TERMS AND CONDITIONS CIMB Top Up Balance Programme (3%p.a Reward) 1. The CIMB Top Up Balance Programme (3% p.a. Reward) is jointly organized by both CIMB Bank Berhad (13491-P) ( CIMB Bank ) and ( CIMB Islamic ). CIMB Bank and CIMB Islamic shall herein collectively be referred to as ( CIMB ). Campaign Period 2. The CIMB Top Up Balance Programme (3% p.a. Reward) ( Campaign ) shall run from 20 July 2015 until a date which CIMB shall notify by giving prior notice ( Campaign Period ). 3. CIMB reserves the right to change and/or end the campaign duration by giving fourteen (14) calendar days prior notice. Eligibility 4. This Campaign is open to all existing primary accountholders who maintain Current Account and Savings Account ( CASA ) with CIMB Bank and/or maintain Current Account-i and Savings Account-i ( CASA-i ) with CIMB Islamic (excluding Flexi CA and Foreign Currency Current Account/-i) who received an invitation from CIMB to participate in this Campaign by way of telephone call from CIMB s Retail Telemarketing Centre ( RTC ) officer(s). 5. For the avoidance of doubt and subject to Clause 4, the following persons/entities shall NOT be eligible to participate in this Campaign: - i) Permanent, temporary and/or contract staff or employees of CIMB Bank/CIMB Islamic (including its subsidiaries and related companies); and/or ii) Representative and/or agents (including advertising and promotion agents) of CIMB; and/or iii) Sole-proprietorships, Partnerships, Charitable/Non-profit Organizations/Societies, Corporate and Commercial Customers; and/or iv) Individuals below the age of 18 years; and/or v) Non Malaysian; and/or vi) Current Account/-i and Savings Account/-i Accountholders with no valid mobile number in CIMB s record; and/or vii) Selected Current Account/-i and Savings Account/-i accountholders who have been offered to participate in other CIMB campaign(s) 6. In relation to Joint Participating Accounts, only the first named account holder i.e. the primary account holder shall be eligible to participate in the Campaign ( Primary Accountholder ) and only a Primary Account holder s incremental balances will be taken into consideration. A joint CIMB Top Up Balance Programme (Reward 3% p.a.)page 1 of 8

account holders incremental balance will not be taken in consideration. For the purpose of this Campaign, any other joint accountholder(s) who is not the Primary Accountholder will not be eligible to participate in this Campaign. (hereinafter referred to as the Eligible Participant(s) ). Campaign Mechanics 7. To participate in this Campaign, the Eligible Participant(s) must: i) Top up his/her CASA/CASA-i ( Participating Account(s) ) by a sum of not less than RM3,000 or the required amount which will be communicated through the phone call by RTC s officer to achieve the minimum incremental average balance ( Top Up Deposit ); AND ii) Maintain a minimum incremental average balance in his/her Participating Account(s) of not less than RM3,000 ( Incremental Average Balance (IAB) ) for a period of six (6) full consecutive calendar months commencing from the 1 st day of the month immediately following the month of the call made by RTC s officer ( Participating Period ); AND iii) Maintain all his/her Participating Account(s) with CIMB in good standing and without any breach of the relevant terms and conditions or agreements governing the Participating Account(s). 8. The following are frequently used terms in computing eligibility of Rewards and we have provided explanations on what they mean. i. Participating Account(s) This shall include CASA and/or CASA-i. For clarity, when calculating customer s IAB, the Participating account(s) balance includes both CASA and/or CASA-i of the Primary Accountholder. In the event that Eligible Participant(s) have multiple Participating Accounts, the Baseline and Average 6 MAB in the Participating Account(s) shall be aggregated to calculate the IAB throughout the Participating Period ii. MAB Monthly Average Balance. This is sum of daily balance of an account for a month divided with the number of day in the month. Example MAB Calculation: Day 1 + Day 2 + Day 3. + Day31 number of days in a month iii. Baseline This is the cumulative of all Participating Account(s) MAB on the month(s) prior to the call made by RTC officer. CIMB Top Up Balance Programme (Reward 3% p.a.)page 2 of 8

Example Baseline Calculation: (Account 1 MAB) + (Account 2 MAB) + (Account 3 MAB) + (Account MAB) iv. Average 6 MAB This is the cumulative of all Participating Account(s) for six (6) full consecutive calendar months account(s) average balance. Example Average 6 MAB Calculation: MAB 0 The month where the call was made by RTC s officer MAB 1 Participating period month 1 MAB 2 Participating period month 2 MAB 3 Participating period month 3 MAB 4 Participating period month 4 MAB 5 Participating period month 5 MAB 6 Participating period month 6 Average 6 MAB for any single Participating Account MAB0 + MAB1 + MAB2 + MAB3 + MAB4 + MAB5 + MAB6 6 If A customer has more than one Participating Accounts, the Average 6 MAB for all Participating Accounts are aggregated by adding up the Average 6 MAB for all Participating Accounts. v. IAB Incremental Average Balance. This is computed based on Eligible Participant s Average 6 MAB minus Baseline. Example Incremental Average Balance Calculation: IAB = Average 6 MAB Baseline 3% p.a. Reward vi. Reward Subject to the terms and conditions herein, the Eligible Participant(s) who fulfilled the requirements stated in Clause 7 shall be entitled to 3% per annum Reward on the IAB. The computation of the Reward is the IAB maintained at not less than RM3,000 multiplied by 3% per annum multiplied by the total number of days and divided by the number of days in a year. Example Reward Calculation: IAB (maintained at not less than RM3,000) X 3% per annum X Total number of days of the 6 consecutive months Number of days of the year 9. For clarity, below is an illustration of the calculations on the Reward that the Eligible Participant(s) may be entitled to earn: Scenario 1: RTC s officer calls Customer A in August 2018. Assuming customer A only has 1 Savings Account with CIMB and this customer A s baseline is RM500. If this customer agreed to top up a total amount of RM5,000 on September into his CIMB Savings Account, this customer A s eligibility for the Reward is calculated based on the manner set out below. Eligible Participant(s) can continue to deposit and withdraw from the Participating Account(s) as long as the customer has an Incremental Average Balance (IAB) of not less than RM3,000 and shall be eligible for the Reward. 11. Subject to the terms and conditions herein, the Reward shall be credited to the Eligible Participant s Participating Account with the highest balance within eight (8) to ten (10) weeks after the end of the Participating Period and CIMB s computation of the Eligible Participant s Incremental Average Balance (IAB). Eligible Participant(s) must not close his or her Participating Account(s) prior to the crediting of the Reward, otherwise they are deemed to have forfeited their Reward entitlement. 12. For the purpose of this Campaign, each Eligible Participant(s) shall be entitled to earn the Reward once only during the Participating Period. 13. An SMS notification will be sent to the Eligible Participant(s) mobile number maintained in CIMB s record after the Reward has been credited into their account. It shall be the Eligible Participant(s) sole responsibilities to ensure their mobile numbers are up to date in CIMB s record. 14. If the Eligible Participant(s) participate in several campaigns or promotions at the same time, the customer is only entitled to the Reward(s) under one of the participated campaigns or promotions. CIMB reserves the right to decide which campaigns or promotions is applicable to the relevant Eligible Participant(s). General Terms and Conditions 15. By participating in this Campaign, the Eligible Participants(s) are deemed to have read, understood and agree to be bound by the Terms and Conditions as well as consented to CIMB processing and disclosing their personal data in accordance with the CIMB Group Privacy Notice which can be found at www.cimbbank.com.my/ www.cimbislamic.com.my and the Eligible Participant(s) agree that all decisions fairly and reasonably made by CIMB in relation to every aspect of this Campaign, including the Reward and the determination of the Eligible Participant(s), shall be final, binding and conclusive. 16. The Eligible Participant(s) s Participating Account(s) (i) MUST be in good standing and MUST not be in breach of the terms and conditions governing the Participating Account(s); AND (ii) MUST be current and not be terminated or closed or be made subject to any attachment, adverse orders made by the Court or any authorities sanctioned by laws, delinquent, and/or be invalid or cancelled as determined by CIMB during the Campaign Period and/or at the time of processing the eligibility and/or before the Reward grant, otherwise the Eligible Participant(s) will be disqualified from participating in this Campaign and/or the Reward will be forfeited. 17. CIMB reserves the right at its sole discretion to disqualify any Eligible Participant(s) that it determines to be acting in breach or potential breach of these Terms and Conditions. 18. CIMB reserves the right to substitute the Reward with other item(s) of similar cost and/or to extend, shorten, discontinue, cancel, terminate or suspend this Campaign by giving fourteen (14) calendar days prior notice to the Eligible Participant(s). For the avoidance of doubt, any extension, shortening, discontinuance, cancellation, termination or suspension of this Campaign by CIMB shall not entitle any of the Eligible Participant(s) or any other persons whosoever to any claim or compensation against CIMB for any losses or damages suffered or incurred by the Eligible Participant(s) as a direct or indirect result of the act of extension, shortening, discontinuance, cancellation, termination or suspension of this Campaign. 19. By participating in this Campaign, the Eligible Participant(s) hereby agree that CIMB shall not in any manner whatsoever be liable or held responsible to the Eligible Participant(s) if CIMB is unable to perform in whole or in part of any of its obligations herein, attributable directly or indirectly to the failure of any mechanical or electronic device, data processing system, transmission line, electrical CIMB Top Up Balance Programme (Reward 3% p.a.)page 6 of 8

failure, industrial dispute, war, strike, riot, any act of God beyond CIMB's reasonable control or due to any factor in a nature of a force majeure which is beyond CIMB s reasonable control. 20. CIMB shall not be liable to any Eligible Participant(s) or any party for any loss or damage of whatsoever nature suffered (including but not limited to, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) howsoever arising, in relation to the participation or non-participation in this Campaign including arising from any non-receipt or delayed receipt by the Eligible Participant(s) of the Short Message Service ( SMS ) and email unless the same shall arise from and are caused directly by CIMB s gross negligence or wilful default. 21. CIMB reserves the right upon giving prior notice of twenty-one (21) calendar days to vary (whether by addition, deletion, modification, amendment or otherwise howsoever) ( Amendment ) any of the Terms and Conditions herein. Notification to the Eligible Participant(s) in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, via electronic communication display at CIMB s website at www.cimbbank.com.my/ www.cimbislamic.com.my / www.cimbclicks.com.my and CIMB s branches or CIMB s Currency Exchange counters where detail provisions regarding the Amendment may be provided in the notice itself or may be provided to the Eligible Participant(s) upon request; or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice or by any other means of notification which CIMB may select and the Amendment shall be deemed as binding on the Eligible Participants as from the date of notification of the Amendment or from such other date as may be specified by CIMB in the notification. The Eligible Participant(s) acknowledge and agree to access CIMB s website at regular intervals to view the terms and conditions of the Campaign and to ensure that they are kept up-to date with any changes or variations to these terms and conditions. 22. No compensation in cash or any kind shall be given to the Eligible Participant(s) for any losses or damages suffered or incurred by the Eligible Participant(s) as a direct or an indirect result of such Amendment of the Terms and Conditions herein. 23. These Terms and Conditions (as amended from time to time pursuant to Clause 21 above) shall prevail over any provisions or representations contained in any other promotional materials advertising this Campaign. These Terms and Conditions are to be read in conjunction with the prevailing terms and conditions governing the respective Participating Account(s) which shall apply in addition to the Terms and Conditions herein. 24. These Terms and Conditions shall be subject to the application of any prevailing laws, guidelines, directives, notices, regulations enacted and/or any other written laws or which are issued by Bank Negara Malaysia or any other body having supervisory authority over the CIMB in relation to or which are applicable to the Campaign or any matters herein. 25. If there is any inconsistency(ies), conflict(s), ambiguity(ies) or discrepancy(ies) between the Bahasa Malaysia and English version of these Terms and Conditions herein, the English version of these Terms and Conditions shall prevail. Notwithstanding the aforementioned, where a request had been made by the Eligible Participant(s) and such request was noted and acknowledged by CIMB in its records that these Bahasa Malaysia version of the terms and conditions shall govern the Eligible Participant(s) s Participating Account(s), then the Bahasa Malaysia version of these Terms and Conditions shall prevail. 26. CIMB has the right and is entitled to debit the Participating Account(s) or any other account of the Eligible Participant(s) maintained with CIMB at any time as it deems appropriate with the Reward received pursuant to these terms and conditions, the applicable or prevailing statutory fees, stamp duties, commissions, bank charges and/or service charges ( Indebtedness ) and pending the debiting of the Participating Account(s) or any other account of the Eligible Participant(s), CIMB has the right to withhold and or suspend payment of monies from the Participating Account(s) or any other account of the Eligible Participant(s) for the amount of the Indebtedness. 27. All terms and conditions governing the operation of the Eligible Participant(s) s Participating Account(s) shall continue to apply save and except if or where the same are expressly varied or amended by the terms and conditions herein and the terms and conditions governing the operation of this Campaign, these terms and conditions shall prevail for the purpose of this Campaign. 28. The decision of CIMB in relation to every aspect of the Campaign shall be final, binding and conclusive provided always that the decision must appear to be fair and reasonable. No further correspondence, appeals, protests or attempts to dispute the same would be entertained. 29. CIMB accepts no responsibility for any tax implications that may arise from the Reward or the use thereof. Any tax filing obligation or any tax payment due to any authority as a result of receipt of the Reward remains the sole responsibility of the Eligible Participant(s). It is the responsibility of each Eligible Participant(s) to seek independent advice on the possible implications this may have on his/her own financial situation. 30. By participating in the Campaign, the Eligible Participant(s) hereby consent to and agree that CIMB shall be entitled to publish and/or display at no costs to the Eligible Participant(s), materials and/or information, including but not limited to the names, identification number, city of residence and photographs of the Eligible Participant(s) who get the Reward for this Campaign for advertising and publicity purposes in any manner it deems appropriate. 31.
