MINUTE ORDER COUNTY COMMISSIONERS PUBLIC HEARING MINUTES SEPTEMBER 8, 2015 CALL TO ORDER: Chair Kelly called the Bonner County Commissioners hearing to order at 3:00 p.m. in the 3rd floor BOCC meeting room, Suite 338 of the Bonner County Administration Building, 1500 Highway 2, Sandpoint, Idaho. PRESENT: ABSENT: Commissioners Chair Cary Kelly; Vice Chair Glen Bailey; and Todd Sudick None ALSO PRESENT: Planning Director Clare Marley, AICP; Assistant Planner KayLeigh Miller; and Planning Secretary Jeannie Welter PUBLIC HEARING: SPECIAL USE PERMIT CALL FOR VISUAL, HEARING OR OTHER IMPAIRMENT REQUIRING ASSISTANCE: The Chair asked whether anyone needed special assistance to hear, see or participate in these proceedings. Hearing no response, the Chair continued with the public hearing. 3:00 p.m. File CS989-15 Scenic Half Marathon - Greater Sandpoint Chamber of Commerce is requesting special use permit approval for a half marathon to be held September 20, 2015. The total number of participants is expected to exceed 400. The start and finish will be at Sandpoint City Beach. The route will cross the Long Bridge, take the U.S. Highway 95 bike/pedestrian underpass and continue down Lakeshore Drive to approximately Springy Point, where the racers will turn around and retrace their route. Only the portions of the race within unincorporated Bonner County are subject to the special use permit. CONFLICT OF INTEREST/DISCLOSURE DECLARATIONS: The Chair requested the Commissioners declare any conflicts of interest or disclosures. The Chair noted that there were no disclosures or conflicts. STAFF PRESENTATION: Assistant Planner KayLeigh Miller presented a PowerPoint summary of the project and previously circulated staff report, concluding this project is consistent with Bonner County Revised Code. BOARD DELIBERATION: The Chair closed the hearing to public testimony. The Board discussed s and Conclusions. MOTION TO APPROVE: Commissioner Bailey moved to approve this project FILE CS989-15 for a special use permit on September 20, 2015, to allow a 10k run and half marathon along U.S. highway 95 and Lakeshore Drive, finding that it is in accord with the general and specific objectives of the Bonner County Comprehensive Plan and Bonner County Revised Code as enumerated in the following conclusions of law, and based upon the evidence submitted up to the time the Staff Report was prepared and testimony received at this hearing. Commissioner Bailey further moved to adopt the following findings of fact and conclusions of law as written. The action that could be taken to obtain the special use permit is to complete the Conditions of Approval as adopted. This action does not result in a taking of private property. Commissioner Sudick seconded the motion. VOTED upon and the Chair declared the motion carried, unanimously. s of Fact: 1 Site specific facts A. Site data: The proposed event will be held Sunday, September 20, 2015, with an estimated 1,200 participants. All portions of the race course located south of the northern end of the Long Bridge are located within Bonner County jurisdiction. B. Access: The race course is accessed from U.S. Highway 95 and Lakeshore Drive. Lakeshore Drive is an existing public right-of-way (varying width), with a paved travel way. C. Environmental factors: Portions of the race course located adjacent to the Long Bridge are located within the floodplain (Flood zone AE; D-FIRM panels 0718E and 0950E). However, the race will not impact the floodplain. Additionally, portions of the race course are designated as critical wildlife habitat (Bald Eagle foraging area and Bald Eagle nesting territory) by the Bonner County Comprehensive Plan. The race course does not contain mapped wetlands, according to the U.S. Fish and Wildlife National Wetland Inventory maps. Page 2 of 8

(b) That there is sufficient land area to accommodate the proposed special use, and that the temporary use and any appurtenant structures are so arranged on the land as to minimize any adverse effects on surrounding properties, and will not create particular hazards to adjacent properties. (c) That the design and management of the proposed special use will not pose a material risk to public health and safety. (d) That adequate public services (such as water supply, sewage disposal facilities, roads, law enforcement, traffic control, fire protection, emergency medical services, etc.) exist or will be provided to serve the proposed special use. (e) That the site plan and accompanying descriptive material for the special use are sufficiently detailed as to provide a clear and unambiguous description of the nature of the use to be allowed under the terms of the special use permit. (f) That measures can and will be taken to mitigate any adverse effects that the proposed special use may have. Page 3 of 8

A. The race travels through properties that have a variety of comprehensive plan map designations. The designations include Transition (<=2.5 AC), Urban Growth Area (<=2.5 AC) and Rural Residential (5-10 AC). The majority of the race course will occur within the public right of way. The turn-around locations are just west of Springy Point Recreation Area (half marathon) and just south of Northern Energy. The race course is bordered by the Pend Oreille River, Lake Pend Oreille, mixed use commercial properties, high density waterfront residential lots and rural residential parcels. B. (f) That measures can and will be taken to mitigate any adverse effects that the proposed special use may have. The race will be located on existing roads with no new structures proposed. All proposed stations are temporary and will be disassembled after the race. Traffic will be mitigated as proposed by the submitted traffic control plan. The applicant has provided a copy of the certificate of liability insurance, obtained for a $1 million per occurrence/$2 million aggregate liability insurance naming Bonner County as additional insured. A traffic control plan was submitted by the applicant, which outlines the placement of signs and volunteers. Emergency medical service aid stations will be located at the south end of the Long Bridge and at Springy Point Recreation Area. Additional roaming EMS stations will be provided along the course. Water/sports drink stations and portable toilets will be located at the south end of the Long Bridge, the fish hatchery and at the Springy Point turn around. The record contains: a site plan, application narrative, certificate of liability insurance and agency comments. The nature of the use to be allowed is a Half Marathon and a 10k race. See Conditions of approval below. Page 4 of 8

4 Agency Review The application was routed to the following agencies for comment on July 28, 2015: Panhandle Health District Bonner County Public Works Selkirk Fire District Idaho Department of Transportation Area of City Impact Sandpoint Bonner County EMS Idaho State Patrol Bonner County Sheriff Bonner County Emergency Management Services The following agencies commented: Bonner County EMS, memo dated July 28, 2015: EMS stated no comment on the special use permit request. Panhandle Health District (PHD), letter dated July 30, 2015 and email dated August 20, 2015: Initial comments received from John Dowling of Panhandle Health District stated that plans for sewage waste disposal were necessary, but had not been provided. Revised comments were later provided stating that upon further review of the project application attachments, the necessary information was located and Panhandle Health District has no concerns or objections to the plan. Bonner County Emergency Management Services, memo dated August 3, 2015: Emergency Management stated no comment on the special use permit request. Idaho Transportation Department District 1 (ITD), email dated August 4, 2015: Don Davis, P.E., Senior Transportation Planner, stated that District 1 of the Idaho Transportation Department has entered into a special use agreement with the Greater Sandpoint Chamber of Commerce that covers the marathon running event that will use the pedestrian long bridge and the bike path under U.S. Highway 95. He stated that ITD has no specific comments on or objections to the requested special use permit. Bonner County Public Works, email dated August 6, 2015: Matt Mulder, P.E., Staff Engineer stated that Bonner County Road and Bridge had no comment on the special use permit. He further stated that an encroachment permit for the event had been submitted and approved. City of Sandpoint, email dated August 31, 2015: Melissa Bethel, Associate Planner, City of Sandpoint stated no comment on the special use permit. A copy of the City of Sandpoint Parade/Public Assembly permit was provided. 5 Public Notice & Comments No public comment has been received regarding the proposed special use permit. Page 5 of 8

Conclusions of Law: Based upon the findings of fact, the following conclusions of law are adopted: Conclusion 1 This proposal was reviewed for compliance with the criteria and standards set forth at Sections 12-240 et seq., Bonner County Revised Code. Conclusion 2 The type of temporary use proposed, its general location and the characteristics of the specific site ARE compatible with the nature of the district and WILL NOT have material and long term negative effects. The marathon is a one-day event. The race hours are limited from 8:30 a.m. to 1 p.m. Conclusion 3 There IS sufficient land area to accommodate the proposed special use, and that the temporary use and any appurtenant structures are so arranged on the land as to minimize any adverse effects on surrounding properties, and WILL NOT create particular hazards to adjacent properties. There are no permanent structures proposed for the single-day race. The portions of the race within Bonner County are limited to Sagle Road and Sagle Elementary School. Conclusion 4 The design and management of the proposed special use WILL NOT pose a material risk to public health and safety. The race application includes a traffic plan. Traffic control persons and volunteers are assigned to the race course. There have been no adverse public agency comments. Conclusion 5 Adequate public services (such as water supply, sewage disposal facilities, roads, law enforcement, traffic control, fire protection, emergency medical services, etc.) DO exist to serve the proposed special use. The race application includes a traffic plan. Traffic control persons and volunteers are assigned to the race course. There have been no adverse public agency comments. First aid and water stations are provided by the applicant. Page 6 of 8

Conclusion 6 The site plan and accompanying descriptive material for the special use ARE sufficiently detailed as to provide a clear and unambiguous description of the nature of the use to be allowed under the terms of the special use permit. The application includes a traffic plan, race course site plan and narrative. Conclusion 7 Measures CAN be taken to mitigate any adverse effects that the proposed special use may have. Conditions of approval prohibit parking in the public rights-of-way. Liability insurance is required as a condition of approval. This action does not result in a taking of private property. Conditions of Approval: Standard & site specific permit conditions: A-1 The use shall be developed and shall be operated in accordance with the approved site plan. A-2 This special use permit shall not supersede deed restrictions. A-3 This special use permit shall be valid from 6:00 a.m. to 5:00 p.m. on Sunday, September 20, 2015. Upon petition by the permittee, the Board may allow one extension of time for the completion of the terms of the special use permit. This special use permit shall be deemed to run with the land to which it is attached, and the terms of this permit shall not be modified, abrogated or abridged by a change in ownership of such lands, or other private contracts or agreements. A-4 This special use permit shall be issued for a single event, use or structure, or a combination, for the time period specified. Renewals are subject to the provisions of BCRC 12-243(B). A-5 The terms and conditions of this special use permit shall not be changed except as set forth at Section 12-266, BCRC. A-6 Issuance of this special use permit constitutes an agreement between the applicant and Bonner County to guarantee by the applicant construction or maintenance of improvements, insure that operations are carried out with minimal risk to public health and safety or to minimize public or county liability which might result from the issuance of such special use permit. The traffic control plan shall be carried out as provided in the application. Page 7 of 8

Emergency medical aid stations shall be placed along the course and manned for the duration of the race as provided in the application. A-7 No parking shall be permitted within public right-of-ways. A-8 The applicant shall obtain and maintain in force liability insurance in the amount of $1 million per occurrence/$2 million aggregate liability insurance for the event, naming Bonner County as an additional insured against claims of liability resulting from the issuance of the special use permit.
