ORDER SONS OF ITALY IN AMERICA LODGE 2662 ARTS & CRAFTS VENDOR CONTRACT/RELEASE DATE: JUNE 22 & 23, 2019 OCTOBER 5 & 6, 2019 LOCATION: THE MARKET COMMONS TIME: JUNE SATURDAY 11 AM 8 PM / SUNDAY 11 PM 7 PM OCTOBER - SATURDAY 11 AM 6 PM / SUNDAY 11 PM 6 PM (Please note this is the advertised time and patrons may enter up to one hour prior) REGISTRATION: Complete the attached registration form in full and mail (by check or credit card), or fax (credit card only), to OSIA Lodge 2662, 7957 Moss Creek Rd, Myrtle Beach, SC 29588, Attn: Vendor Coordinator. Deadline for either event is two weeks prior. NO REFUNDS CHECK-IN: Check-in begins on Friday, 3PM until 6PM and ends on Saturday 7AM 9AM. Vendor coordinator will be available on site during these times. Display booths must be set-up prior to 10 AM. Times are subject to change. Vendors are requested to follow the check-in procedure as follows: Check-in with volunteer coordinator and obtain your site number and location information. Each vendor will be allowed 15 minutes to off load his or her equipment CURBSIDE. Do not drive onto the festival grounds. Violators will be required to pay for repairs. Curbside parking is only allowed during check-in times and otherwise at your own risk. FREE parking is available on side streets, overflow lot (one block away), or the parking garage directly across the street. 1

FESTIVAL PROCEDURES, RULES AND REGULATIONS 1. Read and complete the attached WAIVER AND RELEASE OF LIABILITY. Include completed form with your registration. 2. You will be sent a confirmation letter upon receipt of your completed registration. All requests will be considered, but not guaranteed. We try not to duplicate similar products please offer full descriptions of product/service. 3. One week prior to the festival you will be sent, by email, information regarding set-up, breakdown and parking. Booth assignment and festival layout will be given at check-in. 4. Vendors must have someone to oversee their booth at all times. Please inform the Vendor Coordinator if you might need assistance during the day. 5. Vendors may not move their booth site unless approved by the Vendor Coordinator. 6. Vendors are responsible for personal liability coverage and for collecting local taxes, if applicable. 7. Vendors are required to provide their own tents, tables, chairs, displays, etc. All equipment must be contained within the 10 boundary of your rented space. 8. Limited electric sites are available and contracted on a first come first served basis. Vendors are responsible to provide their own extension cords (50 suggested) and surge protectors, if necessary. 9. Vendors are expected to be in attendance both days, during festival hours, unless prior arrangements have been made. Any vendor who chooses otherwise will not be invited back for future events. We understand that weather may make changes necessary; however, Vendor Coordinator will inform participants of this decision. 2

WAIVER AND RELEASE OF LIABILITY for THE MARKET COMMONS In consideration of permission from Sons of Italy Lodge 2662, a South Carolina Fraternal organization holding charity status, Myrtle Beach, (the "Host") to attend and participate in the Sons of Italy Lodge #2662 Italian Festival at Market Commons for the period of June 21, 2019 at 12PM and continue though June 24, 2019 at 11:59PM and/or October 4, 2019 at 12:00 p.m. and continue through October 7, 2019 at 11:59 p.m., ( the "Activity") the undersigned acknowledges and agrees as follows: 1. There is an inherent risk of injury from my presence at, and/or participation in, the Activity; and, 2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS RELATED TO MY PRESENCE AT, AND/OR PARTICIPATION IN, THE ACTIVITY, BOTH THE RISKS KNOWN AND UNKNOWN, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES (as hereinafter defined), AND I ASSUME FULL RESPONSIBILITY FOR MY ATTENDANCE AND/OR PARTICIPATION IN THE ACTIVITY; and, 3. If I observe any unusual significant hazard during my presence at, or participation in, the Activity, I will remove myself from participation in such Activity and bring such to the attention of the nearest official or representative of the Host immediately; and, 4. I, for myself and on behalf of my heirs, assigns, personal representatives, family and next of kin, HEREBY WAIVE ANY CLAIMS AGAINST, RELEASE AND HOLD HARMLESS the Host, and its officers, directors, board members, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the Activity (hereinafter referred to as the Releasees ), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. 5. I, for myself and on behalf of my heirs, assigns, personal representatives, family and next of kin, hereby agree to indemnify and hold harmless the Releasees against any loss, costs, damages, liens, expenses (including attorneys fees), lawsuits, claims, procedures, actions or other liability claimed or imposed upon the Releasees for any property damage or loss, personal injury of any kind, illness and/or death, whether arising from the negligence of the Releasees or otherwise. I agree to defend and indemnity Releasees from any claim, cost, or expense arising from or relating to my acts or omissions or alleged acts or omissions while participating in the Activity. 6. The undersigned further expressly agrees that the foregoing waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the law of the State of South Carolina and that if any portion thereof is held invalid, it is expressly agreed that the remaining terms and conditions shall, notwithstanding, continue in full legal force and effect. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT AND FULLY UNDERSTAND ITS TERMS. I fully understand the terms and conditions of this Agreement as set forth above and expressly agree to be bound by the foregoing terms and conditions.
