ELIGIBILITY: Open only to legal residents of the fifty (50) United States (including the District of Columbia) (collectively U.S. ) who currently reside in the U.S., are at least eighteen (18) years old at time of entry (or the legal age of majority in their state of legal residence, whichever is older) and who have a valid, current U.S. driver s license. Box 809004, Houston, Texas 77280-9921. All mail in entries must be postmarked by March 26, 2014 and received by April 4, 2014. Entry requires entrants to submit the following personal information at the time of Entry and/or the time of the Prize verification, depending on the entry method selected: name, address, date of birth, email address, and daytime phone number. Sponsor cannot guarantee this Sweepstakes will be available via all wireless carriers. The QR code portion of the Sweepstakes Entry will be available on participating wireless carriers only. To scan a QR Code, your smart phone must have a QR Code reader application installed in your mobile device. and such entrant will be disqualified. In the event of a dispute as to the identity of a participant in the Sweepstakes, the Entry will be deemed completed by the authorized account holder of the email address, or mobile phone cellular number used to enter the Sweepstakes. Potential winner may be required to show proof of being the authorized account holder. The authorized account holder is the natural person assigned to an email address by an Internet service provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address; or if entry is by QR code or mobile URL, the natural person assigned to the cellular phone number by the cellular phone service provider. All Entries will be deemed to have been made by the authorized account holder. PRIZE DRAWING: On or about April 10, 2014, Sponsor (or its authorized representative) will randomly select one (1) Prize winner from among all eligible Entries received. The potential Prize winner will be contacted via telephone or email (in Sponsor s discretion) in order to notify him/her that he/she has been selected as a potential winner and to verify eligibility. 4. PRIZE, ODDS OF WINNING: A. One (1) PRIZE: A 3-day, 2-night Quaker State 400 VIP Racing experience in Sparta, Kentucky on June 27, 28 & 29, 2014 for winner and one (1) guest. Trip package consists of: roundtrip, coach class air transportation from a major U.S. gateway airport near winner s residence to a major U.S. gateway airport near Sparta, Kentucky; two (2) night s standard hotel accommodations (single room, double occupancy; hotel room tax included); VIP Race Day Experience on Saturday, June 28 th including Hospitality, VIP access and seating on race day, June 28 th, along with $400 total spending money for the winner. Total Approximate Retail Value ( ARV ) of the Prize: $3,950. Winner agrees to release, defend and hold harmless the Promotion Entities from and against any and all claims, actions, responsibilities, damages, costs and liabilities arising at any time relating thereto. D. The winner may waive the right to receive the Prize. Prize winner must be able to accept the Prize in its entirety or not at all. notification is ignored, returned as unclaimed or undeliverable, or not timely responded to, for whatever reason, the Prize will be forfeited, and an alternate winner will be selected. No assignment, transfer, or substitution of the Prize, in whole or in part, is permitted, except at Sponsor s sole discretion. Sponsor reserves the right to substitute a Prize of equal or greater value. All federal, state and local taxes, if any, on the Prize are winner s responsibility. Actual value of the Prize may vary from the amount set forth in these Official Rules. Winner will not receive the difference between the actual value and the ARV of the Prize. 5. CONDITIONS OF PARTICIPATION: Entries not legitimately submitted in accordance with these Official Rules are void. The potential winner will be subject to verification by Sponsor or its authorized representatives, whose decisions are final and binding. An entrant is not a winner of the Prize, unless and until said entrant s eligibility has been verified and said entrant has been notified that verification is complete and any documentation necessary for verification has been received and approved by Sponsor or its authorized representatives. Trip must be taken on dates specified by Sponsor. Travel must be roundtrip. Sponsor will determine airline, flight itinerary and hotel in its sole discretion. Winner and guest must travel together on the same itinerary, and guest must be 18 years of age or older (or of the legal age of majority in their state of residence, whichever is older) at the time of prize verification. If in the judgment of Sponsor, air travel is not required due to the proximity of winner s legal residence to the prize location, ground transportation will be substituted for round trip air transportation at Sponsor s sole discretion. All expenses and incidental travel costs not expressly stated in these Official Rules, including but not limited to meals, incidentals, airport fees, parking fees, personal charges at the hotel, etc., are the sole responsibility of the winner. Any upgrades, additional elements, or extras requested by winner are the sole cost and expense of the winner. Event and prize activities are subject to rain-check, modification and/or cancellation policies and procedures of organizers. Sponsor reserves the right to add, substitute, change or edit prize related elements and/or activities in its sole discretion. Lost, stolen, damaged or destroyed tickets will not be replaced. Prize winner and guest are responsible for all travel related documents and to obtain and maintain applicable insurance at their own cost and expense. In the event Prize winner and/or his or her guest engage in behavior that (as determined by Sponsor in its sole and absolute discretion) is obnoxious or threatening, illegal, or that is intended to annoy, abuse, intimidate, threaten or harass any other person, Sponsor reserves the right to terminate the trip or other applicable experience early, in whole or in part, and send winner and/or his or her guest home with no further compensation and any element of the Prize, if any, still remaining will be immediately forfeited. Prize winner will be required to sign, have notarized and return an Affidavit of Eligibility and Liability/Publicity Release (where legally permitted), within ten (10) business days following the date of notification. Failure to comply with this deadline will result in forfeiture of the Prize. Prize winner may be required to sign and return additional documents in order to receive the Prize. Prize winner s guest will be required to sign and return a Release of Liability/Publicity prior to tickets being issued. Acceptance of the Prize constitutes permission for Sponsor and its agencies to use winner s name, biographical information, opinions, voice, photograph and/or likeness for advertising and promotional purposes in any and all media now known or hereinafter developed throughout the world in perpetuity, without additional compensation, review, notification or permission, unless prohibited by law. Sponsor is not responsible for any typographical, human or other error in the printing of Sweepstakes and/or collateral advertising materials, administration of the Sweepstakes, processing of the Entries or in the
announcement of the Prize or in any other materials or information associated with the Sweepstakes. If, through printing or production error, or for any other reason whatsoever, more prizes are claimed for the Prize than intended and/or set forth in these Official Rules, Sponsor reserves the right to award the Prize by random drawing from all eligible claimants for the Prize. Only one Prize as set forth in these Official Rules will be awarded. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes, technological or otherwise, which corrupt, disrupt or otherwise affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend any and all aspects of the Sweepstakes, and Sponsor reserves the right, but not the obligation, to select the winner from eligible, non-suspect Entries received prior to the date of such action. Sponsor further reserves the right to disqualify any individual it suspects, in its sole and absolute discretion, to be tampering with the entry process or the operation of the Sweepstakes, to be cheating, or acting in a non-sportsmanlike or disruptive manner. INDEMNIFICATION: Winner agrees, by accepting the Prize, and each entrant agrees, by participating in this Sweepstakes, to release, discharge, indemnify and hold harmless Sponsor, and its parent company, subsidiaries, affiliates, distributors, retailers, web development companies, advertising and promotional agencies, participating Advance Auto Parts retailers (and their parents, subsidiaries and affiliates), Prize suppliers and any other companies participating in the design, administration or fulfillment of this Sweepstakes and their respective officers, directors, employees and agents (collectively Released Parties ) from and against any and all liability for any threatened or actual injuries, loss, costs, or damages of any kind to any person, including death or disability, and property, arising in whole or in part, directly or indirectly, from participation in this Sweepstakes or acceptance, possession, use, or misuse of the Prize, participation in any Sweepstakes-related activity or inability to participate in parts thereof including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, violation of the rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, and whether or not caused in whole or in part by the negligence of one or more of the Released Parties. Entrants covenant not to sue any Released Party or cause them to be sued regarding any matter released above; and further covenant not to disaffirm, limit or rescind this release. WITHOUT LIMITING THE FOREGOING, EXCEPT FOR ANY STANDARD WARRANTY THAT MAY BE PROVIDED BY THE MANUFACTURER OF A PRIZE TO THE WINNER, IF ANY, SPONSOR HAS NOT MADE, AND SPONSOR IS NOT RESPONSIBLE IN ANY MANNER FOR, ANY WARRANTIES, REPRESENTATIONS OR GUARANTEES, EXPRESS OR IMPLIED, IN FACT OR LAW, RELATING TO ANY PRIZE, INCLUDING BUT NOT LIMITED TO, THEIR QUALITY, MECHANICAL CONDITION, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON- INFRINGEMENT. INTERNET/WIRELESS SERVICES: Sponsor is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of Entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software, telephone or other communications, incompatibility, malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive information by Sponsor on account of technical problems, lost or unavailable network connections, telephone connections, wireless device connections or traffic congestion on the Internet or at any website or any combination thereof. 9. GOVERNING LAW; DISPUTES: By entering the Sweepstakes, each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or the Prize award shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court in Houston, Texas; and (ii) in addition to the limitations in Section 7 of these Official Rules, any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys fees.
