Gonzalez, Ext. 320 Action Necessary: No SUMMARY: Planning Commission staff is requesting a text amendment to the Capital Improvements Element (CIE) of the Comprehensive Plan. Pursuant to Section 163.3177(3)(a)4. and 5. of the Florida Statutes, the CIE schedule of capital improvement projects must be updated on an annual basis and include all federal, state and local projects that affect levels of service. To date, the County has complied with state law by incorporating each relevant agency s list of projects in each annual update of the capital improvement schedule. Recent guidance by the Department of Economic Opportunity (DEO) now allows local jurisdictions to incorporate these project lists by reference in the Comprehensive Plan, thereby eliminating the need to include each project list for the relevant agencies. This staff-initiated text amendment would incorporate by reference the Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County School District s Public Schools Facilities Work Program. This amendment will ensure that projects listed in the TIP, TDP, and Public Schools Facilities Work Program remain consistent with the Comprehensive Plan, as required by law, while reducing the size and complexity of the Comprehensive Plan. RECOMMENDATION: This item is for your information only. No action is required. ATTACHMENTS: Amendment summary.

Capital Improvements Element Text Amendment Planning Commission Briefing: December 14, 2015 Application type Publicly initiated Proposed Text Amendment CIE Policy 3.D: The Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County Public Schools Facilities Work Program are incorporated by reference into the Capital Improvements Element of the Comprehensive Plan, except as expressly excluded during the annual adoption of the Schedule of Projects. The County is not financially responsible for those capital projects which are funded, maintained and/or under the control of other agencies or jurisdictions. Policy 8.3: The County adopts by reference the schedule of capacity improvements approved by the School Board annually, that includes school capacity sufficient to meet anticipated student demands projected by the County and municipalities, in consultation with the School Board s projections of student enrollment, based on the adopted level of service standards for public schools. The 5-year schedule of improvements ensures the level of service standards for public schools are achieved and maintained within the period covered by the 5-year schedule and are shown in Table 7 of this element. Policy 8.5: By December 1st of each year, the County shall amend Table 7 in the Capital Improvements Element to update the five year work program approved by the School Board to add planned facilities and funding sources that will ensure a financially feasible capital improvements program and to ensure level of service standards will be achieved by the end of the five year period. Purpose The staff of the Planning Commission is requesting an amendment to the Capital Improvements Element of the Comprehensive Plan to incorporate by reference the Hillsborough County Metropolitan Planning Organization s (MPO) Transportation Improvement Program (TIP), Hillsborough Area Regional Transit s (HART s) Transit Development Plan (TDP) capital projects, and the Hillsborough County Public Schools Facilities Work Program to obtain consistency between the plans, as required by law. I agree that adopting by reference is a better way to go. However, I was looking through the adopted CIE online, and I was wondering if the policies below should be update as well for consistency. HART has no objection to the proposed change if the schedule of capacity improvements approved by the School Board will go through the formal review process prior to the County adoption by reference. This will ensure a more comprehensive assessment for road capacity, sidewalks and impacts of peak period commuting delays when determining the needs for new schools.

The Department is providing the following cursory assessment. Background: With an estimated 2010 population of 832,340 (County estimate), unincorporated Hillsborough County is 909 square miles in size. Land uses with large amounts of acreage include residential, agricultural, public/quasi-public and commercial. The cities of Tampa, Temple Terrace and Plant City are located within Hillsborough County. Numerous federal and state facilities traverse the county, including I-4, I-75, I- 275, US 41, US 92, US 301, SR 60, SR 574, SR 580, and SR 589. Proposal: The County is proposing two land use plan amendments, both of them to greater intensities, and two text amendments. The table below summarizes all four as they relate to transportation facilities of state importance within three miles of the subject property. Development Services offers the following comments: The text amendment to the Capital Improvements Element (CIE) adopts by reference, in their entirety, the MPO Transportation Improvement Program (TIP), the Hillsborough Area Regional Transit Authority Transit Development Plan (TOP), and the Hillsborough County Public Schools Facilities Work Program. Section 163.3177 (3)(a) Florida Statutes requires that the 5 year schedule of capital improvements include "applicable'' transportation improvements listed in the MPO TIP "to the extent that such improvements are relied upon to ensure concurrency and financial feasibility." It should be noted that the statute neither requires such plans to be adopted in their entirety, nor does it require projects that are operational, maintenance, unfunded, or "vision" projects to be adopted in the Capital Improvements Element (CIE) or 5-year Capital Improvement Program (ClP). The LRTP TLP already includes HART~s funded priorities for the next 5 years. The Capital Improvement Element and 5 year CIP do not have to include the unfunded items identified in the 10 year "vision" section of the TOP, particularly when such projects are dependent on funding sources that have not been approved. Development Services statt recommends that the text be amended to only include capital projects that meet level of service standards, consistent with the intent of Section 163.3177 (3)(a) Florida Statutes, instead of incorporating the entire documents by reference.
