Fill, Swipe & Win Campaign Terms and Conditions The terms and conditions herein ( Terms and Conditions ) are in addition to and are to be read together with the AmBank (M) Berhad (8515-D) ( AmBank ) / AmBank Islamic Berhad (295576-U) ( AmBank Islamic ) (collectively referred to as The Bank ) relevant credit card agreement(s) ( Cardmember Agreement ) and AmBank Debit MasterCard Terms and Conditions which govern the use of the credit card issued by AmBank / AmBank Islamic and debit card issued by AmBank respectively ( Card ). In the event of any discrepancy or inconsistency between these Terms and Conditions and the Cardmember Agreement, the Terms and Conditions shall prevail in so far as it relates to the Campaign. Definition Except where the context otherwise requires, or unless these Terms and Conditions otherwise provide, all words, names and expressions defined in the Cardmember Agreement when used or referred to in these Terms and Conditions shall have the same meaning as that provided in the Cardmember Agreement. Eligible Cardmembers means the Customers of the Bank who have applied and have been issued a Principal Card and/or Supplementary Card and/or Debit Card during the Campaign Period as herein described, and are entitled to participate on an independent basis with the exception of: a. Cardmembers of Prepaid Card(s), Corporate Card(s), Commercial Card(s), and Insurance Card(s) issued by The Bank; and/or b. Cardmembers whose Card accounts have been suspended, cancelled or terminated for whatsoever reasons during the Campaign Period or during the fulfilment of the Cash Back and Prizes. The following group of persons shall be eligible to participate in the Daily Cash Back portion of the Campaign but will not be eligible to win any of the Monthly or Grand Prizes: a. permanent, contract and/or temporary staff or employees of AmBank and Chevron Malaysia Limited (992309-U) (including its affiliated and related companies) and their immediate family members (children, parents, brothers and sisters, including spouses); and b. employees of Caltex service station operators / retailers / marketers and staff and their immediate family members (children, parents, brothers and sisters, including spouses). Bank s Card(s) means the Credit Card of AmBank (M) Berhad ( AmBank ) / AmBank Islamic Berhad ( AmBank Islamic ) and Debit Card of AmBank (M) Berhad (including TRUE by AmBank Debit MasterCard). The Campaign means Fill, Swipe & Win Campaign organized by The Bank in accordance with the Terms and Conditions as herein stipulated. Words denoting person shall include living persons and, if and where applicable, body or persons incorporated or unincorporated. Words importing the singular shall also include the plural and viceversa. Words importing the masculine gender shall include the feminine and neuter gender. Campaign Period 1. The Campaign commences on 1 June 2016 and ends on 30 September 2016 ( Campaign Period ), both dates inclusive or such other period(s) as may be determined at the sole and absolute discretion of the Bank with at least 21 calendar days prior notice. Registration Criteria 2. To participate in this Campaign, Eligible Cardmember must register via a one-time short message service ( SMS ) during the Campaign Period as follows: G1<space>Y1 or Y2 or Y3 or Y4 or Y5 or Y6<space> 12-digit NRIC Number to 66399 Example: G1 Y1 880818101234 (SMS submission is not upper or lower case sensitive) Note: Y1 / Y2 / Y3 / Y4 / Y5 / Y6 is for the Bank s internal tracking. Eligible Cardmembers only need to register with either one (1) code as all codes are valid. 3. Eligible telecommunication service providers for SMS registration: Maxis, Celcom, DiGi, and UMobile only. Standard telecommunication charges levied by the respective telecommunication service providers will apply for each registration SMS sent. Registration in any other format will be automatically disqualified and any dispute with regards to the disqualification shall not be entertained by the Bank. 4. Eligible Cardmembers are responsible to ensure the accuracy of registration details and contact information maintained in the Bank s system is updated and complete. 5. Upon successful registration, there will be an acknowledgement SMS sent from the Bank to the Eligible Cardmember to the mobile number used for the registration. Proof of SMS sent by a Cardmember does not denote proof that the SMS is received by the Bank. 6. To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the Bank will not be held responsible and reserves the absolute discretion to disqualify any registration due to reason(s) including, but not limited to, incomplete/ inaccurate SMS registration details provided which are not similar to records saved in the Bank s system, late entries, error message, unsuccessful registration due to network failure and/or interruption experienced by telecommunication service providers or for any reason whatsoever as the Bank may in its absolute discretion deem fit. 7. In the event the Cardmember does not receive the SMS confirmation due to the invalidity, inaccessibility or system failure of the mobile phone number including, but not limited to, the Bank s or third party system, any electronic, mechanical, system failure or corruption, computer viruses, bugs or related problems, operating system malfunction, telecommunication network or internet failure, power breakdown or other delivery breakdown, the Cardmember should call the Customer Service number set out in Clause 35 for assistance. 8. To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the Bank is not responsible for nor does the Bank have any control whatsoever on the SMS traffic, network failure and/or interruptions on the part of the respective telecommunication service provider or the Bank s SMS vendor or for any other reason(s) whatsoever during the process of registration SMS sent to 66399 or confirmation SMS sent from 66399 to Eligible Cardmembers which may result in the delay of the SMS registration during the Campaign Period. Campaign Participation and Eligibility 9. 10. Tracking of the Eligible Cardmember s spending shall commence from the Campaign Month (as set out in Clause 9) in which the SMS registration is acknowledged by the Bank until the end of the Campaign. Example Successful SMS Registration Date Qualifying Campaign Month Cardmember 1 1 June 2016 Months 1, 2, 3 and 4 Cardmember 2 15 July 2016 Months 2, 3 and 4 Cardmember 3 15 August 2016 Months 3 and 4 Cardmember 4 30 September 2016 Month 4 only Daily Cash Back 11. Eligible Cardmembers are required to use their Card to perform a minimum retail transaction of RM50 in a single receipt at Caltex outlets located within Malaysia as recorded in the Bank s system ( Daily Eligible Transaction ) to earn one (1) ( Entry ). Entries will be assigned based on transaction time stamp as recorded in the Bank s system date and time. 12. Every 6 th Entry and its multiples (for example: 12 th, 18 th, 24 th and 30 th Entries) of each day throughout the Campaign Period shall also receive 10% Cash Back on its transaction amount on a first-come, first-served basis, subject to availability of the daily cash back allocation of RM1,000 (RM800 is allocated for Credit Cards and RM200 is allocated for Debit Cards) as outlined below: Monthly Cash Back Allocation Credit Cards Debit Cards Total Month 1 RM24,000 RM6,000 RM30,000 Month 2 RM24,800 RM6,200 RM31,000 Month 3 RM24,800 RM6,200 RM31,000 Month 4 RM24,000 RM6,000 RM30,000 Total Cash Back Allocation RM97,600 RM24,400 RM122,000 13. The balance from the daily cash back allocation for the respective day that is not utilized (if any) will be brought forward to the next day. The balance from the monthly cash back allocation for the respective month that is not utilized (if any) will be brought forward to the next month. 14. Each Eligible Cardmember is only entitled to a maximum cash back of RM30 for Credit Cards and RM30 for Debit Cards for each Campaign Month as outlined in Clause 9 above. Monthly Prizes and Grand Prize 15. Eligible Cardmembers who meet the following minimum cumulative monthly spend at Caltex outlets as recorded in the Bank s system ( Cumulative Eligible Transaction ) will receive the following additional Entries: Minimum Cumulative Monthly Spend at Caltex outlets RM200 25 RM400 50 Additional Entries (applicable for Monthly Prizes and Grand Prize) 16. Winners of Monthly Prize and Grand Prize will be selected as outlined below: Prize Cash Prize Winner Selection Monthly Prizes 4x RM5,000 Highest number of Entries during the Campaign Month Grand Prize 1x RM50,000 Highest number of Entries throughout the Campaign Period 17. In the event of a tie, winner will be determined based on their highest cumulative spend at Caltex outlets during the Campaign Month (for Monthly Prize) or throughout Campaign Period (for Grand Prize) followed by the earliest transaction time stamp of their last Entry for the Campaign Month (for Monthly Prize) or Campaign Period (for Grand Prize). 18. Eligible Cardmember is entitled to win only one (1) Prize throughout the Campaign Period. In the event that an Eligible Cardmember is selected as the winner of both a Monthly Prize and the Grand Prize, the Eligible Cardmember will only win the Grand Prize and the Monthly Prize will be awarded to the next Eligible Cardmember. In the event that an Eligible Cardmember is selected as the winner of more than one (1) Monthly Prize, the Eligible Cardmember will only win the first Monthly Prize and the other Monthly Prize(s) will be awarded to the next Eligible Cardmember(s). 19. Retail transactions mean MasterCard/Visa transactions for purchase of goods and services incurred for personal consumption. Transactions excluded are all Eligible Transactions which are subsequently cancelled or refunded, disputed, unauthorised or fraudulent transactions, or transactions which are under special corporate arrangement where rebate is applicable. 20. All Eligible Transactions must be posted to the Eligible Cardmember s Card account within the Campaign Period based on the Bank s system date and time to be eligible for the Cash Back and allocation of Entries. The Bank will allow five (5) calendar days for the Eligible Transactions made to be posted into the Eligible Cardmember s Card account. The Bank is not responsible in any manner whatsoever for any late posting to Eligible Cardmember s account by merchants and/or third party which may result in the Cardmember s transaction being omitted from the Campaign. 21. To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the Bank shall have the right at its absolute discretion to vary / revise / amend the selection mechanism / process as it deems fit at any time with at least 21 calendar days prior notice. Cash Back and Notification of Prize Winners 22. The Cash Back will be credited within 10 weeks after each Campaign Month and will be reflected in the following month s Card statement. Monthly and Grand Prizes will be fulfilled within 10 weeks after the end of the Campaign Period. 23. The Bank will notify all Prize winners via SMS/telephone/electronic direct mailer/direct mailer through their contact information maintained in the Bank s system. Notwithstanding the foregoing, the Bank reserves the right to use any other method or medium the Bank deems fit at its sole and absolute discretion for the purpose of announcing the winners. 24. All Prize winners shall be required to attend the prize presentation ceremony and/or other publicity Campaigns as and when required at their own costs and expenses. If any Prize winners fail to attend such ceremony and/or other publicity Campaigns without valid reason, the Bank reserves the right to forfeit their Prize and select another Prize winner. Disqualification 25. The Bank reserves the absolute right to disqualify participation of Eligible Cardmembers for the purpose of this Campaign without having to notify or alert the Cardmember based on the following:- a. All Entries received before and after the stipulated Campaign Period. b. Inaccurate or incomplete registration details. c. The Eligible Cardmember s Card account shall not be in default of facilities granted at any time during the Campaign Period, subject to the Bank s discretion; and/or holder(s) of the Bank s Card(s) whose accounts have been closed before the notification of the winners. Liability 26. To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the eligibility of the Cardmembers for the Cash Back and Prizes is final and no correspondence disputing the Bank s decision shall be entertained. 27. To the extent permitted by law and the Bank not being in breach of this Campaign or is negligent, the Cardmember will indemnify the Bank for any loss or damage, costs and expenses, fees and charges which the Bank may incur due to breach by the Cardmember of any terms and conditions of this Campaign including the enforcement of such terms and conditions against the Cardmember. 28. By participating in the Campaign and only for the purpose of this Campaign, Cardmembers consent for the Bank to disclose their particulars only to the extent necessary to the Bank s service providers for the purposes of running this Campaign. Language 29. In the event of any discrepancy or conflict in the interpretation of these Terms and Conditions, the English and Bahasa Malaysia versions of each of these Terms and Conditions shall be construed as equivalent and each of the Terms and Conditions stipulated shall carry the same meaning. Adherence to the Campaign Terms & Conditions 30. By participating in this Campaign, the Prize winners hereby consent to and agree that the Bank shall be at liberty to publish or display materials and/or information, including but not limited to their names and photographs without compensation for advertising and publicity purposes in any manner the Bank deems appropriate. Non compliance may result in an alternative Prize winner being chosen. 31. All Cardmembers shall be required to adhere to the Campaign Terms and Conditions. The Bank reserves the right to forfeit the Cash Back and the Prizes in the event any of the Terms and Conditions are not adhered to. 32. All Terms and Conditions stipulated herein are governed by and construed in accordance to the laws of Malaysia and any legal disputes shall be commenced and heard in courts in Kuala Lumpur. 33. The Cardmember has read and understood all the Terms and Conditions specified herein and the Bank may change, amend and/or modify any of the Terms and Conditions stipulated herein from time to time and any changes will be announced with at least 21 calendar days prior notice on the Bank s website at www.ambank.com.my 34. The Bank s decision on all matters relating to the Campaign is final. 35.
