Page 2 of 7 Do you prepare returns for California residents? If so, you might find this interesting! A few years ago, California issued regulations that addressed the issue of a tax professional who left the state but continued to service California resident taxpayers remotely. The regulations state that:.sales from services are assigned to California to the extent the taxpayer s customer (the purchaser of the service) receives the benefit of the service in California. I have multiple clients who have relocated to California and I continue to prepare their returns. I ve only been in California once in my life in 1999 but according to this regulation, that is totally irrelevant. (When I put on my attorney hat, bells and whistles start going off but that s a subject for another time and place.) By extension, here are the potential implications: A New York tax professional who prepares a return for a California resident will be required to report that income on Form 540-NR. Since we sign the return, California has many easy means of tracking compliance; and If the return is never filed, the Statute of Limitations never runs out, so this could apply to ALL years (and not just open years) Michael Novick, EA, Esq Upcoming Education Dates! A recent press Release from NYS DTF Acting Commissioner Nonie Manion encourages taxpayers to ask the following questions of their tax preparers: Are you registered with the IRS and New York State? Most tax preparers are required to be registered both with the IRS and NYS. How much will it cost? Ask to see a list of fees. The fee should be directly related to the services provided, and not the refund amount. Also, by law preparers cannot charge to e-file in NYS. How will I receive my refund? A refund should never get deposited into a preparer s bank account. The fastest and safest way to receive your refund is to have direct deposited into your bank account. Will you sign the return? A completed tax return must be signed by both the taxpayer and the preparer. Preparers also must include their federal tax ID (known as a PTIN) and either their NYS registration number or an exclusion code. Further, the press release give details on how to report a tax preparer who has engaged in illegal or improper conduct.
