Should an end date be set for this Agreement, IEH will provide you with a minimum of thirty (30) days written notice, informing you of the date upon which this Agreement ends. If you do not enter into a new fixed price agreement with IEH, or you do not take action to switch to another supplier or move back to default service with your LDC, your fixed rate will become a month to month variable price product. 7. Cancellation Provisions. You may cancel your service under this Agreement at any time. If you cancel during the initial period and after the seven day rescission period, you may be charged an early cancellation fee, as set forth in the Product Summary. Cancellation is effective on the next meter read date that occurs after your LDC has switched your account from IEH. To cancel this Agreement, please contact IEH by phone, email, or mail at the contact information contained in this Agreement. If your LDC terminates your service, this Agreement will be automatically cancelled. IEH may cancel this Agreement if: i) you fail to make timely payment of IEH charges; or ii) if at some future date there is a change in any law, regulation, market rule, or tariff that materially impairs IEH's ability to fulfill its obligations under this Agreement. We will follow applicable rules in providing notice to you if we intend to cancel this Agreement for either of the reasons specified in (i) or (ii) above, and will provide a minimum of thirty (30) days written notice to you. IEH reserves the right to cancel this Agreement, in whole or with respect to any particular account(s) covered by this Agreement, at any time for any reason and we will follow applicable rules in providing you notice of this intent. Cancellation is effective upon the date as deemed effective by the LDC, after any applicable notice period, and you will be responsible for unpaid balances as of the cancellation date, until your account is paid in full, and we will not assess a cancellation fee if IEH cancels this Agreement. https://prod-garcon.herokuapp.com/api/1/terms/dd7c3062 2/5

8. Residential Customer Rights. If you are a residential customer, you may terminate this Agreement with forty eight (48) hours notice, without penalty, as a result of relocation within or outside the LDC s service territory, disability that renders you unable to pay for IEH s services, or death. No termination or cancellation fee will be assessed against you for any of these reasons. Cancellation of Existing Service You are responsible for canceling any agreements with other electric suppliers from whom you are purchasing electric service as of the date of this Agreement. Switching to a competitive third party electricity supplier is not mandatory, and you have the option of remaining with your LDC for basic generation service. 9. Environmental Disclosure/Electricity Facts. Typical grid power in your region is produced mostly from dirty fuels like coal, oil, and gas. IEH ensures that electricity equal to 100% of your electricity usage is produced by wind power generation facilities located in the United States. Electricity is the product of a mix of generation energy sources that is delivered over a system of wires. You will not have electricity from a specific generation facility delivered directly to your service address, but IEH ensures that the applicable percentage of your electricity usage is offset by the generation of energy from renewable resources on an annual basis. IEH does so by purchasing and retiring renewable energy attributes or renewable energy certificates representing the environmental attributes associated with the applicable amount of renewable energy generation from the renewable sources specified for your product. Your purchase helps support the development and operation of renewable energy in the areas specified for your product. IEH may take up to three months following the close of a calendar year to make up any deficiency in the renewable resource content for this product. Information on generation energy sources for your product, energy efficiency, environmental impacts or historical billing data is available upon request. 10. Penalties or Fees. There are no customer service charges or set up fees, though you may be charged a cancellation fee, as set forth in the Product Summary, if you cancel this Agreement after the seven day rescission period and before the expiration of the initial period. 11. Special Terms and Conditions: Rewards Program. Please refer to your welcome confirmation letter or email regarding your rewards program, if applicable. If you cancel this Agreement prior to the end of your second billing cycle, you may forfeit some or all of the rewards described in your welcome confirmation. 12. Renewal Provision/Agreement Expiration. This agreement will remain in effect, and Inspire will continue to supply your electricity, until cancelled by either you or Inspire. If you enter into a fixed term Agreement with us and it is approaching the expiration date, we will send you a renewal notice thirty (30) days prior to expiration of the initial term, at which point we will continue to serve you on a month to month term under current contract terms and price, unless you opt in to the new terms. 13. Billing and Payment. You will receive one consolidated bill from your LDC each billing cycle for the electric service provided by IEH and the transmission, distribution and other services provided by your LDC, plus all applicable taxes. You agree to remit payment for all of these services directly to your LDC in accordance with the payment terms stated in your LDC's tariffs. Failure to make payment for one hundred and twenty (120) days may result in separate bills from your LDC and IEH. In the event that IEH must separately bill you, late payment fees of 1.33% may begin to accrue upon balances being more than five (5) days past due. IEH's failure to charge late fees when due shall not be construed as a waiver of IEH's right to collect such late fees. Failure to make full payment may be grounds for disconnection of utility services. A $20 fee per account may be assessed for any payment returned due to insufficient funds. If any payments made by you directly to us are rejected two times in a one year period, the only form of payment acceptable will be a certified check, money order or electronic funds transfer. If you make a payment for a lesser amount, which includes a statement or letter indicating that the lesser payment constitutes full payment, we may accept such payment without prejudice to any other rights or remedies that we may have against you and we may apply it to your account(s) as a partial payment. Customer agrees to timely review its invoice and agrees that subject to applicable tariff and law, unless notice is given to IEH within ninety (90) days of the invoice date, all invoiced amounts shall be deemed to be correct and Customer shall waive any right to dispute amounts set forth on such invoice. 14. Title and Taxes. Title to, control of, and risk of loss of the electricity sold under this Agreement will pass from IEH to Customer when it is delivered to Customer s LDC. Each party will indemnify and hold the other party harmless from any and all claims (including claims for personal injury, death, or property damage), losses, fees, taxes, damages, suits, causes of actions and judgments of any kind arising hereunder while title and risk of loss are vested in the indemnifying party. You will be responsible for the payment of all transfer, sales or other taxes related to IEH's service under this Agreement. If you are exempt from any such taxes, you are responsible for identifying and requesting such exemption from the collection of taxes by filing appropriate documentation with IEH and/or your LDC, as applicable. 15. Contact Information/Customer Complaints. If you have a question about your bill or service, you may contact IEH (see IEH Contact Information below). If you are not satisfied with the response from IEH s Customer Care representative, you may ask that your questions be referred to an IEH supervisor, who will respond promptly. If you remain unsatisfied with our attempts to resolve the issue, you may seek assistance from the BPU or request information from the BPU regarding your consumer protection rights. The BPU's contact information is listed below. 16. Power Outages and Emergencies. The Parties agree to the extent permitted by law that the statute of limitations with respect to all claims arising out of or related to this Agreement shall be reduced to the lesser of (x) two years from the event giving rise to the claim or (y) the minimum period permitted by law and any action not brought within such time period shall be barred without regard to any other limitations period. You may rescind these authorizations and restrict the release of your information by contacting us by phone at 1.866.403.2620. IEH reserves the right, to the extent permitted by law, to reject your enrollment or terminate this contract and cancel your service in accordance with this contract in the event these authorizations are rescinded. 26. If there is a future change in any applicable law, rule, regulation, order, filed tariffs, market rules or pricing structure, or in charges or new charges, imposed by your LDC, PJM, the BPU or any governmental agency, whereby IEH incurs additional charges or costs as a result of such changes, then IEH will have the right in its sole discretion to (i) propose to adjust your price to reflect such additional charges or costs to IEH by giving two advance written notices in separate mailing between 45 and 90 days before the proposed effective date, and (ii) if you do not accept such proposed price change, cancel this Agreement by giving notice to you as required under applicable law. 27. At the conclusion of the relevant duration required for the Rewards to accrue, unless the Reward is a one time Reward (e.g. an initial enrollment Reward) the next accrual duration will commence for another period of the same duration, subject to the same terms and conditions. c. Redemption. Within sixty (60) days after the conclusion of the relevant Rewards accrual period, as set forth in the Welcome Confirmation, Inspire will calculate the amount of the Rewards and send notice to the Customer that such Rewards are available for redemption. Such notice may be sent by email, where applicable. The manner and means by which such Rewards are conveyed to the Customer, once redeemed by the Customer, are at the sole discretion of Inspire. Once the Rewards are redeemed, it may take several weeks for the Rewards to be processed and delivered to the physical or email address provided to Inspire by Customer. d. Limitations. Rewards may not be applied as a credit or offset to reduce the amount owed by a Customer to Inspire or the Customer s Atlantic City Electric. The Rewards shall have no cash value until the relevant accrual period is complete and the Rewards are redeemed by the Customer. The Customer shall have no property rights or other legal interest in the Rewards until the Rewards are redeemed and received by Customer. The Customer may not assign, transfer or pledge Rewards. Inspire reserves the right, in its sole discretion, to determine whether a particular Customer has met all requirements to be eligible for a particular Reward. Any tax liability relating to Rewards is the sole responsibility of the Customer. Inspire shall not be responsible for resolving any conflicting claims to any Rewards. Inspire is not responsible for any lost or stolen Rewards. In the event that all or part of any Rewards program is found to be in violation of applicable law, Inspire shall have no obligation to provide any Rewards to Customer found to be in violation of that applicable law. The Rewards program is subject to the Agreement between Inspire and the Customer, including, but not limited to, all terms related to dispute resolution. The Agreement is hereby incorporated by reference into these terms and conditions. For the avoidance of doubt, Inspire and the Customer agree that the Limitation of Liability provision of the Agreement shall apply to these terms and conditions. e. Customer Information. Inspire may provide some Customer information to a third party vendor for administering some or all Rewards programs. Customers may opt out of Inspire providing information to a third party by calling Inspire at 1 866 403 2620. Should you opt out, Inspire does not guarantee another means of Rewards fulfillment. f. Modification. These terms and conditions governing Rewards programs may be modified by Inspire in its sole discretion, provided that Inspire provides any notice to the Customer as required by applicable law. dd7c3062 https://prod-garcon.herokuapp.com/api/1/terms/dd7c3062 5/5
