About Malaysian Medical Indemnity (MMI) Malaysian Medical Indemnity (MMI) Insurance is a scheme arranged by Aon Insurance Brokers (M) Sdn Bhd (Aon Malaysia). Selecting your Limit of Indemnity The most important decision that you need to make when you take up MMI protection is the Limit of Indemnity. Like any insurance policy, MMI provides doctors with the option of choosing from a range of limits that will apply in the aggregate to all claims arising from treatment provided during the one year policy period. MMI provides choices of limit ranging from MYR 1 million to MYR 5 million in the aggregate. When selecting your MMI limit of indemnity, please consider the following: The nature of your practice. Some specialties, including obstetrics, orthopedics, and neurosurgery have a higher risk of large malpractice claims due to the nature of treatment or the age of the patients. The number of patients you treat. The MMI limit of indemnity is an aggregate limit, which means that the limit is shared amongst all claims arising from treatment given during the 12-month policy period. The possibility of the limit being required to cover more than one claim should be taken into account. The impact of inflation. In some cases, it is possible for claims to be brought many years after the date of treatment. The limit of indemnity that you select therefore needs to account for the possibility that a claim made in the future may be a higher value claim than it is today. Claim Reporting Requirements Claim Notification Process Your MMI policy document contains the following condition in respect of claims. It is a condition precedent to the right of the Insured to be indemnified under this Policy that notice of any Claim shall be given to the Insurer immediately upon the insured becoming aware thereof. A breach of this condition precedent will entitle the Insurers to decline all indemnity to the Insured in respect of any Claim. For the purposes of the MMI policy, a Claim means: If you become aware of a potential circumstance that may lead to a claim against you or when you receive a letter of demand, legal threat or writ of summon during the policy period relating to your medical services rendered to patients, please notify Aon Malaysia as soon as practicable. This will enable you to get the required support and assistance and may also help to mitigate a claim or circumstance at an early stage. Please complete the Claim Notification Form which will assist the Insurer to process your notification smoothly. any claim for actual or alleged Malpractice first made against theinsured during the Period of Insurance; any official investigation, examination, inquiry or other proceedings, coroner s inquest, prosecution or disciplinary proceedings first notified to the Insured during the Period of Insurance. The Insured shall give immediate written notice to the Insurers of any circumstances which may give rise to a Claim for Malpractice. If, during the Period of Insurance, the Insured gives written notice to Insurers in accordance with this clause, any Claim subsequently made against the Insured arising out of the notified circumstances shall be deemed to have been first made against the Insured during the Period of Insurance. Claims Management Protocol Once you have submitted your notification and the Claim Notification Form, within two working days, upon review of your notification and notifying the insurers about the claim or potential claim, Aon will send you an acknowledgement letter. Depending on the nature of the notification, this could range from a simple agreement to monitor any further developments through to the immediate appointment of lawyers to conduct the defence of a legal claim. It is critical that you should not respond to any demand, offer any settlement, or issue any apology or statement in relation to a claim circumstance or event prior approval from the Aon MMI Service Team or the insurers. FAQ When was the MMI scheme launched? Aon Malaysia has been providing Medical Indemnity Insurance solutions to Malaysian doctors since 2001. Why did Aon Malaysia decide to launch MMI? In recent years, Aon has received many requests from Malaysian doctors for an alternative protection against malpractice claims. MMI is our response to the need for a malpractice protection that combines cover with the certainty provided by an insurance contract that includes a written policy document. How is MMI arranged? Aon Malaysia acts as an independent insurance broker on behalf of Malaysian doctors who wish to take up cover. MMI Insurance is underwritten by MPI Generali Insurans Berhad and supported by a strong panel of Insurers. Who is covered under MMI? Each MMI Insurance policy covers the individual doctor for claims arising from medical practice worldwide excluding USA & Canada. What is covered under MMI? The key protection is for claims brought against doctors alleging negligence in the provision of medical malpractice. In such cases, MMI will cover the cost of appointing legal counsel to defend claims, the amount of any settlements, and court awards of judgments and costs. Protection for the costs of dealing with any MMC complaints against you including legal representation at a Malaysian Medical Council Disciplinary Tribunal hearing arising from treatment provided by a doctor is included under MMI. Can MMI cover me outside Malaysia? The protection provided by MMI is for medical care provided worldwide excluding USA & Canada. What happens when I retire or cease practice? MMI provides free protection for run-off cover for retired directors who have been with MMI for five years. In addition, run-off cover is available for doctors who cease practice or change practice at a nominal additional premium. How do I make a notification? Please download the Claims Notification form and contact MMI Service Team. What happens after I notify Aon Malaysia about my claim? Within two working days of making a notification, an Aon MMI representative will contact you to discuss your notification and agree on the next steps. Aon Malaysia will then guide you throughout the claim process to the final resolution of the claim. Will lawyers be appointed to defend me? Yes, where required, Aon has a panel of MMI-approved law firms, all of whom have substantial experience in managing malpractice claims. Will I need to bear any costs myself? No. There is no deductible under MMI, so doctors are not required to contribute anything to the cost of investigating, defending or settling claims. How can I obtain a certificate confirming that I am covered? Should you require a certificate to provide evidence that you are protected by Malaysian Medical Indemnity (MMI) Insurance Policy, please contact the Aon MMI Service Team.
