GENERAL TERMS & CONDITIONS FOR WORK CONTRACT 1. Contract means the documents forming tender and the subsequent agreement that may be entered into. 2. Work or Works means Maintenance Contract for refilling of cartridge of any type of laser printer of computer at SSHEP, Kevadia Colony. Contractor means a firm or an individual undertaking these works or offers the rates for this work. 3. The general rules and regulations of the GSECL for tender and contract for works will apply to the extent of the same and not modified herein. The contractor is deemed to have gone through and considered to be fully aware of the conditions mentioned therein. 4. Earnest Money Deposit: Tender should be submitted along with Earnest Money Deposit (EMD) at the rate of one ( 1% ) percentage of estimated cost of the tender, without which tender is liable to be rejected. 5. Security Deposit: Successful bidder shall have to pay Security Deposit (SD) equivalent to 5% of the ordered value. S. D should be paid in cash or Demand Draft in favor of payable on State Bank of India, Kevadia Colony Branch OR Bank Guarantee issued by Bank within seven days of acceptance of order. Failure to deposit the S. D. will entail forfeiture of EMD and the contract shall be treated as terminated. The contractor shall not be allowed to start the work if SD is not paid before the stipulated period. 6. The amount of Security Deposit will be refunded after the satisfactory completion of the contract after certification by the concerned Superintending Engineer and after deducting any dues of the GSECL. 7. To sublet or to transfer the contract without prior approval of the GSECL shall be treated, as breach of contract and it shall be punishable by forfeiting the S. D. as well as termination of contract. 8. The GSECL reserves the right to forfeit the S. D. in case of any breach of contract and in case of disputes. The decision of Chief Engineer, SSHEP,Kevadia Colony shall be final, binding and acceptable to the contractor. If the contractor fails to start the work as stipulated, the EMD and the S. D. shall be forfeited. 9. Payment: Monthly charges will be paid after rendering services only. Party shall have to produce their bill in three copies along with separate bill of supply of cartridges as per Schedule-B. The R. A. Bills along with the supporting documents will be paid within 30 days on submission of bill. 10. The total Value of rate contract is Rs.70,000/- ( Rupees Seventy Thousand Only.) 4

11. The GSECL will be entitled to deduct directly from the bills to be paid to the contractor any sum or sums payable by the contractor and which sum/sums the GSECL is required to pay as a principal employer on account of contractor s default in respect of all liabilities referred to in above clauses. 12. No sales tax, professional tax, cess or levy, excise duty, octroi, royalty or other duties will be payable by the GSECL against this contract. 13. The quantities mentioned in the Schedule-B are approximate only and may vary widely. The contractor shall be paid for the actual works carried out at the rates quoted by him. 14. During refilling, if cartridge damages, party shall have to replace it at his own cost. 15. Rejection of Tender : a. Tender will be rejected if party does not accept our all conditions. b. Conditional Tenders will be rejected. c. If tender is found incomplete or not signed on each page by the party. d. If party has provided wrong information or try to mislead to the board. e. Insufficient experience of refilling. f. If party does not fulfills pre-qualification criteria. g. If party is black listed by the Board, Govt., Semi Govt. or any Recognized Body. h. If party s contract is terminated due to poor performance by the Board, Govt., Semi Govt. or any Recognized Body. i. If party do not agree to refill toner cartridges and replace to spares at our premises. 16. Termination of Contract : a. Board may reserve the right to terminate the contract after issuing one week s notice, without assigning any reason if service is not found satisfactory. b. If party uses lower quality s material. c. If the contractor or any employee of contractor is involved in any illegal activity, contract will be terminated and if any loss occurs to the board, party shall have to repay it or recover. 17. Execution of Agreement: The successful bidder (contractor) will have to enter into an agreement with the GSECL and the cost of the stamp paper will be borne by the contractor. The contractor will also have to execute indemnity bond on required value of stamp paper as per GSECL s rules. The cost of stamp paper for indemnity bond will be borne by the contractor. 5

18. The contractor will make arrangements at his own cost to insure all men, materials and equipment employed for this work. The GSECL will not be responsible for any loss or damage either to the contractor s personnel or his equipment. 19. Time Limit: The time limit for completion of this contract works, if awarded, is 11 (Eleven) months from date of commencement. GSECL can extend contract for further six months after expiry of time limit, if desired by GSECL and quantity will be enhanced proportionately with same rate of running order. 20. Sealed tender should be super scribed as Maintenance contract for refilling of cartridge & replacement of Drum /PCR blade on rate contract basis at GSECL,SSHEP,Kevadia Colony. 21. Technical Bid & Price Bid should be sent by RPAD only so as reach this office before last date & time of acceptance of the tender. GSECL will not be responsible for any postal delay. Tender received after last date and time of acceptance will not be considered. 22. The rates quoted shall be firm and valid for 180 days for acceptance from the date of opening. 23. GSECL reserves right to divide work to nos. of agencies / Overall L1 party. 24. Compensation for the Delay: Penalty for delays Any delay that may take place in supply and /or erection, testing and commissioning activities beyond contractual cut off date/stipulated period in the order shall be subjected to penalty (not liquidated damages) at the rate of ½% of the contract price/order price per week or part thereof subject to a maximum of 10% of the total contract value/order value(i.e. End cost including taxes & duties). // SCOPE OF WORK \\ Name of Work:- Maintenance Contract for refilling of cartridge & replacement of Drum /PCR blade on rate contract basis at GSECL,SSHEP,Kevadia Colony. 1. The work should be Commence at once after receipt of the commencement order. 2. The said work should be done on urgent basis as and when required. 3. Refilling of cartridge of computer printers (i.e. SAMSUNG, HP,Canon etc.) is to be done by the contractor. 4. The detailed work is to be appraised in consultation with Engineer In- Charge. 5. The contractor shall have to attend work for refilling of empty cartridge / replacement of drum & PCR blade ( If required )within 03 days after receipt of mail/telephonic instruction either from SSHEP Site OR from Administrative Building at Kevadia Colony and duly refilled cartridge (same one which was collected) should be returned at respective site/ place within three days. 6. No. of cartridge refilling made is required to be logged in register with concerned signature and same is to be signed by Engineer-In-Charge or authorized person of GSECL. 7. The contractor shall have to again refill the cartridge in case of refilled cartridge failed to print/ un satisfactory output without charging any extra cost.lumpsump Rs.10/- per week will be penalty for not satisfactory of work. 8. During refilling, empty cartridge / replacement of drum & PCR blade (If required) if any damages, party shall have to replace it at his own cost. 9. Payment is to be made as per actual work carried out for GSECL, i.e. outsiders (other than GSECL) are not allowed for the said work. 10. The decision of the Chief Engineer, GSECL,SSHEP,Kevadia Colony shall be final in case of any dispute. 11. The contract shall be issued for 11 (Eleven) months from the date of issue of work from commencement letter. 12. You have to execute an agreement as per GSECL s rule. 13. The GSECL s General Terms & Conditions of works shall be applicable to this work, which shall be studied before giving sealed quotation.
