MINUTES of the Pembroke Town Board Workshop held on November 24, 2010 at the Pembroke Town Hall, 1145 Main Road, Corfu, NY. PRESENT: James H. Tuttle, Supervisor Peter Sformo, Councilman John Worth, Councilman Gary L. DeWind, Councilman Edward G. Arnold, Jr., Councilman OTHERS PRESENT: Nicole Begin, Town Clerk; Stephen Stocking, Highway Superintendent; and Ralph Peterson, Village of Corfu Trustee. The Workshop was called to order at 7:32 A.M. OLD BUSINESS DOG LICENSING The Board looked over the copy of the Dog law that they received at the Regular meeting November 10 th. The only feedback received was from Councilman Worth regarding the charge for a dog license tag. NYS will no longer provide the actual dog tag for each dog license issued and because of changes in the dog law all licensed dogs will need to receive a new tag with the Town of Pembroke and Town Hall phone number imprinted on them. Currently, the state does not tack on a fee for tags unless it is a replacement tag. Councilman Worth stated that we should charge a fee for all new dog license tags that we issue in the upcoming year to generate some revenue to hold fees for the long term. SALARY SCHEDULE The Board decided to discuss the salary schedule more before deciding on a change. GENERATOR FOR COMMUNITY CENTER The Board has decided to re-bid the generator out and to use the bid description from Spring Creek Construction. NEW BUSINESS Town Clerk, Nicole Begin has chosen Nancy Mandolene to fill the vacant Deputy position. Nancy will be coming to the position from the position of Assessor/Zoning clerk. Nancy will work 12 hours a week unless needed for more from time to time and Nancy s pay rate will be $10.88 which is what Nicole Begin s pay rate was as Deputy Town Clerk. Appointment will take place next week. When Nancy fills the position of Deputy Town Clerk that will leave the Assessor/Zoning Clerk position open. The position will need to be filled. The new clerk s job description will include being clerk to the Assessor and Zoning Office and secretary to both Planning Board and ZBA for a total of 19.5 hours per week at the rate of pay in which Nancy Mandolene receives now. 1
Workshop -2-11/24/10 For the Town of Pembroke to maintain the $8.82 per thousand tax rate to help defray the cost of the 2011 County Tax burden to the residents of the Town of Pembroke the Town must remit $200,133.63 to Genesee County by December 1 st, 2010. On MOTION of Councilman Worth, seconded by Councilman Arnold, the following RESOLUTION was ADOPTED by roll call vote: Councilman Worth, AYE; Councilman Arnold, AYE; Councilman Sformo, AYE; Councilman De Wind, AYE; Supervisor Tuttle, AYE. ALL AYES - MOTION CARRIED RESOLUTION # 62 of 2010 Appropriation of Unanticipated Sales Tax to Reduce County Tax WHEREAS the Pembroke Town Board wishes to help defray the cost of the 2011 County Tax burden to the residents of the Town of Pembroke; and WHEREAS the Pembroke Town Board has determined there is unanticipated Sales Tax received in 2010 in excess of the amount Budgeted in the 2010 Budget; NOW, THEREFORE, BE IT RESOLVED that the Pembroke Town Board appropriates $100,133.63 of said unanticipated Sales Tax to add to the $100,000.00 Budgeted in the 2010 Town of Pembroke Budget for a total of $200,133.63 to be used to reduce the 2011 County Tax burden to all town property owners outside the Village of Corfu. Budget Journal Entries as follows: B1120 Sales Tax $100,133.63 B1972.4 County Treasurer Reduce County Tax $100,133.63 There was discussion regarding holding a Public Hearing for adoption of Local Law #2 for Dog Control as New York State has decided to pass the task of all licensing aspects to Local Government. It was decided to keep the fees the same as they are at present. 2
Workshop -3-11/24/10 On MOTION of Councilman Arnold, seconded by Councilman Sformo, the following RESOLUTION was ADOPTED by roll call vote: Councilman Arnold, AYE; Councilman Sformo, AYE; Councilman Worth, NAY; Councilman De Wind, AYE; Supervisor Tuttle, AYE. 4 AYES 1 NAY MOTION CARRIED RESOLUTION #63 of 2010 Local Law #2 of 2010/Public Hearing RESOLVED that the Town Board of the Town of Pembroke will hold a Public Hearing at the Pembroke Town Hall, 1145 Main Road, Corfu, NY in said Town on the 8th day of December 2010 at 7:00 P.M. for the purpose of acting on Local Law #2 of 2010, Dog Control Law of the Town of Pembroke Both the Town and the Village of Corfu have been awarded grant monies for establishing a Sewer District. The engineers for both the Town and Village have stated in the past that it would be feasible to tie into the Village Sewer system to help establish infrastructure to the corners of Route 5 and Route77. Ralph Peterson, Village Trustee stated that the Village would need to update their plant to be able to accept what the Town would send to them. It was decided to set up a meeting with the Village of Corfu, the Engineers, GCEDC, and Clark Patterson to discuss further. Councilman Arnold left the meeting at 9:00 A.M. The board decided not to sign with Municipal Solutions, a specialized company that deals with cell towers, cable, and wind energy at this time and to continue discussing any future involvement. ROUND TABLE DISCUSSION Highway Department Highway Superintendent Stephen Stocking said that he contacted Zoning Enforcement Officer Charles Reid to have him inspect a farm on North Airville Road that has farm runoff draining into the roadside ditch which then drains into the Tonawanda Creek. Mr. Reid will contact NYS DEC. NYS DEC came and inspected our fuel tanks and alarms. The sensors in the tank are outdated and shot as well as the alarms. Parts are unavailable to repair them. The Town will have to update the system for approximately $6,500 using the same wiring and the same pumps. NYS DEC gave the Town 30 days to repair. The Board agreed to repair. Mr. Stocking will begin the process contacting a company out of Rochester, NY. 3
Workshop -4-11/24/10 Councilman Sformo - 77 Construction replaced all the lock at the Community Center. - 77 Construction sealed the unit on the Community Center Roof but it is still leaking but from somewhere inside. Councilman Sformo contacted Turnbull Heating and A/C to check out the heating unit and see why or where it is leaking from. Insulation was blowing from the heater in the kitchen area as well. - Councilman Sformo said he spoke to the Corfu Fire Department and Attorney Mark Boylan regarding the Fire Department getting a permanent key to access the Community Center. Mark Boylan said that according to the lease they are required to have a key. Councilman Sformo agreed to give the Fire Department a key but let the Fire Department know that if they violate the Community Center Use Policy they will be in violation of the lease and the lease would be terminated. - Supervisor Tuttle said he will check to see that the problem with flies has been resolved at the Community Center and Town/Village offices and Courts. Councilman Sformo said that there may be a problem with bugs coming from the men s bathroom in the Court. - Overhead Doors met with Councilman Sformo on the Fourth but he hasn t heard from them since. Will contact Overhead Doors to see if they are still interested in the job. - Scott Strollo installed new hand dryers in the bathroom. - Councilman Sformo received a call from the Boy Scout Troop that received a violation letter for misuse of the Community Center. They were not happy and said that they did not leave it looking that way. - Councilman Sformo spent three hours cleaning the Community Center kitchen and stated that the cleaners are not spending enough time cleaning there. Someone needs to be down at the Community Center to inspect and clean on a daily basis. - Councilman Sformo asked if the Town Board would replace Scott Stollo. Surpervisor Tuttle said that by December 8 th he would send Scott a letter to see if he was definitely resigning. The Board discussed replacing Scott Strollo with a part-time person or bid the projects out for repairs, mowing and cleaning. A consideration may be to hire the Village Maintenance Workers on an as needed basis to do the cleaning, mowing and maintenance. Until a decision is made Councilman Sformo, Councilman De Wind and Supervisor Tuttle will inspect the hall when needed. - The Board decided to discuss the report from Clark Patterson for the Community Center and the wall repair in the Highway Department and get that resolved in the next couple of meetings or after the first of the year when the work can be done. - All Town Board members received a copy of the Village of Corfu Employee Handbook. The Board members will take a look at it and get an idea for our employee handbook. - Cintas was at the Pembroke Community Center to check the fire extinguishers in the kitchen. 4
Workshop -5-11/24/10 Supervisor Tuttle Shellye Dale-Hall asked to attend training again this year and the Town could split the cost with the Town of Barre as we did last year. The cost for the training is $250.00 and the room fee is $255.00. Pembroke will pick up the training and Barre will pick up the room fee. Supervisor Tuttle and Councilman John Worth spoke to Court Clerk Susan Mortellaro regarding her status as a salaried or hourly employee. It was really important to Susan that she was a salaried employee. She must turn in a time sheet on a bi-weekly basis and will work no more than 80 hours per time period. A confirmation letter of the meeting will be sent to Susan. Susan received a letter two years earlier from Supervisor Beideck requesting her to submit a time sheet on a Bi-weekly basis. ALL AYES - MOTION CARRIED RESOLUTION # 64 of 2010 Building & Codes Training Attendance WHEREAS Shellye Dale-Hall, Building & Codes Officer, is requesting permission to attend the Niagara Frontier Building Officials Association Education Conference January 24 26, 2011 in Cheektowaga, NY; and WHEREAS monies for this Conference will be split between the Town of Pembroke and the Town of Barre; and WHEREAS the monies are in the 2011 budget; NOW, THEREFORE, BE IT RESOLVED that the Town Board grants permission to Shellye Dale-Hall, Building and Codes Officer, to attend the above mentioned Conference. 5
