Terms and Conditions for Caller Tunes Lagao T20 Final Main Jao The Caller Tune Lagao T20 Final Main Jao is organized by Hungama Digital Media Entertainment Private Limited, a company having its office at F-1, First Floor, Laxmi woolen Mills Estate, Shakti Mills Lane. Off Dr. E. Moses Road, Mahalaxmi, Mumbai 400011 (hereinafter referred to as Hungama & the Organizer ) In association with- VODAFONE WEST LIMITED, a company incorporated under the companies act,1956 and having its registered office at Vodafone, 6 th floor, Sakar II, Elis bridge, Ahmedabad-380006 and its regional circle office at Vodafone House, Corporate Road, Prahalad Nagar, Off S.G. Highway, Ahmedabad- 38 51, Gujarat, India (hereinafter referred to as Vodafone ) in Gujarat circle for valid prepaid and postpaid cellular mobile subscribers (hereinafter referred to as Subscribers ) of Vodafone; subject to the terms and conditions of the Caller Tunes Lagao T20 Final Main Jao contest. Duration of Caller Tunes Contest: 10 th April 2012 onwards till 20 th May, 2012 Caller Tunes contest will be available subject to the following terms and conditions (hereinafter referred to as Terms ). The subscribers agree to abide by these Terms & conditions in entirety. If any subscriber does not agree to any of the Terms, such subscriber shall not be allowed to participate in Caller Tunes Contest. Vodafone and/ or Organiser, reserve the right to modify the Terms at any time, without notice. Caller Tunes contest is valid for pre-paid as well as post-paid category of subscribers of Vodafone. 2. To participate as a contestant in the Caller Tunes contest, the subscriber shall have to subscribe for Caller Ring Back Tone (CRBT) of either of following price-points by available modes of subscriptions and shall be eligible to win the Prizes. 1) Single Song of Rs. 15/- which is a package of 1 CRBT with validity of 90 days, provided by the 1) Shuffle of Rs. 15/- which is a package of 3 CRBTs with validity of 30 days, provided by the 2) Shuffle of Rs. 25/- which is a package of 6 CRBTs with validity of 30 days, provided by the 3) Shuffle of Rs. 99/- which is a package of 30 CRBTs with validity of 30 days, provided by the 4) Shuffle of Rs. 1 which is a package of 3 CRBT with validity of 1 days, provided by the 5) Shuffle of Rs. 2 which is a package of 6 CRBT with validity of 1 days, provided by the 5) Shuffle of Rs. 3 which is a package of 30 CRBT with validity of 1 days, provided by the
3. The Participants can win the following Prizes A. Grand Prize T20 Final Ticket: Lucky Winner will get 2 ticket for DLF IPL 2012 final match to be held in Chennai, along with to and fro air tickets and hotel stay for a night as gratification for the contest B. Weekly Prizes One Samsung Mobile handset would be awarded to three winners every week. For the purpose of clarification and avoidance of doubt, Prize does not include any personal expenses incurred by the winner and the winner shall be solely responsible for any expenses whether additional or incidental, required to be incurred to avail his/her Prize. 4. Caller Tunes contest is valid only for Vodafone Subscribers who are: (i) eighteen (18) years of age or above; (ii) Active and existing Subscribers; (iii) Not either prosecuted or convicted for commission of any criminal offence; (iv) Not suffering from any legal disability e.g. insolvency, restraint by court etc; (v) Not have any outstanding dues payable to Vodafone on account of the mobile connection. 5. If the winner is not able to provide sufficient evidence to show that he/she is the rightful & genuine subscriber of the Vodafone Mobile connection, Organizer and / or Vodafone, reserves the right to award the Prize (defined below) to the next eligible winner or to forfeit the prize, at its sole discretion. 6. Employees and relatives of employees of Hungama and Vodafone will not be eligible to participate in Caller Tune Contest. 7. To participate in Caller Tunes contest, the Subscriber needs to subscribe for Hungama s Caller Ring Back Tone (CRBT) single song of Rs 15/- or shuffle of Rs.15/- or of Rs.25/- or of Rs.99/- or Rs. 3/day or Rs 2/day or Rs 1/day. 8. WINNER SELECTION: A. Grand Prize
1. Selection of winner will happen through a skill based SMS contest, where the subscriber who has selected the caller tune @15 Rs or shuffle @ 15, 25, or 99, 3Rs/day, 2Rs/day, 1Rs/day will have to SMS a slogan on why does he/she likes Vodafone and send it to the toll FREE number 54045. 2. Decision of Vodafone shall be final and shall not be subject to challenge under any circumstances. 3. All the participants who have subscribed any of the Caller tune song or CRBT shuffles mentioned above will be considered for the SMS contest 4. Subscriber who has already won Weekly prize shall also be eligible for the Grand Prize. 5. Only one Winner of all the eligible Participants shall be considered for the Grand Prize. 6. Prizes will be decided by Vodafone Gujarat management based on the best slogan received and their decision will be final in this regard. B. WEEKLY PRIZES: Weekly Winners will be selected after the end of contest during the Term through a skill based SMS contest where the subscriber who has selected the caller tune and or shuffle @ 15, 25, or 99,3Rs/day,2Rs/day, 1Rs/day will have to SMS a slogan on why does he/she likes Vodafone and send it to the toll free number 54045, who will be offered one Samsung handset. Winner will be informed immediately after the contest about their winning of Prizes. 9. The documents required to be submitted along with the claim by the winner shall include the following (the document list is only inclusive and not exhaustive) and organizers, at their sole discretion may insist on such further proof as it may deem fit: a. Identity Proof. b. Address Proof c. Letter of Compliance with rules and regulations etc. in the manner prescribed. d. Submission of acknowledgement letter (as per the format that shall be provided by Organizer) on receipt of the Prize(s) e. Pan Card If the Winners are unable to provide the required documents, the Prizes shall be offered to next shortlisted Participants subject to submission of all the required documents. 10. No substitution or exchange of the Prize shall be allowed. 11. However, the Organizer reserve the right to substitute and/ or change the Terms and/ or Prize, without any prior intimation or notice to the participants and/ or winner as the case may be.
12. The Organizer & Vodafone shall not be liable for any delay or loss that may accrue in the delivery of the Prize. 13. Organizer shall provide the Prizes to the concerned authorized Person of the Vodafone Telecom Service Area in the Circle from which the Winner is chosen. However, the Winners shall personally come to the office of Vodafone in their Circle to claim the Prizes within 15 days from the date of declaration of Winners and the winners shall be solely liable to bear any cost that may be incurred by him / her, in collecting / availing the prize. 14. Caller Tunes contest is valid subject to the winner complying with all Terms and Conditions contained herein, as required by the Any failure on the part of the participant to comply with the any specified Terms & conditions contained herein, shall disqualify such participant. 15. Caller Tunes contest is subject to applicable laws and guidelines/ directions issued by Telecom Regulatory Authority of India ( TRAI ), Department of Telecom (DOT) or any other statutory authority from time to time. 16. Organizer reserves the right to extend, cancel, discontinue, prematurely withdraw, postpone, change, alter or modify Caller Tunes contest or any part thereof including the eligibility criteria at its sole discretion at anytime during it s validity as may be required in view of business exigencies and/or changes by TRAI, Department of Telecom (DOT) and/or statutory changes and the same shall be binding on the participant. 17. The existence of a dispute, if any, regarding the Prize shall not constitute any claim against Vodafone or Organiser. 18. In matters relating to Caller Tunes contest hereto, the decision of organizer shall be final and binding in all respects. 19. Caller Tunes contest is subject to force majeure circumstances i.e. Act of God or any circumstance beyond the reasonable control of Organizer & Vodafone shall not be liable for any failure to comply with its obligations where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
20. Organizer & Vodafone shall not be responsible for any SMS message delivery failures, for any lost, late or misdirected network, electronic failures of any kind or any failure to receive entries owing to transmission failures or due to any technical reasons and/or other conditions beyond its reasonable control. 21. The Prizes are non-transferable, non-negotiable, subject to availability and there will be no cash alternative. Organizer reserve the right to substitute Prizes of equal or greater value, at any time. 22. The Organizer and Vodafone are neither responsible nor guarantee the quality of the goods/ services being provided as prizes nor is it liable for any defect or deficiency of goods or services so obtained/availed, by the subscribers under Caller Tunes contest. 23. Income tax, gift tax or any other statutory taxes, duties or levies as may be applicable from time to time, arising out of free Prize, shall be solely borne by the Winner for the respective Prize won. Applicable Taxes, Insurance amount and Registration charges in respect of availing Prize of Bike and applicable taxes in case of other Prizes shall also be born by the Winner. In case the Winner fails to comply with the applicable laws and fails to pay applicable tax, Insurance amount and Registration Charges, as may be applicable, Organizer will be entitled to select another winner at their own sole discretion. 24. The winner will be requisitioned to pay for the TDS (Tax Deducted at Source) applicable for his/ her Prize. However if the winner does not agree to comply with the said requisition of paying the TDS amount, an alternative winner who agrees to pay the TDS will be chosen. Prior payment of the TDS to the government authority and submission of proof thereof to Organizer shall be a condition precedent for delivery of prizes to the Winner. 25. Organizer will not be liable for any damage or loss (including but not limited to indirect or consequential loss) arising from personal injury or death, or damage to property, which is suffered or sustained in connection with Caller Tunes contest or Prizes. 26. Winners shall be intimated by the Organizer directly. Organizer shall not entertain any questions, correspondence, enquiries on the manner of conducting Caller Tunes contest and grant of Prizes from any person, whatsoever. 27. Apart from the entitlement to the Prize, the Winner or his/her legal heirs will have no other rights or claims against the Organizer and / or Vodafone. 28. In case of any dispute or difference in respect of this Contest, the decision of Organizer shall be final and binding on all concerned. 29. These terms and conditions are governed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of courts in Gujarat.
30. If, in Gujarat Circle of Vodafone and/or territory or part thereof, the running of Caller Tunes contest is prohibited, the Subscribers from such Circle and/or territory or part thereof shall not be eligible to participate in Caller Tunes contest. No further notice shall be given by the Organizer, in this regard. 31. Participation in Caller Tunes contest implies acceptance of all the terms and conditions of Caller Tunes contest. Acceptance of the Prize by the Winner constitutes permission for the Organizer and its affiliates to click photographs of the Winner and use the Winner's name, photographs, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any additional compensation whatsoever
