2 THE REGIONAL HEALTH AUTHORITIES (AMENDMENT) BILL, 1999 Explanatory Note (These notes form no part of the Bill but are intended only to indicate its general purport) The purpose of the Bill is to amend the Regional Health Authorities Act in order to ensure that (a) Governrnent s existing policy on the payment of preserved superannuation benefits be maintained, so that a Pension Plan operated by a Regional Health Authority (RHA) would provide a level of pension which, when taken together with the preserved Government benefits would realise a total pension based on pensionable public service before and service after transfer to the RHA and on final salary earned in an RHA at retirement; (b) where a forrner public officer dies or retires in a nonpensionable RHA position before the establishment of a Pension Plan operated by a RHA and where such forrner public officer was in receipt of a higher salary than that at the time of his transfer, his superannuation benefits would be based on the higher salary and the difference in superannuation benefits due would be met by the RHA.

3 BILL A N A CT to incorporate the National Chutney Foundation of Trinidad and Tobago and matters incidental thereto. [, 1999] WHEREAS since the 16th day of October, 1994 there has been established in Trinidad and Tobago a Foundation known as National Chutney:

4 Enactment Short title Incorporation Aims and objectives ENACTED by the Parliament of Trinidad and Tobago as follows: 1. This Act may be cited as the National Chutney (Incorporated) Act, 1999. 2. The National Chutney Foundation (hereinafter called The Foundation ) is hereby created a body corporated. 3. The aims and objectives of the Foundation are to (i) to promote, enhance, research all aspects of the Chutney Artforms to advance its presentation to the World, through all available Media and Entertainment forms; (ii) to encourage amalgamation with any other Entertainment Body having objects similar either wholly or in part to those of this Foundation; (iii) to present, produce, manage, conduct and represent at any Theatre, Music Hall or place of Amusement and Entertainment, the works of the Chutney Artistes and other Artistes in Concerts, Musical and other pieces, Shows, Competitions, Exhibitions and a variety of other entertainment as the Foundation may from time to time deem fit; (iv) to purchase or otherwise and obtain exclusive and other interest in copyrights of representations of the members and other artistes with similar cultural and artistic talents and any other rights of or in sounds, music, cinematography and other films, works and compositions;

5 (v) to purchase, lease, rent or otherwise acquire lands, buildings and other premises for the benefit of the Foundation within the Republic of Trinidad and Tobago or elsewhere together with all or any part of the furniture, fixtures, fittings, scenery and effects belonging to such lands, buildings and other premises in connection wherewith and to alter, rebuild, reconstruct, work, maintain and carry on business for musical entertainment for the time being owed or rented or taken on lease by or in the occupation of the Foundation; (vi) to carry on within the Republic of Trinidad and Tobago or else where all or any on the business of music hall, concert hall, and cinema proprietors or agents, box office keepers, showmen, exhibitors, sound, music, play programme and general publishers, printer decorators, theatrical and musical agents, caters for public and private amusements and entertainments of every description; (vii) to carry on, in connection with the proper functioning of the Foundation, the business of wine, spirit, beers, mineral water, tobacco, cigar and cigarette merchants and retailers, confectioners, florists, restaurant and refreshment room-keepers and proprietors, or any of such business for the financial enhancement and upliftment of the Foundation;

6 (viii) to carry on all or any of the business of entertainment as promoters, chutney singers and artistes, managers and personal representatives in all or any sphere of entertainment; (ix) to provide on such terms as the foundation may deem expedient, all or any of the managements, secretarial, advertising, publicity, accountancy, personal and social activities and services required or used in connection with their professional engagements by chutney signers and other artistes engaged in the musical entertainment activities; (x) to acquire copy-rights, rights of production or presentations, licences and privileges of any sort likely to be conductive to the proper functioning of the Foundation; (xi) to employ persons to write and compose Chutney Songs or adapt plays and Chutney products, sketches, sounds and music within the ambit of the law for the benefit of the Foundation; (xii) to enter into agreement with foreign Chutney Singers or Artistes or other persons whom the Foundation may deem proper for the presentation of musical shows and other musical entertainment in the Republic of Trinidad and Tobago or elsewhere; (xiii) to carry on business as distributors and buyers, sellers and dealers in records, tapes and all other apparatus for

7 recording events by means of sight and sound and all rights to produce, distribute or exhibit any show, entertainment or event by means of film, records and other such apparatus as aforesaid. To collect all royalties relevant to the above for distribution; (xiv) to carry on in all parts of the world the business of making, producing, exhibiting, distributing, renting, letting or hire and other wise exploiting cinematographic and television films/ and to act as agents for the purchase, sale, hiring and exploitation thereof and generally deal in equipment capable of being used in connection with chutney shows and other artistes shows, exhibitions and entertainment/or useful for the purchase of such shows, exhibitions and entertainment; (xv) to carry on business as dealers in sound-producing machines of all kinds, electrical appliances, apparatus and fittings, labor saving contrivances and other articles; (xvi) to obtain all necessary permits or licences required for the purpose of enabling the Foundation to carry on its functions upon such terms and conditions as may be acceptable to it; (xvii) to produce, promote, present, organise, arrange and provide every kind of entertainment, diversion or instructions in whole or in part suitable, or which may directly or indirectly provide suitable materials for the uplifting of the Foundation and the financial benefits of its members;

8 (xviii) to start, acquire, print, publish and circulate, or otherwise deal with any Newspaper or printer or publisher to propagate the views of the Foundation generally; (xix) to hold or promote competitions of any description authorized by law, which may be calculated to increase the business of the Foundation or to advertise or promote the sale of any publication issued by it or in which it is interested and to give prizes in connection with such competitions or otherwise consisting of cash, scholarship, or other terminable payments, gifts in kind, or any other description of bonus or reward, or any rights, privileges or advantages which it is in the power of the Foundation to confer; (xx) to enter into any arrangement or contract with any person, firm, establishment, organisation or company for carrying on the whole or any part of the business of the Foundation; (xxi) to remunerate any person, firm or company rendering services to the Foundation by payment in cash or by allotment to him or them any benefit as is agreed to by the Executive; (xxii) to borrow money either with or without security from any lending agency and to secure the repayment of any money by mortgage or other charge upon the whole or any part of the Foundation s assets;

9 (xxiii) to take note of the functions of the National Cultural Promotions and the Ministry of Community Development, Culture and Women s Affairs; (xxiv) to laise with the Government of this Territory and elsewhere with a view to obtain finance and a franchise to further enhance the Foundation s objects; (xxv) to seek and obtain overseas contracts through its marketing department and to propagate its views through the media; (xxvi) to promote this National Artform in Trinidad and Tobago and throughout the World; (xxvii) to establish this Artform to be officially recongnised by the Government of Trinidad and Tobago as a National Artform of Trinidad and Tobago ; (xxviii) to promote various Chutney Programmes in all its categories; (xxxix) to establish a Chutney Museum which will include the following: (a) Recording Studios (Videos and Audios/Cassettes), etc.; (b) Instrumentations Experiments; (c) Creative Writings/Compositions; (d) History of the Artform; (e) Cultural Exchanges both Nationally and Internationally; (f) All relevant information and development of the Artform;

10 (xxx) to assist Artistes at all levels; (xxx) to network with National and International Organisations and Individuals as is necessary; (xxxii) to act as the Custodian of the Chutney Artform; (xxxiii) to receive donations/grants/gifts from private sector in order to assist its Aims and Objectives; (xxxiv) to do all things according to the Laws of Trinidad and Tobago in order to achieve the greatest benefits for the Artform and its practitioners; And it is hereby declared that each of these objects hereinbefore mentioned shall wherever and in so far as the context so admits be regarded as an independent object, and is in no way shall be limited or restricted to or inference from the name of the Foundation or any other paragraph or otherwise howsoever. Power of the Organisation 4. The Organization shall have power to (a) acquire by purchase, transfer, donation, exchange, devise, bequest, grant, giftconveyance or howsoever otherwise, any real or personal property or any estate or interest therein; (b) accept surrenders of reconveyances and to enter into contracts; (c) subject to any restrains, reservation or condition contained in the document under which it has acquired title to sell, exchange, devise, mortgage, or otherwise dispose of and deal with all property which may for the time being be vested in it.

11 5. All real or personal property of whatever nature now held or vested in any person for the use and benefit of the Foundation is hereby transferred to and vested in the Foundation. 6. All documents requiring the seal of the Foundation shall be sealed with the common seal of the foundation in the presence of the President and Secretary for the time being in office (or in the event of incapacity in the presence of some other person or persons authorized for that purpose by the Foundation) who shall both sign every document and such signing shall be prima facie evidence that the said seal was duly affixed and that the same is the lawful seal of the Foundation. 7. (1) The Foundation shall at all times have a fixed address in Trinidad and Tobago for the service of the documents on the Foundation and such address and any change thereof shall be registered with the Registrar General within twenty-eight days of the incorporation or the change of address as the case may be. (2) Every document to be served on the Foundation may be served by leaving the same at or by sending the same by registered post to the registered address of the Foundation. (3) Failure to register the address and any change thereof is a summary offence and renders the Foundation liable to a fine of one hundred and twenty dollars and to a further fine of ten dollars for each day during which the offence continues after conviction thereof. 8. The Foundation may from time to time make rules and regulations for the proper conduct of its proceeding and discharge of its duties, powers and functions with power to vary, or revoke such rules and regulations. Nothing in this Act shall affect or be deemed to affect the rights of the State, or of any bodies politic or corporate or of any persons, except such as are mentioned or referred to in this Act and those claiming by, through, from or under them.
