The IRS recognizes that the MEP structure, including the unaffiliated employer variation utilized in the OPEN 401k plan, is a valid 401(k) construction. The Department of Labor simply requires, as it does for all plans, that each individual employer (a) submits its own DOL Form 5500 (done on your behalf by the OPEN 401k plan administrator), (b) have an ERISA/Fidelity bond, and (c) have an audit audit if you have more that 100 employees in the MEP (the audit can be arranged by the 401k plan administrator at your request).

Pl an Design Options Eligibility Requirement Options Minimum age requirement can be either 18 or 21 years old to enter the plan. Minimum service requirement can be 1 year of service, any number of months up to 11 months of service, or immediate entry after 1 hour of service. Additionally, an adopting employer may choose to auto enroll employees in the plan once they have met their eligibility requirements. Participant Deferrals Both Traditional and Roth contributions are permitted in the plan. Loans, Hardship Distributions, Pre-Retirement Distributions Adopting employer has the option to restrict or allow 401(k) loans, hardship distributions, and pre-retirement distributions. Matching and Profit Sharing Contribution Options Adopting employer may choose to make discretionary matching contributions, Safe Harbor matching contributions, or no match at all. Adopting employer may choose to make discretionary profit sharing contributions, a Safe Harbor profit sharing contribution, or no contribution at all. There is an additional option to restrict profit sharing contributions to those participants who worked at least 1,000 hours during the calendar year and were employed on the last day of the year. Key Parties & Responsibilities The OPEN 401k plan bundles the services of the following industry leading professional service groups to offer best in class fiduciary protection, compliance, and ease of use. Plan Coordinator/Investment Education "XYZ Financial" coordinates the set up of all new accounts in the OPEN 401k Plan. The company provides inital and ongoing participant education, enrollment materials and serves as the advocate for the employer. Plan Fiduciary & Trustee Fiduciary Wise, LLC is the fiduciary and trustee of the plan. As fiduciary and trustee they assume the responsibilities and liabilities of ERISA sections 3(16), 404(c), and 408(b). They are responsible for identifying, analyzing and appointing the administrative, custodial and investment management service providers to the 401k plan. Plan Administrator & Recordkeeper Future Benefits of America is the administrator and recordkeeper of the plan. FBA processes payroll data, tracks participant eligibility and produces both online and paper statements for participants and employers. FBA is also responsible for the plan testing and the preparation of form 5500 for each adopting employer. Plan Custodian Mid Atlantic Trust Company is the custodian of the plan assets in the 401k plan and responsible for making all transactions for the plan. Mid Atlantic has over $50 billion in assets under custody and administration, and over 75,000 brokerage and trust customer accounts. ERISA 3(38) Investment Fiduciary Bell Rock Capital (BRC) is an SEC-registered investment adviser, based in Delaware with offices in Florida and Pennsylvania. As the ERISA 3(38) fiduciary for the OPEN 401(k), BRC is responsible for the plan's Investment Policy Statement as well as the selection, monitoring and replacement of the investment menu of individual options.
