Northwestern Cottages Fence Installation Project Gainesville, Georgia 30501 PURPOSE: The City of Gainesville will accept quotes from all interested companies for fence installation at the Northwestern Cottages single-family housing project. The City seeks qualified companies to provide material and labor cost for the installation of a 5 wide x 6 tall, pre-finished, black aluminum fence system along the property line, adjacent to Martin Luther King, Jr. Boulevard. Fencing installation will include all four homes: 940 Mill Street, 946 Mill Street, 952 Mill Street, and 958 Mill Street, in order to detour foot traffic away from the family homes, and encouraging pedestrians to utilize the existing pedestrian foot traffic trial. The project will involve supplying all materials and labor of approximately 700 linear feet of black aluminum fencing. The purpose of the project is to create a safe living environment for the local residence. The company will provide the following services: 1. Fence Installation a. All materials and supplies required to complete turn-key project b. Install new pre-finished black aluminum fence c. Fencing specifications are attached d. All installation not covered in the attached specifications should meet industry standards. 2. Permitting and Coordination a. Coordination with any utility companies (power, gas, and water) 811 Call Before You Dig. b. Obtain required permits from the City of Gainesville Community Development Department located at: 311 Henry Ward Way, 2 nd Floor, Gainesville, GA 30501. Phone: 770-531-6570 All plans, specifications, drawings, and work must meet City of Gainesville codes for fencing as approved by the Community Development Director (Section 9-9-5-15). A plat of the Northwestern Cottages site is attached. GENERAL SPECIFICATIONS: Materials shall be new, in good condition, and of standard grade unless otherwise specified in the work-write-up. Contractors are expected to be familiar with, and comply with, all applicable codes, written rehabilitation standards, project specifications, and ordinances currently adopted by the City of Gainesville. In the event a conflict is determined to exist between the General Specifications for the project and the City of Gainesville s adopted codes, the stricter shall apply. Contractor is responsible for any damage to the existing irrigation system, landscaping, or sod. Replacement for said damages shall be included in the cost for the project. All materials, salvageable or otherwise, including rubbish, must be removed from the premises. Project site area must be left clean. The Contractor Is Responsible For Verification of All Quantities. The contractor is cautioned to verify site conditions and quantities prior to submitting a price quote. Project change orders will not be approved due to items missed by contractor. SELECTION PROCESS: All submittals will be received by the City. The City will base its selection on the following criteria: Cost Experience and capability to provide fencing services Quality and comprehensiveness of the quote. Page 2 of 5
WAIVER OF TECHNICALITIES All items must meet or exceed specifications as stated by the City of Gainesville. The City of Gainesville reserves the right to waive any technicalities and to reject or accept any quote in its entirety or to accept any portion thereof if it is determined that either method results in lower costs, better service, final satisfaction or is otherwise determined to be in the best interest of the City of Gainesville. Award may be made by item number or in total. Determination of best response to a quote will be the sole judgment of the City of Gainesville. Quotation shall remain valid for ninety days from the date of submittal. REJECTION The City of Gainesville reserves the right to reject any or all quotes at any time without penalty. INVOICING: The City shall pay the Contractor for the faithful performance of the work as specified herein. Payment for the work/services under this Contract shall be made in accordance with the provisions of this Contract. The City shall pay the contractor upon satisfactory completion of the work. The payment shall be a single payment when work is satisfactorily-completed and accepted by the City of Gainesville by way of a Certificate of Completion. The work to be performed under this contract is subject to the requirements of Section 3 of the Housing and Urban Development Act of 1968, as amended, 12 U.S.C. 170lu (section 3). The purpose of section 3 is to ensure that employment and other economic opportunities generated by HUD assistance or HUD- assisted projects covered by section 3, shall, to the greatest extent feasible, be directed to low- and very low-income persons, particularly persons who are recipients of HUD assistance for housing. B. The parties to this contract agree to comply with HUD's regulations in 24 CFR part 135, which implement Section 3. As evidenced by their execution of this contract, the parties to this contract certify that they are under no contractual or other impediment that would prevent them from complying with the part 135 regulations. C. The contractor agrees to send to each labor organization or representative of workers with which the contractor has a collective bargaining agreement or other understanding, if any, a notice advising the labor organization or workers' representative of the contractor's commitments under this section 3 clause, and will post copies of the notice in conspicuous places at the work site where both employees and applicants for training and employment positions can see the notice. The notice shall describe the section 3 preference, shall set forth minimum number and job titles subject to hire, availability of apprenticeship and training positions, the qualifications for each; and the name and location of the person(s) taking applications for each of the positions; and the anticipated date the work shall begin. D. The contractor agrees to include this Section 3 clause in every subcontract subject to compliance with regulations in 24 CFR part 135, and agrees to take appropriate action, as provided in an applicable provision of the subcontract or in this section 3 clause, upon a finding that the subcontractor is in violation of the regulations in 24 CFR part 135. The contractor will not subcontract with any subcontractor where the contractor has notice or knowledge that the subcontractor has been found in violation of the regulations in 24 CFR part 135. E. The contractor will certify that any vacant employment positions, including training positions, that are filled (1) after the contractor is selected but before the contract is executed, and (2) with persons other than those to whom the regulations of 24 CFR part 135 require employment opportunities to be directed, were not filled to circumvent the contractor's obligations under 24 CFR part 135. F. Noncompliance with HUD's regulations in 24 CFR part 135 may result in sanctions, termination of this contract for default, and debarment or suspension from future HUD assisted contracts. G. With respect to work performed in connection with section 3 covered Indian housing assistance, section 7(b) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450e) also applies to the work to be performed under this contract. Section 7(b) requires that to the greatest extent feasible (i) preference and opportunities for training and employment shall be given to Indians, and (ii) preference in the award of contracts and subcontracts shall be given to Indian organizations and Indian-owned Economic Enterprises. Obtain all permits determined to be necessary by the local government permit office. 3. Coordinate with utility companies (811 Call Before You Dig). 4. Acquire a sufficient amount of dumpsters in order to hold the materials removed during construction. 5. Maintain Worker s Compensation/General Liability Insurance as required by the City. 6. Contractor shall supply all labor, material, and equipment to complete this project. 7. Contractor shall post safety signs, barricades, and erosion control as required to ensure safety and environmental compliance per the Unified Land Development Code City of Gainesville, Georgia (Chapter 9-14-3). 02 Fence: 1. Supply and install COMPLETE turn-key black, pre-finished aluminum fencing (see attached photo). To include all posts, balusters, screws, bolts, post caps, guide wire/anchor support (if applicable), brackets, and concrete. *If specified items cannot be supplied, please provide alternate fencing information as indicated on the response form. 2. All fencing shall be 5 wide x 6 tall black pre-finished aluminum panels. 3. Support post shall be 2 x 2 square x 8 in length with a standard cap. 4.
