COMMENTS BY THE GENERAL PUBLIC No comments NOTICE OF THE APPEAL PROCESS Chairman Hough advised everyone of the appeal process. PRELIMINARY HEARINGS -000-000 Betty Reed Bear Revocable Living Trust An application submitted by Betty Reed Bear Revocable Living Trust for a change of zoning request from Special Lands to M, General Industrial uses as allowed within the M District. PUBLIC HEARINGS -000-000 David & Naomi Heneage (Continued from the June, 0 meeting) A public hearing regarding an application requesting a street/roadway or other right of way vacation submitted by David & Naomi Heneage, for a vacation of a portion of rd Street and West Street, located in the Town of Gold Circle (Midas), Nevada. Location: A portion of West Street along Block P, Lots &, and a portion of rd Street along Block P, Lot, as shown on File, Town of Gold Circle, filed in the office of the Elko County Recorder. Located in Midas, Nevada. Applicant/ Owner: Naomi & David Heneage Mr. Kingwell had presented the staff report during the last meeting for application -000-000 David & Naomi Heneage. Amendments to the staff report were made after a consultation with the applicant and the county surveyor. The amendments are written in blue. Mr. Kingwell read the amendments that were made to the staff report. Mr. Kingwell stated that Mr. Heneage had gone out and located the pins to his property. July, 0 Page 0 0 0 0 Mr. Kingwell explained the importance of not building on the RS roads as they exist. The county will not allow any abandonment on RS roadways. Mr. Kingwell read the staff recommendations, findings and conditions with the amendments. Chairman Hough expressed his concerns with the prescriptive roads within Elko County. Discussion followed on RS roads and the importance of prescriptive roads within Elko County and the restrictions on building within the roadways. Curtis Moore explained that RS protects the existing roads. Public comments: David Heneage thanked Mr. Kingwell and Commissioners on their cooperation on this issue. Mr. Heneage went out and found the original pins to his property. He stated that a dozer drove right through the pins that are 0 wide without damaging them. Mr. Heneage stated that the road extends tenths of a mile, and hasn t been driven on for quite some time and ends at a cliff. He stated that it is over grown by weeds. He said that the property that he owns is completely off the road. Mr. Heneage explained what he did to survey the property and the RS roadway. He stated that he was pretty lucky and the RS roadway barely touches his property. He stated that he has no problem with the agreement that was made with the Elko county staff. He commented that the prescriptive roads were an issue and that maybe there could be a study done regarding them. Chairman Hough asked if he was satisfied with the agreement. Mr. Heneage stated that he is satisfied with the staff findings and agreement. MOTION: Commissioner Galyen moved to forward an application -000-000, David & Naomi Heneage, to the Elko County Commission with the Planning Commission s recommendation for approval with staff s recommendation, conditions and findings, seconded by Commissioner Judd. Location: A.0 Acre parcel of land described as Parcel of that Parcel Map for Edward Jaffe with File No. filed in the office of the Elko County Recorder September,. Said parcel is located in Section, Township N., Range E., M.D.B. & M. Address is Royal Crest Drive in Elko, NV. Owner/Applicant: Young, Timothy C. & Timbre D. Mr. Kingwell stated staff is still awaiting a letter from the applicant outlining the condition and the reason why the need for a secondary residence and would like to continue this item until the next meeting. Public Comments: Mary Sheen stated that she just received the agenda and staff report today. She expressed her concerns regarding their access off of Sundance Drive. She stated that she doesn t think an ambulance or fire truck can get down the driveway they are creating off of Sundance Drive for the secondary residence. July, 0 Page 0 0 0 OTHER BUSINESS None STAFF UPDATE AND COMMISSIONERS COMMENTS Commissioner Galyen asked if the board could submit to Mr. Kingwell, a list of projects that the Planning Commission has approved in the past and what the status of these projects are. If any board member would like to email a list to Mr. Kingwell before the agenda date, he could review the status and report back at the next meeting. Commissioner Hough commented on Oasis and how he would be interested in the status of that area. Commissioner Galyen commented on sending Mr. Kingwell an email so he can research the status and report back to the board at the next meeting.
