OREGON MUTUAL INSURANCE COMPANY M8634F (9-07) FARM FORMS REVISION ADVISORY NOTICE TO POLICYHOLDERS Dear Policyholders, This is a summary of the major changes to your policy. No coverage is provided by this summary nor can it be construed to replace any provisions of your policy or endorsements. You should read your policy and review your Declarations page for complete information on the coverages you are provided. If there is any conflict between the policy and this summary, THE PROVISIONS OF THE POLICY SHALL PREVAIL. Words or phrases that appear in quotation marks have special definitions within the policy. The areas within the policy that broaden, reduce or clarify coverage are highlighted below. This notice does not reference every editorial change made in your policy. FARM LIABILITY COVERAGE FORM FL 00 20 10 06 BROADER COVERAGE PROVIDED POLLUTION EXCLUSION The exception to the Pollution Exclusion which provides coverage for bodily injury arising out of smoke, fumes, vapors or soot from building heating equipment has been expanded to also apply to water heaters and cooling and dehumidifying equipment. REDUCTIONS OF COVERAGE REVISED MOTOR VEHICLE AND MOBILE EQUIPMENT COVERAGE AND MOBILE EQUIPMENT/MOTOR VEHICLE DEFINITIONS The Aircraft, Motor Vehicle, Motorized Bicycle or Tricycle Exclusion has been revised. Now, any land vehicle that had been classified as a piece of mobile equipment (with certain exceptions) under your previous policy, will now be considered a motor vehicle if that vehicle is subject to compulsory or financial responsibility laws or other motor vehicle insurance laws where such vehicle is licensed or principally garaged. With this change, coverage is no longer provided for these types of land vehicles since they are now defined to be motor vehicles and are subject to the Aircraft, Motor Vehicle, Motorized Bicycle Or Tricycle Liability Exclusion in your policy. However, the operation of certain mobile equipment would still be potentially covered under your policy, as cherry pickers currently are. If you wish to obtain coverage for land vehicles subject to compulsory or financial responsibility laws, or other motor vehicle insurance laws, you should consider an automobile policy. In addition, because of the above changes, we have revised the mobile equipment and motor vehicle definitions to state that mobile equipment subject to compulsory or financial responsibility laws or other motor vehicle insurance laws where they are licensed or principally garaged are now motor vehicles. DISTRIBUTION OF MATERIAL IN VIOLATION OF STATUTES EXCLUSION We have also introduced an exclusion to apply to bodily injury, property damage, personal injury and advertising injury arising directly or indirectly out of any action or omission that violates or is alleged to violate the Telephone Consumer Protection Act (which addresses consumers' concerns about certain telephone marketing practices), the CAN-SPAM Act of 2003 (which imposes limitations and penalties on the transmission of unsolicited e-mail messages), or any other statute, ordinance or regulation that prohibits or limits the sending, transmitting, communicating or distribution of material or information. PERSONAL INJURY TO AN INSURED EXCLUSION We have introduced an exclusion to apply to personal injury coverage when the victim of the offense is you or any other insured. This new exclusion also applies to you or one of the following members of your household in a cross claim situation: your relatives, any other person under the age of 21 in your or your relative's care, or a full-time student who was a member of your household before moving out to attend school.
