Notice of the time and place of the meeting was posted on the Utah State Public Notice website, the Fillmore City website, the Council Chambers, the City Office bulletin board, and the President Millard Fillmore Library. Notice was also provided to the Chronicle-Progress, radio station KMTI and each member of the governing body on April 28, 2017. Those present were: Mayor: Eugene R. Larsen Council: Michael D. By: Councilmember Mitchell Bills Payroll MOTION: To approve the April 30, 2017 payroll and payment of bills listed on the invoice register dated April 19, 2017 April 30, 2017. Second: Councilmember Holt MOTION: To ratify approval of Purchase Order # 17-07 payable to Natural Impressions in the amount of $13,750.00 for first payment on cemetery roundabout and fencing for the cemetery expansion project. Since then there has been a small amount of power running through it. The rest of the city s power has been running through the Airport Substation. It is critical that the station be repaired before the summer demand for power reaches its peak. The repairs include two new transformers and a complete re-build of the station. The estimated cost of the repairs is $2,000,000. The current invoice due to Flowell Electric is $473,043.81. These expenses include materials billed and remaining progress payments on transformers. MOTION: To approve Purchase Order # 17-10 payable to Flowell Electric in the amount of $473,043.81 for Creamery Substation re-build project expenses. By: Councilmember Holt Public Hearing To Receive Public Comment Regarding Amending the Fillmore City 2016-2017 Fiscal Year Budget MOTION: To go into public hearing at 6:40 p.m. to receive public comment regarding amending the 2016-2017 Fillmore City budget By: Councilmember Holt An amendment to the budget is needed to account for the $473,043.81 payment to repair the Creamery Substation. Fillmore City will receive a payment in the amount of $360,000 from UAMPS. This money comes from a retention fund that the city can draw from to help pay for unforeseen significant expenses. The amount in the retention fund increases each year due to projects coming in under budget that the city is involved with. $260,000 of that will help pay for half interest in a transmission line to bring more power into the city. The city will purchase the half interest in the line to eliminate $60,000 per year wheeling charges. The other $100,000 will go towards Creamery Substation re-build expenses. Bart Adams asked if a public hearing was standard procedure and if there was already money in the Electric Fund to help pay for the Creamery Substation repairs. A public hearing is required before the budget can be amended. The costs of the unforeseen repairs require the original budget be amended because the original budget will be exceeded significantly. The budget should be amended before the funds are expended. Funds will be spent from the electric fund in addition to the retention fund monies to pay for the re-build.

96 97 98 99 100 101 102 103 104 105 106 107 108 109 110 111 112 113 114 115 116 117 118 119 120 121 122 123 124 125 126 127 128 129 130 131 132 133 134 135 136 137 138 139 140 141 MOTION: To go out of the public hearing at 6:49 p.m. Second: Councilmember Holt COMMUNICATIONS AND REQUESTS Law Enforcement Report Lieutenant Morris Burton Lieutenant Burton summarized law enforcement activity in Fillmore for the month of March. There was 1 traffic accident, 10 citations issued for 12 violations, 157 CAD calls were received and there were 35 incidents that resulted in 17 arrests. Last weekend the Millard Sheriff Department participated in a National Take-Back Drug Initiative with the United States Drug Enforcement Administration. The program involves providing drop boxes where old or expired prescription drugs can be properly disposed of. People who have prescription drugs in their home are at risk of becoming targets of burglary if it is known that the drugs are in their homes. Millard County Commission Report - Commissioner Wayne Jackson Millard County is at a critical stage at the ambulance shed in that there is no one to operate it. Sheriff Deputies are filling in as drivers. The county does not want to outsource its ambulance services as that is very expensive. Volunteers are needed. The Sheriff Posse members can help fill in as drivers. The county needs two more ambulances. Ten emergency medical technicians are required to sufficiently operate the county services. There are times when no one is on call in Fillmore, and they need to rely on Delta to help. Having drivers will help because an ambulance can have a driver plus two EMTs. The county has soil samples being tested for the soccer fields to see if they are ready to plant grass. The soccer players now do not want to use the county fields for soccer. They prefer to play at the horse track and will continue to hold their tournaments there. Fillmore schools do not allow soccer to be played on school grounds. One of the new soccer fields may be converted into a baseball field. Millard County is concerned about losing the county s two Intermountain Power Plant (IPP) coal-fired power plants. The county is working with legislators to try and keep the plants in Millard County and use them once California will no longer use the power in 2027. 385 or more jobs will be lost when IPP changes from coal to gas. Mayor Larsen pointed out that IPP generates so much power that the whole state of Utah could not use it if California were to back out. There is a built-in one hundred million dollars to decommission the plant when the time comes. If that does not happen, then it would be up to the cities of Utah to decommission it. Millard County is looking to hire a new employee at the landfill. They are deciding on whether they want to hire for full or part time. A licensed operator is needed who can operate the equipment to cover the landfill every day. The position starting wage is minimum wage,

The city has agreed to pay wages for a part-time employee. Girl s State Donation Request Sydney Dearden Sydney has recently become interested in politics and government. It will be a great opportunity for her to learn more about government and she is excited to attend. She is willing to help with community events and she will report back to the council of her experience. MOTION: To approve a donation of $350.00 for Sydney Dearden to attend Girl s State. Second: Councilmember Mitchell Boy s State Donation Request Britton Rasmussen Britton is excited about the opportunity to attend Boy s State this year at Weber State University. He also is willing to provide help with community events and will report back to the council of his experience. MOTION: To approve a donation of $375.00 for Britton Rasmussen to attend Boy s State. By: Councilmember Mitchell Fillmore City Cemetery Rates Fillmore City is among the lowest in Utah in terms of cemetery rates for purchasing burial plots. Many cities in Utah charge $1,500 for residents to purchase a burial plot, where Fillmore charges $200.00. There are only five plots left for sale in the east 300 section which allows for upright headstones. The rates have not changed in over fifteen years. Information was provided to the council that includes cemetery rate comparisons for several other cities in Utah. A lengthy discussion ensued where the council and members of the public analyzed and suggested new rate amounts. Councilmember Mitchell made a motion to set the cemetery burial plot purchase rates to $350.00 for residents and $700.00 for non-residents. Councilmember Mitchell rescinded the motion because it was not an action item on the agenda. The council came to a consensus to amend the Fillmore City fee schedule to reflect these new rates. A resolution will be voted on in the next regularly scheduled council meeting. BUSINESS Appoint Robert Reidhead to Serve on Celebrations Committee MOTION: To appoint Robert Reidhead to serve on the Fillmore City Celebrations Committee for a three year term through May of 2020.

Attorney Greathouse will find out if sewer impact fees can be used for those reserve funds. MOTION: To adopt Resolution 17-05 Municipal Wastewater Planning Program Report Second: Councilmember Rhinehart Role-Call Vote: Unanimous. Motion carried. Final Adoption on Resolution 17-03 to Make Changes to Renewable Energy Policy MOTION: To adopt Resolution 17-03 to make changes to the Fillmore renewable energy policy By: Councilmember Holt Second: Councilmember Mitchell Role-Call Vote: Unanimous. Motion carried. Tentative Amendment to FY 2016-2017 Year Budget Amendment proposals to the current fiscal year budget were addressed and explained to the council. Notable amendments were proposed for the following accounts in the general fund. Court fines, State Court Fees, Contracts both Civil and Criminal, and Contracts Outside Engineering for a decrease in the total original budget from $2,165,620 to $2,113,140. MOTION: To approve the tentative amendments to the fiscal year 2016-2017 as explained. By: Councilmember Rhinehart Adopt Tentative Budget for FY 2017-2018 Year A tentative budget was presented for the fiscal year 2017-2018 that shows projected budget amounts for the following funds. General Fund, $1,963,480; Capital Projects Fund, $17,500; Water Fund, $638,900; Sewer Fund, $171,000; Electric Fund, $2,632,000; and Cemetery Fund, $15,000. MOTION: To adopt the tentative Fillmore City budget for the fiscal year 2017-2018 to include the above projected budget fund amounts. By: Councilmember Holt Second: Councilmember Jenson

There is nothing in the city ordinance that addresses problems with cats. The city only deals with dogs; however, owners of cats who injure people are liable. There were two dogs in the shelter this week, one of which is vicious because it attacked someone. Nobody wants to adopt it because it is a mean dog. No one has claimed the other dog. Sidewalks The Second Ward completed a service project where they repaired a portion of the sidewalk on 300 West. Other Councilmember Holt attended a conference where he learned more about a company called Qualtricks. They provide training on how to conduct internet surveys and collecting and organizing data from the internet. The County office currently uses their services for economic development projects. Qualtricks will present to the council in the next regularly scheduled council meeting. Councilmember Adams Celebrations There have been several requests from the public and members of the celebration committee to prohibit street parking along the 4 th of July parade route. The existing ordinance will be modified to allow this. Center Street will be used for the parade route instead of Main Street this year due to the UDOT construction project. Streets On May 1, 2017 the Department of Natural Resources started another deer removal effort in Fillmore. At least four deer were removed. Councilmember Rhinehart Cemetery The roundabout and flags will be in place by Memorial Day. Airport A bid opening for the airport apron improvement project will be held May 4 th at the city chambers. Other The State offers grants for recreational development. Some projects can be funded completely by the grant. Members of the community have expressed an interest in introducing more outdoor recreational offerings in Fillmore such as hiking and bike trails.

283 284 285 286 287 288 289 290 291 292 293 294 295 296 297 298 299 300 301 302 303 304 305 306 307 308 309 310 311 312 313 314 315 316 317 318 319 320 321 322 323 324 325 326 327 328 329 Councilmember Mitchell Parks Installation of the inline heater discussed in the April 18 th council meeting will likely not work in efficiently heating the water to the splash pad. The volume of the water going through the system is too much to keep it heated. Councilmember Mitchell will suggest to public works the possibility of adding a couple of black, above ground tanks near the fence to keep warm water going through the system. Councilmember Rhinehart said that he has received a great deal of positive feedback from the community expressing appreciation for the splash pad and that they are happy that the city completed the splash pad project. The city will work with the county in getting new infield dirt put onto the North Park baseball diamond. Millard County recreation will use the field for baseball and softball tournaments. Garbage The city does not have enough funds to pay for a full-time, benefited employee at the landfill. Currently the city pays half the wages for a part-time employee. Councilmember Jenson Water Johanson Construction will be mobilizing this week and will commence construction on the culinary water project next week. Van Con will also be mobilizing this week and starting construction next week on the Center Street Flooding project. There is an irrigation pipe that needs to be relocated before the ditch and culverts can be placed. Attorney Greathouse John Higgins and Bryan Stevens rejected the city s offer to pay the appraised value of their properties plus a pump for each household in exchange for easements to complete the culinary water pipe upgrade. The State Ombudsman will select a new appraiser for a second appraisal on their properties. The city will be able to give the new appraiser their input. Generally, the appraiser requested by the property owner will be selected when conducting a second appraisal. Mayor Larsen The home located at 265 North 200 West is dilapidated and is creating a nuisance to the neighbors. The city office sent a letter to the owner of the home requesting an action plan to clean up the home and yard. The owner has begun a clean-up effort and will continue to bring it back to an acceptable state. ADJOURNMENT Upon motion by Councilmember Rhinehart and second by Councilmember Adams, the meeting adjourned at 9:47 p.m. The next regular council meeting will be held May 16, 2017 at 6:30 p.m.
