suspect that another person knows it. Other Account-Related Services The Cardholder and the Authorized User, where applicable, understand that they will be bound by all other agreements regarding the services related to the Card which the Bank may offer them from time to time, namely, the rules and regulations regarding loyalty programs to the extent that the Card offers such rewards. Collection, Use and Communication of Personal Information Collection The Bank collects information of a personal nature, such as identification and financial information and information on spending habits, in order to offer regular financial services related to the issuance, management, renewal or replacement of the Card and insurance products related to the Card (where legislation permits), by any technological or electronic means or by telephone, where applicable, to understand and meet your needs, to determine your eligibility for the various products and services which the Bank offers and, generally, to protect the interests not only of the Cardholder and the Authorized User but also of the Bank. The Cardholder and the Authorized User agree to provide the Bank with the necessary information about them for the purposes mentioned in this application. In particular, the Cardholder authorizes the Bank to obtain personal information about him from persons and entities likely to have such information or to confirm its accuracy (credit reporting and assessment agencies, financial institutions, public registries, regulatory authorities and organizations, employers, professionals and individuals given as reference). Use and Communication 1. The personal information collected by the Bank and that it requires so that it can provide the requested products and services may be used and communicated to the persons and entities mentioned in the preceding paragraph, to any person working for and with the Bank, including the Bank s suppliers, providers and agents, as well as to other third parties, to the extent permitted by law, for the following purposes: 1.1 to determine the financial situation and eligibility for the various products and services requested, including the benefits, programs and services related to the use of the Card, if applicable, as well as to check the authenticity and accuracy of the information provided; 1.2 to provide on a continuous basis the various financial products and services requested; 1.3 to allow the processing and storage of data and the collection of accounts and to conduct inspections, verifications and investigations regarding transactions made with the Card; 1.4 to protect the Cardholder, the Authorized User and the Bank from errors and fraud, thereby authorizing the Bank to monitor transactions made with the Card and, as needed, exchange personal information with merchants where remote transactions are made with the Card; 1.5 to allow the Bank to compile data for statistical purposes, to assess the quality of its customer service and, generally, to manage its activities and ensure their compliance, which authorizes the Bank to record and monitor telephone conversations and other exchanges (email, Internet, etc.); 1.6 to enable the Bank to adopt the necessary measures and to exchange the required information with its subsidiaries and affiliates for risk management purposes, to update the customer profile and to comply with applicable legislation, in particular with the Proceeds of Crime (Money Laundering) and Terrorist Financing Act; 1.7 to make it easier to identify the Cardholder and to distinguish the Cardholder from the Bank s other customers and to the credit reporting and assessment agencies, financial institutions, public registries, regulatory authorities and organizations, employers, professionals and individuals given as reference. The Bank may use the Cardholder s social insurance number for these specific purposes, unless the Cardholder declined to disclose it when completing this application form; 1.8 to enable interested individuals or companies to carry out due diligence audits in the event of the sale, assignment or any other form of transfer of the Bank s business or assets or to allow the conclusion of a transaction in this regard; 1.9 to convey the Cardholder s credit file to credit reporting and assessment agencies, to credit product insurers or to other lenders in order to preserve the integrity of the credit granting process, where applicable; and 1.10 in all other cases and under conditions where legislation allows the Bank to use and exchange personal information without the consent of the Cardholder and the Authorized User. 2. Some personal identification information, such as the name, address, telephone number, email address and financial information may also be used and communicated for the following purposes: 2.1 to offer the Cardholder or the Authorized User, through telemarketing or other means, namely their personal telephone number, other products and services offered by the Bank, its subsidiaries and affiliates, as well as by its select business partners who are well established corporations chosen by the Bank. Such information will also be added to the customer lists drawn up and used by the Bank for such purpose; and 2.2 to allow the Bank to communicate this information, to the extent permitted by law, to its subsidiaries, affiliates and agents as well as to its select business partners so that they can offer products and services that might be of interest to the Cardholder or the Authorized User, through telemarketing or other means, namely by telephone. The Cardholder and the Authorized User expressly agree that the Bank may use and communicate their personal information for the purposes stated above. The Cardholder and the Authorized User acknowledge that they may, at any time, withdraw their consent regarding the use or communication of their personal information for the purposes mentioned in paragraph 2 above, subject to reasonable notice. The Bank must be notified by telephone at 514-394-1427 in the Montreal area or, toll free at 1-888-622-2783, by email by visiting nbc.ca or in person at one of the Bank s branches. The requested product or service will not be refused solely because the Cardholder or the Authorized User does not authorize the use or communication of the information for these purposes. They will be notified of the consequences of withdrawing their consent, in particular of the fact that they will no longer receive information on the products and services likely to be of interest to them. However, such decision will not preclude the Bank from sending regulatory inserts or from printing messages on a statement of account or other statement or from posting them on a website banner or on an online transaction site. The Cardholder and the Authorized User authorize the Bank to keep the collected information for the above-stated purposes as long as such information is needed or for any other period of time stipulated or permitted by law even if they no longer do business with the Bank. The Cardholder and the Authorized User acknowledge that they may also have access their personal information and correct it, if needed, by sending a request to this effect either to a branch or by email to confidentiality@nbc.ca. In addition, the Cardholder and the Authorized User undertake to promptly notify the Bank of any changes in their personal information for the purposes of updating their files. The Bank is authorized to act on any information it holds about them until it is notified of any change to said information. Should the Cardholder or the Authorized User fail to notify the Bank of any such change, they cannot hold the Bank liable for any damages they might incur owing to the inaccuracy of the information it holds about them.
