Low-paid employment Information leaflet Employment is considered to be low-paid if the contractually agreed salary regularly falls below the level of 450.00 per month. In this calculation, one-off payments (e.g. Christmas bonus) are to be taken into account at the level of the proportionate share calculated for one calendar month. If more than one low-paid position is held, these will be combined to calculate the social insurance obligation. If an employee holds more than one low-paid position and the total income (including one-off payments) exceeds the limit of 450.00, then the overall income from all employment is subject to the usual contribution obligation. In such cases, the employee social security contribution will be deducted and paid to the health insurance fund together with the employer contribution. A low-paid position with a different employer may be carried out in addition to a non-low-paid main occupation subject to insurance obligations without the two positions being added together for calculation purposes (the low-paid employment therefore remains insurance-exempt). If, on the other hand, more than one low-paid position is held in addition to a non-low-paid main occupation subject to insurance obligations, then the low-paid position entered into first shall be left out of account and all other positions added to the main occupation for calculation purposes, meaning that in most cases, there is a contribution obligation to all branches of social security for the second and all subsequent low-paid positions. In all cases, the employer is required to pay fixed contributions to the pension and, if applicable, health insurance funds for all low-paid employment positions. There is no entitlement to claims within the health insurance fund as a result of low-paid employment. Since 1 January 2013, employees in low-paid positions ( 450 mini-job) have theoretically been subject to the insurance and full contribution obligation to the statutory pension insurance. The share of the pension insurance contribution to be borne by the employee currently stands at 3.7% of the employment income. This arises from the difference between the fixed contribution of the employer (currently 15%) and the full pension insurance contribution of 18.7% currently. The advantages of the insurance obligation for the employee arise from the acquisition of compulsory contribution periods to the pension insurance. This means that the employment period is taken into account in full in order to fulfil the various waiting periods (minimum insurance periods). Compulsory contribution periods are a precondition for following, for example: taking early retirement, claims for rehabilitation benefits (both medical and professional), claims for a transitional allowance in the event of rehabilitation measures under statutory pension insurance, making or keeping a claim to a pension on the grounds of reduction in earning capacity. Additionally, the employment earnings are taken into account not just proportionately, but at their full level, when calculating the pension. If the pension obligation is not wanted, the employee may apply for an exemption. In such cases, he or she must notify the employer in this case LBV NRW as income payment agency - in writing that he or she wishes to be exempted from the pension insurance obligation. If the employee holds more than one low-paid position, the application for an exemption may be granted only across all low-paid positions held at the same time. The employee must notify all additional and future employees with whom he or she holds a low-paid position of the exemption application. The exemption from the insurance obligation is binding for the entire duration of the employment position or positions; it cannot be revoked. The exemption basically takes effect at the start of the calendar month of entering the employment of the employer or LBV NRW as paying agency, and no earlier than the beginning of the employment. The precondition is that the employer notifies the Minijob-Zentrale of the exemption by the time the payroll is next calculated and no later than within six weeks of receipt of the exemption application. Otherwise, the exemption may not begin until after the end of the calendar month following the calendar month in which the notification was received by the Minijob-Zentrale. te to pension insurance institutes: Low-paid employees applying for an exemption from the pension insurance obligation voluntarily waive the right to the advantages listed above. With the exemption, only the employer pays the fixed-rate amount at 15% of the employment income. Before an employee makes a decision in favour of an exemption from the pension insurance obligation, an individual consultation is recommended regarding the pension-law effects, with the information and advisory services of the Deutsche Rentenversicherung. Income in the transition zone An employment relationship is considered to be in the transition zone if the income earnings received from the employment are regularly between 405.01 and 850.00 per month. If more than one position is held at the same time, these must be taken together for calculation purposes. For employees holding a position subject to an insurance obligation with earnings within the transition zone, the specific rules for the calculation of the contribution basis and for the distribution of the contributions to the health, nursing, pension and unemployment insurance funds apply to both employer and employee. Consequently, the employee bears the "full" proportionate contribution to the individual branches of insurance; the employee, on the other hand, bears only a reduced proportionate contribution. In pension insurance, the level of the pension claim is based on the income earnings subject to contributions. On the basis of a reduction of the income subject to a contribution obligation in the event of employment in the transition zone, only the reduced income will be used as a basis for the subsequent pension calculation for this period, meaning that the employer will receive only reduced pension rights. In order to avoid this reduction, the option exists in the field of pension insurance to waive the right to reduce the level of employment income subject to the contribution obligation and to pay the full employee contribution. The decision to waive the application of the specific rules on the transition zone must be notified to the employer in writing and will not usually take effect until the day on which the declaration was received by the employer. The employee may also appoint a later point in time for the waiver to take effect. If the waiver is received by the employee within two weeks of starting the employment, the waiver may also take effect from the start of the employment, if this is expressly requested by the employee. If more than one position is held under the transition zone rules, the waiver may only be applied to all of these positions taken together.
