An insurance certificate listing a $1,000,000 business liability policy with both the City of Massillon and the City of Massillon Parks and Recreation, ATTN: Lisa Benton, 505 Erie Street N., Massillon OH 44646 as an additional insured is required for any vendor selling items that can be ingested or placed on the skin to participate in the City of Massillon Farmers Market. ALL vendors will have until March 15, 2019 to turn in your registration packets. Acceptant letters will go out by March 29, 2019, upon approval. By May 1, 2019, we must have copies of any required licenses, the Hold Harmless Agreement, any required licenses, and your insurance certificate ($1,000,000 business liability policy) with the above additional insureds included on it. Without payment and completed application your booth will not be reserved. By signing this agreement, the City of Massillon Farmers Market participants acknowledge that they have received and read a copy of the Application, Rules, and Regulations and agree to abide by the guidelines and decisions of the City of Massillon, Massillon Parks and Recreation and the Massillon Farmers Market Manager. MASSILLON FARMERS MARKET RULES & REGULATIONS Location, Days and Hours The Massillon Farmer s Market will be on Saturday s beginning June 1, 2019 and ending October 5, 2019. The market hours will remain 8:00 am to noon, rain or shine. It will be held in the City of Massillon Justice Center Parking Lot located at 2 nd Street SE and Tremont Avenue SE. Vendors may arrive no earlier than 7:00 am to set up and set up no later than 7:45 AM. Vendors must vacate the property by 1:00 pm. Vendors are only permitted to leave early if they have sold 90% of their merchandise. Vendors are not permitted to sell during non-market times. General Information The spots are first come first serve, with returning vendors having priority Vendors must provide their own tables and other display equipment. o We ask that you have tents and proper signage for your spot. If you have not been a vendor with us please provide a few pictures of your set up. o Vendors must make sure all stands, tables, and tents are secure and places within the lines of your booth space. o The Market manager has a right to require a vendor to change his or her display if it is considered to present a safety risk or does not comply with the market rules. Vehicles you are selling from must be pulled all the way up into the spot. Please maintain a line with the other vendors. If you do not have to have your vehicle with you to sell out of, please park it in a parking spot away from the Farmers Market area. Parking will be available in the Municipal Parking Lot next to the market area. You may retain your space from year to year if you remain a vendor in good standing. For customer ease, prices for all items should be clearly marked. Power and water are available to market vendors. Vendors are required to provide bags for sold merchandise and have enough change for each day s sales. All animal waste, litter, debris, and other materials must be cleaned up and removed before you leave. This includes both your booth and parking area. Vendors may not bring animals, except for the beehive display, in the honey booth, service animals, and horses, if being used for travel. If you travel with a horse, it cannot be parked in the market area and must be parked in the City Parking Lot. Vendors must have specific proof of general liability insurance if they are selling any consumable or any items being applied to the skin (bath, body, lotions, etc.) A business policy with coverage of $1,000,000 is required naming The City of Massillon, 151 Lincoln Way E. Massillon, OH 44646 and the Massillon Parks & Recreation Department, 505 Erie Street N., Massillon OH 44646 as additional insureds. Vendors selling non- consumables and non-skin items must sign a Hold Harmless agreement. Vendors must comply with all applicable local health department, Ohio Department of Agriculture, USDA and any other federal, state or local licenses and regulations. The Massillon Farmer s Market is not responsible for the enforcement of USDA, ODOA or any other local regulations. Each vendor is responsible to be aware and be in compliance with regulations for their booth sales. You can contact the Massillon Health Department at (330) 830-1710 or the USDA at (614) 728-6250 with questions regarding these regulations. No onsite preparation of food is permitted, unless you have a mobile license. Documentation from the City of Massillon Health Department is attached. All vendors are independent entities and are responsible for compliance with local codes and paying all applicable taxes: federal, state and local. Personal and product liability is the responsibility of the vendor. All City of Massillon and Massillon Park Ordinances must be followed. Vendors must follow all rules and regulations. Neither the City of Massillon nor the Massillon Parks & Recreation Department are responsible for any damage, loss, injury, harm, theft, or altercation that may occur before, during, or after the hours of the market. Vendors take full responsibility for all liability for any occurrences.
Permitted Items Fruits, vegetables, food items, plants, cut/dried flowers, baked goods, t-shirts, and handmade craft items can be sold at the market. Other items will also be considered, but should be submitted to the Lisa Benton for approval. Cottage food products that follow the guidelines of the USDA cottage food regulations will be permitted. Handmade craft items must be approved. Baked Goods and canned items must be clearly labeled with all ingredients to follow the USDA regulations. Eggs and food items requiring refrigeration may only be sold by vendors with a mobile license. Duplication of products will be limited at the market. Items that are NOT permitted Flea market and/or second-hand items are not permitted to be sold. Non- Farmers Market type items, such as electronics, are not permitted to be sold. Discipline Policy All issues pertaining to the market should be brought to the attention of the Lisa Benton, Special Events & Marketing Coordinator, Massillon Parks & Recreation Department, 505 Erie Street N., Massillon OH 44646 Failure to follow the guidelines will result in 1 written warning and then dismissal from the market, permanently, without a refund. Attendance Policy You must sell 90% of merchandise before leaving the market early. No refunds will be given for weeks missed! Liability Insurance/Hold Harmless Agreement/Licensing Vendors selling consumables or items being applied to the skin are required to attach proof of insurance naming the City of Massillon and the Massillon Parks & Recreation Department as additional insureds. The business liability insurance policy with a $1,000,000 value is required. Everyone is required to complete and submit the Hold Harmless Agreement. Once you receive your acceptance letter, you need to send in the required documents. You will not be permitted to participate in the market until this insurance certificate, your Hold Harmless Agreement and any required license(s) have been received.
