Terms and Conditions HomePro Spend & Win Campaign 1. The HomePro Spend & Win Campaign ( Campaign ) commences on 1 May 2018 at 12:00AM MYT and ends on 30 June 2018 at 11:59PM MYT (both dates inclusive), unless notified otherwise ( Campaign Period ). 2. Eligibility 2.1 This Campaign is open to all new and existing Principal Cardmembers of Visa/MasterCard/American Express Credit/Charge Card(s) (referred to as Maybank Cards ) ( Eligible Cardmembers ) issued by Malayan Banking Berhad (Co. No. 3813-K) or Maybank Islamic Berhad (Co. No. 787435-M) (collectively referred to as Maybank ). 2.2 The following persons are NOT eligible to participate in this Campaign:- a) Persons exclusively holding Visa/MasterCard/American Express Credit/Charge Cards not issued by Maybank; b) Cardmembers whose Maybank Card account(s) is delinquent, suspended, cancelled, or in breach of any of the terms and conditions herein and/or in the Cardmember Agreement during the Campaign Period; c) Cardmembers of Maybank Cards who are or have been in default of any facility granted by Maybank at any time; d) Persons exclusively holding Maybank Commercial/ Corporate Cards without also holding Maybank Cards qualifying them as Eligible Cardmembers in a personal capacity; or e) Permanent or Contract employees of the Cards Marketing Department of Maybank s Malaysia and Regional Cards Marketing Department. 3. Qualifying Entries 3.1 Eligible Cardmembers must make purchase transactions using their Maybank Cards to earn Qualifying Entries, with each Qualifying Entry providing a chance to win the Prizes stated in Clause 4 below. Qualifying Entries may be earned in one of the following manners ( Qualifying Spends ): 3.1.1 One (1) Qualifying Entry will be automatically granted to an Eligible Cardmember by spending a minimum of RM150 in a single receipt; or 3.1.2 Twenty (20) Qualifying Entries will be automatically granted to an Eligible Cardmember by spending a minimum of RM1,000 in a single receipt. 3.2 Qualifying Spends shall include all purchases transacted at all HomePro outlets located at IOI City Mall Putrajaya, Summit USJ Subang, Tesco Melaka, Tesco Ipoh (Station 18), Tesco Penang (Jelutong), and Paradigm Mall Johor Bahru ( HomePro ) using Maybank Cards, including purchases made using the 0% EzyPay Installment Plan ( EzyPay ) during the Campaign Period based on the local transaction time captured in Maybank s system. For avoidance of doubt, EzyPay purchases shall be treated as Qualifying Spends based on the full transaction amount. 3.3 Qualifying Spends shall exclude payment of monthly installments of EzyPay, as well as fees and charges imposed by Maybank. 3.4 Split and/or repetitive retail transactions amounting to five (5) or more transactions in a single day at HomePro are disallowed and shall be disqualified. 3.5 Computation of the total Qualifying Spend shall be based on Qualifying Spends transacted with all valid Maybank Card(s) issued under the same Eligible Cardmember throughout the Campaign Period.
3.6 Qualifying Spends by Supplementary Cardmember(s) under the same Eligible Cardmember s Maybank Card account(s) shall be included in computation of the Eligible Cardmember s total Qualifying Spend. 4. Prizes 4.1 There is one (1) category of prize under this Campaign, the details thereof being as follows: Prize Category No. of Winners RM1,000 HomePro Gift Vouchers 10 4.2 The HomePro vouchers are given on an As Is basis and are not exchangeable for cash or any other good or service, whether in part or in full. 4.3 The HomePro vouchers are valid for three (3) months from the voucher issuance date and may be used to set-off purchase(s) at HomePro outlets. 5. Selection of Winners 5.1 Based on the Qualifying Entries earned, ten (10) Eligible Cardmembers shall be selected by Maybank s randomiser program. These 10 shortlisted Eligible Cardmembers shall be deemed the final and binding winners. 5.2 During the shortlisting process, all Maybank Card account(s) of each Eligible Cardmember must not be or become delinquent, invalid, and/or cancelled. Should such an event occur, the Eligible Cardmember shall be disqualified from being a winner, and a new Eligible Cardmember will be shortlisted using the randomiser program. 5.3 Each Eligible Cardmember is entitled to win only one (1) prize throughout the Campaign Period. 5.4 An Announcement of Winners shall be made on Maybank s website www.maybank2u.com.my within twelve (12) weeks after the end of the Campaign Period.
6. Fulfillment of Prize 6.1 A confirmation letter shall be sent to the Winners billing addresses recorded in Maybank s system within twelve (12) weeks after the end of the Campaign Period. 6.2 Winners are required to collect their prizes at a HomePro Customer Service Counter within eight (8) weeks after the issuance date of the confirmation letter. 6.3 All costs, fees, and/or expenses incurred or to be incurred by Winners in relation to the Campaign and/or the claiming of their prize; which shall include but not limited to the cost of transportation, accommodation, meals, personal costs, and any other incidental costs; are the sole responsibility of Winners. 6.4 Should there arise any dispute over or incident of non-receipt of a prize, Winners are required to contact HomePro Customer Service at 1800-28-2268 at the latest by 31 October 2018. No further requests or inquiries shall be entertained after 31 October 2018. 7. General 7.1 By participating in the Campaign, Eligible Cardmembers/Winners: a) agree to be bound by the terms and conditions herein; b) agree that all records of purchases transacted at HomePro and captured by Maybank s system within the Campaign Period based on local date and time shall be considered accurate and conclusive evidence of those transactions; c) agree that Maybank s decision on all matters relating to the Campaign including the determination of Winners shall be final, conclusive, and binding. No further appeal, correspondence, protests, or attempts to dispute the same shall be entertained in any event; d) agree that any reversal of Qualifying Spends shall be excluded from earning Qualifying Entries; e) give their consent for Maybank to disclose their particulars to Home Product Centre (Malaysia) Sdn. Bhd. ( Home Product Centre (Malaysia) Sdn Bhd ) for the purpose of contacting them during and after the Campaign Period; f) authorise Maybank to publish their names, photos, or other information provided by them for current and future advertising and publicity purposes in any advertising or publicity material relating to the Campaign without any compensation whatsoever; g) agree to access Maybank s website at www.maybank2u.com.my to view the terms and conditions, are deemed to have thereby agreed with any changes or variations to the terms and conditions herein, and are aware of the procedure to seek clarification from Maybank should any of the terms and conditions be not fully understood; and h) agree that in no event shall Maybank nor any of its officers, servants, employees, representatives, and/or agents (including without limitation any third party service providers engaged by Maybank for purposes of this Campaign) be liable to participants in this Campaign for any direct, indirect, special, or consequential loss or damage (including but not limited to loss of income, profits, or goodwill) arising from or in connection with this Campaign. 8. Maybank Privacy Notice 8.1 By participating in this Campaign, Eligible Cardmembers and Winners agree and give consent to allow their personal data to be collected, processed, and used by Maybank in accordance with Maybank Privacy Notice, which may be viewed at www.maybank2u.com.my ( Maybank s Privacy Notice ).
8.2 In addition and without prejudice to the terms in the Maybank s Privacy Notice, Eligible Cardmembers/Winners agree and consent to their personal data or information being collected, processed, and used by Maybank for: a) the purposes of the Campaign; b) marketing and promotional activities for HomePro Raya 2018 Spend and Win Campaign conducted in such manner as Maybank deems fit in any media including but not limited to any form of advertising or publicity media or material such as audio and/or visual recordings published through newspapers, television networks, radio stations, online and digital media, or otherwise on the Internet, without further express consent from the Eligible Cardmembers/Winners. Marketing and promotional activities include without limitation the use and/or publication of any details provided in and/or in connection to the entries, interview materials, responses thereof, and related photographs. In this regard, each Eligible Cardmember/Winner agrees to co-operate and participate without further express consent and/or payment or consideration in all reasonable advertising and publicity activities of Maybank in relation to the Campaign. 9. Maybank reserves the right to: 9.1 disqualify any Eligible Cardmembers at its sole and absolute discretion from participating in the Campaign; including but not limited to Cardmembers with payment due for thirty (30) days or more, whose accounts are suspected to have been fraudulently operated or otherwise closed by Maybank; 9.2 forfeit the Prize in the event there is a reversal of the Qualifying Spend awarding the winning entry, termination of Maybank Card account(s) during the Campaign Period, or non-compliance with the terms and conditions herein; and 9.3 withdraw, cancel, suspend, extend, or terminate the Campaign earlier in whole or in part; and/or to vary, supplement, add, delete, modify, or amend the terms and conditions herein; wholly or in part; at its absolute discretion, by way of posting on www.maybank.com.my, or by any other methods which Maybank deems reasonable by giving twenty-one (21) days prior notice to Cardmembers on such addition, deletion, or amendment of the terms and conditions or termination of the Campaign. 10. Maybank and any of its officers, servants, employees, representatives, and/or agents (including without limitation, any third party service providers engaged by Maybank for the purposes of this Campaign) shall not be liable and responsible for: 10.1 any failure or delay in transmission of sales transactions by Visa International Incorporated, MasterCard Worldwide, American Express, merchant establishments, or any party which may result in the Cardmember being omitted from participating in the Campaign; 10.2 any direct, indirect, special, or consequential loss, damage, or injury in any manner whatsoever suffered by Eligible Cardmembers (including but not limited to loss of income, profits, or goodwill) arising from or in connection with this Campaign and/or use of the prizes; 10.3 any dispute in relation to the quality or characteristics of the prizes or any terms and conditions in respect thereof shall be settled directly by Winners with Home Product Centre (Malaysia) Sdn Bhd without recourse to Maybank; and 10.4 any default of its obligation under the Campaign due to any force majeure event, including but not limited to Acts of God, war, riot, lockout, industrial action, fire, flood, drought, storm, or any other event beyond the reasonable control of Maybank.
11. The terms and conditions herein shall be governed by and construed in accordance with the laws of Malaysia, and Eligible Cardmembers and Winners agree to submit to the exclusive jurisdiction of the Courts of Malaysia. 12. In addition to the terms and conditions herein, Eligible Cardmembers and Winners agree that the general terms and conditions in the Cardmembers Agreement shall be read together with these terms and conditions as an single agreement.
