Mainstreaming of Horizontal Principles: art. 7-8 CPR Peter Berkowitz ESIF SD - 17 November 2015

Regulation 1303/2013 Common Provisions Regulation for ESI Funds Article 7 Promotion of equality between men and women and non- discrimination Member States and the Commission throughout the lifecycle of all programmes. Concerns discrimination based on sex, racial or ethnic origin, religion or belief, disability, age or sexual orientation

Regulation 1303/2013 Common Provisions Regulation for ESI Funds Article 8 Sustainable development Programmes must comply with environmental protection requirements, resource efficiency, climate change mitigation and adaptation, biodiversity, disaster resilience, and risk prevention and management Polluter pays principle applies Uniform conditions for each of the ESI Funds, adopted by the Commission (delegated act).

Integration of the new horizontal provisions in the ESI Funds' programming phase Study on the use of new provisions (ongoing) Scope: PAs and programmes financed by the ERDF and the CF, including multi-fund programmes involving the ESF and ETC programmes (Art. 15.1(a)(v) and 96.7 CPR; Art. 8.7 ETC Regulation) Internal analyses on the implementation of ex ante conditionalities (ongoing) Scope: PAs and all cohesion policy Funds 312 programmes (Art. 19 and Annex XI CPR) Final Report January 2016 all conclusions are preliminary at this stage! 4

Study- new provisions How Member States and regions plan to ensure: the promotion of equality between men and women and non-discrimination including accessibility the promotion of sustainable development the "mainstreaming" of horizontal policy objectives identified as relevant for one or more programmes and one or more ESI Funds. What were the process and the challenges faced when programming those arrangements?

Selection of horizontal priorities

Selection of priorities Trends Findings at PA and programme level are generally consistent No differences between groups of MS (EU 15 vs. EU 13) or types of programmes (ETC vs. OPs) "Sustainability" more frequently in outermost regions OPs as well as OPs with "combination priority axes"

Non-discrimination: Target Groups

Target Groups Trends Minorities most often included in EU-13 OPs and PAs Women and young people more often included in ESF co-financed OPs and EU-15 Ops The unemployed are most often included in ETC OPs

Envisaged methods to address horizontal priorities

Envisaged methods to address horizontal priorities mainstreaming Horizontal principles were incorporated into the intervention logic of the programmes

Envisaged methods to address horizontal priorities specific actions Focus thematic objectives: Sustainable development Employment Fight against poverty and discrimination Focus investment priorities: Gender equality Energy efficiency in enterprises Renewables

Evolutions compared to the previous programming period Based on perception of survey respondents: About half of the survey respondents saw improvements The most substantial improvements concern the environmental principles (including climate change) The vast majority of MS plan to strengthen horizontal principles throughout the programme cycle.

Ex-ante conditionalities Several ex ante conditionalities (ExAC) contribute to the promotion on horizontal principles: Art. 7 principles : Gen ExAC 1 (Antidiscrimination), Gen ExAC 2 (Gender), Gen ExAC 3 (Disability) Art. 8 principles: Gen ExAC 6 (Environmental legislation)

ExAC contribution to Art. 7 Principles Gen ExAC 1 (Anti-discrimination), 2 (Gender), 3 (Disability) Applicable in all Member States A rather high level of fulfillment in comparison to other Gen ExAC: 18 MS entirely fulfilled all 3 Gen ExAC The need for action plans in 10 MS (EE, EL, HR, HU, LV, PL, RO, and SK at national level, and in IT and UK at regional level)

ExAC contribution to Art. 8 Principles Gen ExAC 6 (Environmental legislation) Applies in all Member States The Gen ExAC with the highest degree of fulfillment: 19 MS entirely fulfilled Gen ExAC 6 The need for action plans in 9 MS (CY, CZ, HR, IT, LT, RO, SI, SK at national level and DE at regional level)

THANK YOU!
