Approve the adjusted campaign contribution limits and adopt a resolution approving the adjusted campaign contribution limits in accordance with San Jose Municipal Code Section 12.06.210.C. 2. Place the item on the November 17, 2015 Council Agenda for action. OUTCOME Approval of the recommendation will update the campaign contribution limits for the Primary Municipal Election to be held on June 7, 2016 and the General Municipal Election to be held on November 8, 2016. BACKGROUND On November 1, 2011, the City Council adopted Ordinance 28985 amending certain sections of Title 12 of the San Jose Municipal Code. As part of that Ordinance, Section 12.06.210.C directed the to recalculate the campaign contribution limits based on the Consumer Price Index (CPI) for the San Francisco-Oakland-San Jose area and round to the nearest one hundred dollars in September 2015. The Ordinance set forth the formula the is to use. Based on CPI data from the Bureau of Labor Statistics, those calculations are below. ANALYSIS CPI Change CPI for June 2015 259.117 Less CPI for December 2010 227.658 Equals index point change 31.459 Divided by December 2010 CPI 227.658 Equals 13.82%

Adjusted Campaign Contribution Limits t_ - _ Page 2 Campaign Contribution Limits The 2011 campaign contribution limits were set at $500 per person for Council candidates, and $1,000 per person for Mayoral candidates. The 2013 campaign contribution limits were adjusted to $500 for Council candidates and $1,100 for Mayoral candidates. With the adoption of this resolution, the 2015 campaign contribution limits will be adjusted to $600 for Councilmember candidates and $1,100 for Mayoral candidates. EVALUATION AND FOLLOW-UP No additional follow-up action with City Council is expected at this time. PUBLIC OUTREACH This memorandum will be posted on the City's Council Agenda website for the November 17, 2015 Council Meeting. RD:NXN:KML 10/14/2015 RESOLUTION NO, A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN JOSE APPROVING THE ADJUSTED CAMPAIGN CONTRIBUTION LIMITS IN ACCORDANCE WITH SAN JOSE MUNICIPAL CODE SECTION 12.06.210C WHEREAS, on November 1, 2011, the San Jose City Council ("City Council") adopted Ordinance 28985, amending certain sections of Title 12 of the San Jose Municipal Code ("SJMC"); and WHEREAS, as part of that Ordinance, Section 12.06.210C of the SJMC was amended to direct the to recalculate the Campaign Contribution Limits based on the Consumer Price Index ("CPI") for the San Francisco-Oakland-San Jose area if the CPI has increased during the "base period" as defined in Section 12.06.210C of the SJMC, beginning September 1, 2013 and continuing thereafter on September 1 st of each odd numbered year; and WHEREAS, if the calculation results in an amount that is higher than the previously established Campaign Contribution Limit(s) when rounded to the nearest $100, the City Clerk will then increase the Campaign Contribution Limit(s) established in SJMC Section 12.06.21 OA and SJMC Section 12.06.210B by the percentage increase rounded to the nearest $100, and recommend that the City Council adopt a resolution specifying the adjusted Campaign Contribution Limit(s); and WHEREAS, the calculations below reflect the change in the Campaign Contribution Limits directed by Section 12.06.210C of the SJMC: T-23270.002/1251639 1 Council Agenda:.
