A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SIGNAL HILL, CALIFORNIA, RECOMMENDING CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT 16-02 ADOPTING THE 2016 SAFETY ELEMENT UPDATE AND INCORPORATING THE LOCAL HAZARD MITIGATION PLAN AS AN APPENDIX WHEREAS, Section 65300 et seq. of the California Government Code mandates that each California city adopt a comprehensive, long range General Plan to guide the physical development of the City; and WHEREAS, Section 65302(g) of the California Government Code mandates that each city prepare a Safety Element as part of the General Plan that protects the community from any unreasonable risks associated with seismically-induced surface rupture, ground shaking, ground failure, tsunami, seiche, dam failure; slope instability leading to mudslides and landslides; subsidence, liquefaction, and other seismic hazards; flooding; and wildland and urban fires. The Safety Element shall also include mapping of known seismic and other geologic hazards and address evacuation routes, military installations, peakload water supply requirements, and minimum road widths and clearances around structures, as those items relate to identified fire and geologic hazards; and WHEREAS, the Signal Hill Safety Element was last updated in 1986; and WHEREAS, state law recommends that the entire General Plan be reviewed at least every five years and elements be revised, as necessary, to insure internal consistency; and WHEREAS, the Disaster Mitigation Act of 2000 required state and local governments to prepare mitigation plans to document their mitigation planning process, 1

and identify hazards, potential losses, mitigation needs, goals and strategies; and WHEREAS, on January 1, 2007, California Assembly Bill 2140 became effective which places limits on the amount of additional state funding to local jurisdictions for certain disaster recovery projects funded by the California Disaster Assistance Act, unless a local jurisdiction has a state and federally approved local Hazard Mitigation Plan and has incorporated the Hazard Mitigation Plan into the jurisdiction s Safety Element; and WHEREAS, in 2010, RGP Planning and Development Services consultants prepared a draft Safety Element Update however, the Safety Element Update was not adopted at that time pending completion of the City s Oil Code Amendment; and WHEREAS, on June 2, 2015, the City adopted Ordinance Amendment 15-01 amending Title 16 entitled Oil Code of the Signal Hill Municipal Code to establish regulations for development on properties with abandoned wells, establishing an equivalency standard, adding site restoration requirements, revising methane assessment and mitigation procedures for all development, and updating the standards and procedures for well surveys, leak testing and venting; and WHEREAS, on June 21, 2016, the Planning Commission overviewed the roadmap for adoption of the 2016 Safety Element Update; and WHEREAS, on July 19, 2016, a duly noticed Planning Commission workshop was held focusing on the Safety Element oilfield hazards including general oilfield information, development of properties with abandoned oil wells, and methane mitigation; and WHEREAS, the Planning Commission directed staff to prepare the 2016 Safety Element Update for adoption at a public hearing; and WHEREAS, staff has updated the Safety Element of the Signal Hill General 2

Plan in accordance with state law to include geologic hazards, flood hazards, fire hazards, oilfield hazards and other hazards, mapping of known seismic and other geologic hazards and identification of evacuation routes, military installations, peakload water supply requirements and minimum road widths and clearance around structures; and WHEREAS, Emergency Planning Consultants, Inc. has prepared the Hazard Mitigation Plan update, and all policies and programs contained therein and it is included as Appendix A in the Safety Element; and WHEREAS, in accordance with Signal Hill Municipal Code Section 20.86 entitled Amendments, the 2016 Safety Element Update is properly a matter for Planning Commission review and recommendation to the City Council for approval; and WHEREAS, the 2016 Safety Element Update is consistent with all other elements of the Signal Hill General Plan and the Zoning Ordinance; and WHEREAS, a Negative Declaration was prepared for the project in accordance with section 15072 of the California Environmental Quality Act (CEQA), which found that the adoption of the 2016 Safety Element Update would not result in any significant environmental impact and Negative Declaration 10/07/16(1) was made available for public review and comment for the required 20-day public review period; and WHEREAS, on October 7, 2016, a notice of a Planning Commission public hearing regarding General Plan Amendment 16-02 was published in the Signal Tribune newspaper in accordance with California Government Code 65091(a)(4) and was posted in accordance with Signal Hill Municipal Code Section 1.08.010; and WHEREAS, on October 18, 2016, at a Planning Commission public hearing, all interested persons were given an opportunity to be heard, and the Planning Commission recommended the approval of General Plan Amendment 16-02 as well as the adoption of Negative Declaration 10/07/16(1) relative to General Plan Amendment 16-02, 3

in satisfaction of requirements of the California Environmental Quality Act; and thereto. WHEREAS, the City has incorporated all comments received and responses NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of Signal Hill, California, does hereby recommend City Council approval of General Plan Amendment 16-02 adopting the 2016 Safety Element Update and incorporating of the Local Hazard Mitigation Plan as a part of the Safety Element (Attachment A). PASSED, APPROVED, AND ADOPTED at a regular meeting of the Planning Commission of the City of Signal Hill, California, on this 18 th day of October, 2016.
