SWEEPSTAKES PERIOD: The Sweepstakes begins on Friday, March 6, 2015 at 8:00 a.m., Pacific Time (PT) and ends on Thursday, December 31, 2015 at 11:59 p.m. PT (the Sweepstakes Period ). All entries must be received by Thursday, December 31, 2015 at 11:59 p.m. PT ELIGIBILITY: Sweepstakes is open only to legal residents of the 50 United States (including the District of Columbia) and Canada (excluding Québec) ( Territory ) who are twenty- one (21) years of age or older at time of entry, and have a valid driver s license except that residents of New York, Rhode Island and Florida are not eligible. WINNER SELECTION AND NOTIFICATION: Decisions of Sponsor with respect to the Sweepstakes are final. One (1) potential grand prize winner and ten (10) potential runner- up prize winners will be selected in a random drawing conducted by Sponsor, or a judge ( Judge ) it selects in its sole discretion on or about Monday, January 4, 2016 from among all eligible entries received during the Sweepstakes Period. The potential prize winners are subject to verification, including without limitation, verification of eligibility, age, compliance with these Official Rules and completion of release forms (described below). If a potential prize winner is found not to be eligible or not in compliance with these Official Rules, the potential prize winner will be disqualified. All costs and expenses associated with the prize acceptance and use not specified herein as being provided, including but not limited to transportation costs, meals, gratuities, service charges or taxes, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long- distance telephone calls, insurance, and any other incidental costs or expenses not identified in these Official Rules are the sole responsibility of the Winner. All prizes will be awarded as- is with no warranty or guarantee either expressed or implied. The terms and conditions of the tickets awarded as part of the prize will govern in the event an event is not conducted due to weather conditions, an act of God, and an act of terrorism, civil disturbance or any other reason. Winner and his/her guest agree to comply with all applicable Speedway, Hotel and Venue regulations in connection with the prize. Sponsor reserves the right to remove or to deny entry to the Winner and/or his/her guest who engage in a non- sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the event. Released Parties (defined above) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any event. Event tickets and passes awarded as prizes may not be resold or offered for resale. Any such resale may result in disqualification and prize forfeiture, and may invalidate the license granted by the event tickets. WINNER RESPONSIBILITIES: Sweepstakes winners will be solely responsible for all taxes on Sweepstakes prize(s) and will receive an IRS Form 1099 for the retail value of the prize(s). Winner will be required to sign a Statement of Eligibility, Liability Release and Publicity Release (collectively Releases ) (except where prohibited by law). In addition, Winner s Guest will be required to sign a Liability and Publicity Release (except were prohibited by law). Failure to provide such will result in forfeiture of the Prize. RELEASE: By participating, entrants agree, and by accepting prize, winner(s) agrees, to release and hold harmless the Released Parties from any and all liability, injury, loss or damage incurred by participating in the Sweepstakes and/or the awarding, receipt, acceptance, possession or use/misuse of the prize(s). MODIFICATION: Sponsor reserves the right, at its sole discretion, to modify, cancel, postpone, delay, suspend and/or terminate this Sweepstakes in whole or in part in the event that the Sweepstakes is not capable of running as planned or as intended by these Official Rules by reason of any technical or other
disabling causes that, in the sole discretion of the Sponsor, impair, corrupt or interrupt the administration, fairness, security or integrity or proper play of the Sweepstakes, including without limitation, hurricane, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, war, terrorist threat or activity or insurrection. In the event of cancellation, Sponsor shall award the Sweepstakes Prize (or prizes of equal or greater value) in a random drawing from all eligible, non- suspect entries received as of the time of Sweepstakes cancellation. Sweepstakes are initially provided by Sponsor to entrant under the name Las Vegas Motor Speedway Viva Vegas Superfan Sweepstakes but the name of the Sweepstakes is subject to change at the discretion of the Sponsor and any such name change shall be posted along with the rules at http://www.lvmsfanzone.com/promotions. Additional companies or organizations may join in sponsoring the Sweepstakes and such additions shall likewise be posted at http://www.lvmsfanzone.com/promotions. DISPUTE RESOLUTION: All entrants agree that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contest or any Prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Nevada or the appropriate Nevada State Court located in Clark County, Nevada; and (ii) any and all claims, judgments and awards shall be limited to actual out- of- pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys' fees.
