Please quote your single, best, net price on each item, unless a discount from list price is requested; delivered to the address specified with all transportation charges prepaid. Price shall include delivery to the University's Central Receiving Building (Jordan Warehouse). 3. Bids must be firm. Those containing escalator clauses cannot be accepted. To receive consideration, bids must be made on this form signed in full. Prices must be based on stated units and extended. Delivery guarantee must be shown. 4. The terms and conditions of this Invitation include all general conditions revised July 01, 1983, incorporated by reference and available to each vendor, plus any special conditions enumerated herein, and provisions to be part of any contract(s) resulting from this bid. 5. That I am the Bidder (if the Bidder is an individual), a partner (if the Bidder is a partnership), or an Officer or employee of the bidding corporation having authority to sign on its behalf (if the Bidder is a corporation); 2. 1. Any agreement or collusion among Bidders or prospective Bidders, which restrains, tends to restrain, or is reasonably calculated to restrain competition by agreement to bid at a fixed price or to refrain from offering, or otherwise, is prohibited. 2. Any person who violates any provisions of KRS 45A.325 shall be guilty of a class D felony and shall be punished by a fine of not less than five thousand dollars nor more than ten thousand dollars, or be imprisoned not less than one year nor more than five years, or both such fine and imprisonment. Any firm, corporation, or association who violates any of the provisions of KRS 45A.325 shall, upon conviction, be fined not less than ten thousand dollars or more than twenty thousand dollars. SWORN STATEMENT OF COMPLIANCE WITH CAMPAIGN FINANCE LAWS In accordance with KRS 45A.110(2), the undersigned hereby swears under penalty of perjury that he/she has not knowingly violated any provision of the campaign finance laws of the Commonwealth of Kentucky and that the award of a contract to a Bidder will not violate any provision of the campaign finance laws of the Commonwealth of Kentucky. BIDDER REPORT OF PRIOR VIOLATIONS OF KRS CHAPTERS 136, 139, 141, 337, 338, 341 & 342 The Bidder by signing and submitting a bid agrees as required by KRS 45A.485 to submit final determinations of any violations of the provisions of KRS Chapters 136, 139, 141, 337, 338, 341 and 342 that have occurred in the previous five (5) years prior to the award of a contract and agrees to remain in continuous compliance with the provisions of the statutes during the duration of any contract that may be established. Final determinations of violations of these statutes must be provided to the University by the successful Bidder prior to the award of a contract. INSTRUCTIONS TO BIDDERS All Kentucky State University bid solicitations are made upon and subject to the following conditions: 1. Preparation of Bids 1.1 All solicitations are subject to the provisions and requirements of any applicable Kentucky Revised Statutes, including Kentucky Model Procurement Code, and the rules, regulations and policies of Kentucky State University including the Standard Terms and Conditions. 1.2 Bidders are expected to examine the complete bid and all attachments including drawings, specifications and instructions. Failure to do so is at bidder s risk. 1.3 Bidders shall furnish information required by the solicitation in the form requested. The University reserves the right to reject bids with incomplete information or which are presented on a different form. 1.4 All bids must be legible. A legally authorized company representative shall sign all bids in the appropriate location. Erasures or other changes must be initialed by the person signing the bid. Signature on a bid certified that the bidder has read and fully understands all bid specifications and bidder agrees to all terms and conditions stipulated in the Invitation for Bid (IFB). 1.5 Bid prices shall be entered in spaces provided on the bid form. All unit prices and mathematical extensions and totals shall be indicated where required. In cases of errors in extensions or totals, the unit price will govern. 1.6 Should any potential bidder doubt the true meaning of any part of the solicitation, a written request for an interpretation may be submitted to the University. Requests for such interpretation shall be made in writing to the appropriate Contracting Officer identified in the solicitation. Every interpretation made shall be in the form of an addendum to the solicitation sent as promptly as is practicable to all prospective bidders to whom the solicitation has been issued. Failure by the University to send or any potential bidder to receive such interpretation(s) shall not relieve any bidder from any obligations under the bid solicitation or the bidder s response. Any interpretations, corrections or changes to the solicitation made in any other manner, including oral explanations and instructions, are not binding upon the University. 1.7 Bidders or potential bidders are required to coordinate all discussions concerning solicitations through the appropriate Contracting Officer or other purchasing official within Kentucky State University s Purchasing Department. Bidders or potential bidders are not authorized to communicate with any University administrator, faculty, staff, or Board of Regents member concerning this solicitation. Failure to comply with this requirement is grounds for the bidder s disqualification. 1.8 Unless otherwise stipulated in a bidder s response, the bidder s offer is in strict accordance with the University s specifications and terms and conditions of the Invitation for Bid. Any deviations must be fully itemized in detail. Any deviations from the requirements of this solicitation are at bidder s risk and the University may determine the bid to be non-responsive. 2. Submission of Bids 2.1 Bids, and modifications thereof, shall be returned in a sealed envelope and submitted in such a manner as to ensure its arrival in Kentucky State University s Purchasing Department before the due date and time set forth in the solicitation. Unless otherwise indicated in the solicitation, no oral, facsimile, e-mail or telephone bids will be accepted. Page 4
2.2 Bids may be modified or withdrawn in writing or in person by an authorized representative if done so prior to the exact time and date for receipt of the bids. Telephone and facsimile modifications or withdrawals are not permitted. Withdrawn bids may be resubmitted, with or without modifications, up to the solicitation due date and time. No bids may be withdrawn after the due date and time without the express authorization of Kentucky State University s Purchasing Department. 2.3 Bids received after the designated time and date in the solicitation will not be considered. Bids will be publicly opened and read in accordance with the Invitation for Bid. 2.4 Bidders shall show the bid due date and time, the solicitation number, and the name and address of the bidder on the face of the bid envelope. 2.5 All bids must be signed to be considered. Please also include your mailing address and daytime phone number. 2.6 All bids will be considered firm for a period of 30 calendar days from the bid opening date. 3. Bid Evaluation and Award 3.1 Bids will be evaluated and the award made to the highest bid offered per item. 3.2 The University reserves the right to accept or reject any and all bids or part of a bid and waive informalities, technical defects and minor irregularities in the bids received. 4. Payment and Taxes 4.1 Upon acceptance of offer by Kentucky State University, the winning bidder(s) will be notified and payment can be made. 4.2 If your company is exempt from sales tax, please include a valid sales tax exemption certificate with your bid package. All buyers that are not tax exempt or unable to provide a valid sales tax exemption certificate are subject to state sales taxes of 6% which will be calculated on the bid amount and added to determine the total purchase price. 4.3 Payment for purchases must be made prior to pick-up of vehicles. Payment must be made in the KSU Purchasing Department located in Academic Services Building, Suite 423; payment will be accepted during regular business hours between 8:00 am 4:30 pm. 4.4 Acceptable payment methods include cash, cashier s check, certified check, or money order made payable to Kentucky State University. 5. Removal of Purchases 5.1 Successful buyer is responsible for all expenses related to handling, loading, and transporting purchases from University property. 5.2 Removal of all items must be scheduled by calling Debra Bright at 502-597-6434 or Rebecca Stamper at (502)597-6657. All items must be removed no later than 2:00 pm Eastern time on March 25, 2019. Failure to remove purchased vehicles in a timely manner will result in forfeiture of the vehicle(s) and disbarment from future sales for one year. Page 5
6. Damage of Property 6.1 The bidder shall be liable and responsible for the costs of repairing or replacing any damages to University property resulting from the buyer or their agents, during the removal of sale items, to the satisfaction of the University. 7. Presence on Campus 7.1 Buyer agrees that all persons working for or on behalf of the buyer whose responsibilities bring them on campus shall obey the rules and regulations that are established by the University and shall comply with the reasonable directions of University personnel. 7.2 The buyer shall be responsible for the acts of his employees and agents while on campus. Accordingly, buyer Agrees to take all necessary measures to prevent injury and loss to persons or property located on campus. 7.3 The buyer shall be responsible for all damages to persons or property caused by the buyer, his agents, or employees. 7.4 The University does not and will not assume any responsibility for any tools, equipment, materials, or property belonging to the buyer, his employees, or agents. 8. Indemnification 8.1 Buyer agrees to indemnify and hold harmless Kentucky State University and its respective officers and employees from any claim, damage, liability, injury, expense, or loss, including but not limited to, defense costs and attorney fees, arising out of buyer s performance agreement or as a consequence of the existence of this agreement. KENTUCKY STATE UNIVERSITY INVITATION FOR BID KSI-17-03 SPECIAL CONDITIONS SCOPE This Invitation for Bid is for the sale of surplus vehicles located at Kentucky State University in Frankfort, KY. This sale is open to the general public, employees, and students. All vehicles are being sold as-is and where-is. The University makes no warranty, express or implied, as to the condition of the property or of its appropriateness for any particular purpose. Returns and/or refunds will not be honored. All sales are final. Inspection prior to submitting an offer is the responsibility of the bidder. Interested bidders must contact Debra Bright at 502-597-6434 to schedule appointment for inspection of vehicles. All inspections must occur prior to bid opening date/time. All vehicles purchased must be removed by 2:00 pm Eastern time March 25, 2019. Failure to remove purchased vehicles in a timely manner will result in forfeiture of the vehicle(s) and disbarment from future sales for one year. RESTRICTIONS ON COMMUNICATIONS WITH UNIVERSITY STAFF From the issue date of this IFB until a Contractor is selected and a contract award is made, Offerors are not allowed to communicate about the subject of the IFB with any University administrator faculty, staff, or members of the Board of Regents except: The Purchasing Department representative, any University Purchasing Official representing the University administration, or others authorized in writing by the Purchasing Department, and Kentucky State University representatives during Offeror presentations. If violation of this provision occurs, the University reserves the right to reject the bid. INVITATION SUBMISSION AND DEADLINE Kentucky State University accepts delivery of bids Monday through Friday from 8:00 am 4:30 pm Eastern Time. However, bids must be received by 2:00 pm Eastern Time on the date specified on the Invitation for Bid in order to be considered.
