South Weber Planning Commission Meeting 13 March 2008 Page 2 of 5 FINAL PLAT COTTONWOOD COVE (43 LOTS); 1200 E. 7250 S.; ZION DEVELOPMENT: Jonathan Stokes, of Zion Development, is requesting final plat approval for the subdivision located at 1200 E. 7250 S. Preliminary plat approval was granted September 13, 2007. Chris Loock, of Zion Development, said this subdivision will be in two phases. Commissioner Hyde asked for public comment. Allen Ferry, 1097 Skyhaven Cove, asked when this subdivision will take place? Mr. Loock said Phase 1, on the west side, will take place this summer. Commissioner Grubb moved to close the public hearing for the final plat for Cottonwood Cove. Commissioner Westbroek seconded the motion. Conditions listed in the motion are as follows: 1. E-mail from Mark Larsen regarding the continuation of the storm drain from UDOT from Lot 30 to 1200 E. (Not Completed) 2. Obtain easement from Lester Drive for the new water line. (No longer needed) 3. Submit detailed landscape plan for roundabout. (Completed) 4. Completion of items listed in City Engineer s letter of 13 September 2007. (Not Completed) 5. Concerning item #2 of the City Engineer s letter of 13 September 2007, identify the affected lots of the collapsible soils and garbage so that the Planning Commission can have recommendations as to what to do with those items at the next meeting. (Not Completed) 6. Concerning item #4 of the City Engineer s letter of 13 September 2007, go forward with an easement to the city and not an HOA including a definition of the easements and identify in the CC&R s the maintenance of those items. (Not Completed) 7. Concerning item #9 of the City Engineer s letter of 13 September 2007, the Planning Commission is okay with meandering of detention pond but would like a detailed plan for roundabout with landscaping depth. (Not Completed) 8. The city needs a copy of the title report disclosing any boundary disputes. (Not Completed) 9. Change the percentage of evergreens to 40%. (Completed) 10. Add 6 ft. chain link fence on the west side between the agricultural property. (Completed) 11. The plat needs to identify lot 1, 5, 9, & 41 no driveway access onto main roads. (Not Completed) Discussion took place regarding access to Lot 1. Barry said it looks like a dangerous access. Matt was concerned about access to Lot 6. Barry suggested a circular driveway because that is a blind corner. Commissioner Stott said it wouldn t need to be necessarily a circular driveway, but vehicles need to be able to move in a forward motion. Barry said there needs to be another proposal for storm drain as well as UDOT needs to grant permission for the proposed connections to the two culverts crossing under I-84. Barry stated Rocky Mountain Power and Questar Gas Company need to sign off on the plat. Barry asked why two phases? Mr. Look said they are not excited about putting 44 lots on the market right now.
South Weber Planning Commission Meeting 13 March 2008 Page 3 of 5 Discussion took place regarding the remnant parcel south of Rex Bouchard s existing home. Mr. Loock said Mr. Bouchard is interested in purchasing that piece or Zion Development may hang on to it. Concerning the lots affected by collapsible soils, Mr. Loock said there will be separate geotechnical reports. Barry said that needs to be identified on the plat. Commissioner Westbroek said it needs to be on the building permit. Commissioner Hyde referred to Mark Larsen s memo of 29 February 2008. His concerns are as follows: 1. Remove old water line when new one is complete. (Mr. Loock said that will be completed). 2. Take small plants out of round about. If it is grass in center, we will need some way to get lawnmower on. (Mr. Loock said it will be a certain type of grass that will only need to be cut once or twice a year.) 3. What type of grass is in the HWY 89 buffer, will it need to be cut? 4. Water line on old fort road will need to be up sized. 5. How will storm that comes from South Weber Drive in the back of lots 19-31 be taken care of? 6. Is there an easement for the 10 off site water line? (Barry said they don t need this anymore.) The Planning Commission discussed a temporary alternative access on 1375 East. Matt said it will need road base as well. Commissioner Grubb moved to table the approval of the preliminary plat for Wind River Estates until the following items are completed and verified by city staff: 1. Completion of items listed in the City Engineer s letter of 12 March 2008. 2. Completion of items listed in Mark Larsen s letter of 29 February 2008. (see above) 3. Completion of items listed in the motion of 13 September 2007. (see above) 4. Further address temporary access on 1375 East. 5. Do not include the City owned property within the subdivision. Commissioner Grubb moved to open the public hearing to amend the front, rear, and side setbacks in the Residential Moderate (RM) & Residential Low-Moderate (R-LM) Zones. * * * * * * * * * * PUBLIC HEARING * * * * * * * * * * AMEND REQUIRED FRONT, REAR, AND SIDE SETBACKS IN RESIDENTIAL MODERATE (RM) & RESIDENTIAL LOW-MODERATE (R-LM) ZONES FROM 30 (THIRTY) FEET TO 25 (TWENTY-FIVE) FEET FRONT AND REAR AND FROM 10 (TEN) FEET TO 8 (EIGHT) FEET SIDE: This item was initially brought to the

During the Planning Commission meeting on February 14 th, it was decided that side yard setbacks should also be added to the amendment. The proposed setbacks are 25 feet front and rear and 8 feet side. The proposed change will only affect the Residential Moderate and Residential Low-Moderate zones. Commissioner Hyde asked for public comment. Chris Loock, of Zion Development, said he is in favor of this amendment. Allen Ferry, 1097 Skyhaven Cove, said he is in agreement with this amendment. Commissioner Stott moved to close the public hearing to amend the front, rear, and side setbacks in the Residential Moderate (RM) & Residential Low-Moderate (R-LM) Zones. Commissioner Grubb seconded the motion. Commissioners Grubb, Hyde, Stott, and * * * * * * * * * * PUBLIC HEARING CLOSED * * * * * * * * * * Matt said a potential negative may be homes being closer and the possibility of a fire traveling quicker to homes with the wind in South Weber. Commissioner Grubb moved to recommend the amendment to front, rear, and side setbacks in the Residential (RM) & Residential Low-Moderate (R-LM) Zones from 30 feet to 25 feet front and rear and from 10 feet to 8 feet side. Commissioner Westbroek seconded the motion. Commissioners Grubb, Hyde, Stott, and Westbroek voted yes. The motion carried. OTHER BUSINESS: Red Hawk Homes: Commissioner Grubb asked about the excavation at the toe of the hill. Matt said Jones & Associates will conduct the inspection. South Weber Planning Commission Meeting 13 March 2008 Page 5 of 5 Planning Commission Work Meeting March 13, 2008 The meeting began at 6:12 pm Commissioners Present: Delene Hyde, Rorie Stott, Rod Westbroek Excused: Mark Perkins, Tim Grubb Staff Present: Barry Burton, Matt Dixon, Emily Thomas Visitor: John Koning Rezone Property at Approximately 1150 E. Lester Street Layne & Calvin Kap have requested that parcels 13-027-0004 and 13-027-0005 be rezoned from Agricultural (A) to Residential Low (R-L). This however, goes against the advice they were given from Barry when they initially approached him about the possibility of a rezone. They were counseled to follow the general plan and apply to rezone to the Residential Moderate (R-M) zone. Layne was unable to attend the meeting and sent John Koning as his representative. According to Mr. Koning, Layne would like to rezone the property to RM, even though the application states RL. Mr. Koning was informed that this would not be possible as notification had already been sent out stating that the rezone would be to the RL zone. Because of this, the application will need to be resubmitted or will need to move forward with the RL zone, which allows for less lots than the RM zone. After a phone call to Layne, it was decided that the application would be withdrawn at this time and resubmitted to reflect a request to change to the RM zone. Final Plat for the Cottonwood Cove Subdivision The majority of the items from the preliminary approval on September 13, 2007 have not been completed. These items will be discussed more fully in the regular meeting. Matt had questions about how the subdivision will be phased and how the city approves simultaneous phasing. Barry stated that all of the improvements need to go in at the same time; all appear to be located in the first phase. Another concern with phasing is the ingress and egress of the phases. It has been city practice and preference that two are provided, but no ordinance states that this must be done.
