The Ins and Outs of Domestic Asset Protection Trusts This presentation will discuss Michigan s new Qualified Dispositions in Trust Act, which became effective on February 5, 2017. This Act allows for what are commonly known as Domestic Asset Protection Trusts (DAPTs). Michigan became the 16 th state to allow for DAPTs. Now it s possible for Michigan residents to create irrevocable trusts for their own benefit while still protecting the trust property from the grantor s creditors. The presenter will discuss design features, including trustee selection; selecting the best candidates for establishing a DAPT; the estate, gift and income tax consequences of DAPTs; why DAPTs are good ILITs; and a comparison of Michigan s DAPT statute with those of other states. Special attention is paid to understanding client needs and goals at various stages in life, and understanding the strategies, products, and techniques to help the client achieve their goals and objectives.
