A. APPLICABILITY The provisions hereof shall be applicable to those full time employees who have been excluded from representation by the Public Employment Relations Commission including, but not limited to the following: Department Heads (including Township Manager and Township Clerk), Deputy Township Manager, Executive Assistant, Director of Human Resources, Chief Financial Officer, Assistant Chief Financial Officer, Police Chief, Deputy Police Chief, Fire Chief, Deputy Fire Chief, Municipal Prosecutor, Municipal Judge, Senior Clerk, and MIS Specialist, as well as, those fulltime employees who are not included within a bargaining unit (hereinafter referred to as excluded employees ). B. HOURS OF WORK 1. Except as otherwise provided herein, or except if otherwise authorized by the Township Manager, the established hours of work for all excluded employees shall be thirty-five (35) hours in a work week of four or five (4 or 5) days. 2. The Deputy Fire Chief shall work a forty (40) hour work week, and those hours which may additionally be required to meet the needs of the Fire Department, as scheduled by the Fire Chief with the concurrence of the Township Manager. 3. The Deputy Police Chief shall work a forty (40) hour work week, and those hours which may additionally be required to meet the needs of the Police Department as scheduled by the Police Chief with the concurrence of the Township Manager. C. OVERTIME 1. Pursuant to the Federal Fair Labor Standards Act ( FLSA ) certain employees (hereinafter referred to as exempt employees ) in a managerial, supervisory, administrative, computer or professional positions are exempt from the provisions of the Act. There are also employees who may be exempt because their compensation exceeds $100,000 per year depending upon their job duties. Such exempt employees are not eligible to receive overtime compensation and are required to work the normal workweek and any additional hours needed to fulfill their responsibilities. Time off consideration for large amounts of additional hours may be provided with the Township manager s prior approval and at the sole discretion of the Township Manager. 2. Excluded exempt employees shall not be compensated for any overtime required in order for them to effectively discharge the duties of their position. 3

3. Excluded non-exempt employees shall be compensated for authorized work in excess of the standard thirty-five (35) hour work week in pay or compensatory time off at a straight time rate for the first five hours of such extra work in any week and at a time and one half rate for hours in excess of forty (40) hours in one week. 4. When an off duty excluded non-exempt employee is called back to duty outside of his/her standard daily work schedule, he/she shall be credited with a minimum of two (2) hours overtime. D. VACATION TIME 1. All excluded non-exempt employees shall be granted the following annual leave for vacation purposes, with pay. All excluded exempt employees shall be granted the following annual leave for vacation purposes, with pay. The Township Manager may grant a one-time allotment of up to ten days vacation, for excluded exempt employees who are hired from outside the organization. These 4

days will be available for use during the excluded exempt employee s first year of employment or as determined by the Township Manager. 4. Vacation leave may not be taken until the calendar year following the year in which earned. 5. Vacation leave of excluded exempt employees shall be requested in writing at least two (2 days in advance and approved by the Township Manager. Vacation leave of excluded non-exempt employees shall be requested in writing at least two (2) days in advance and approved by their Department Head. 6. Earned vacation may accumulate for no more than three (3) years of credit, except that excluded employees hired after September 1st, 1989 will be allowed to carry two (2) years vacation only. 7. Vacation time accumulated is forfeited if at least seven (7) days notice of intention to terminate employment is not given in writing, except that, the Township Manager may approve written notice of less than seven (7) days. 8. Vacation time for all excluded employees may be converted from days to an hour equivalent as necessary depending on operational needs. E. SICK LEAVE 1. Sick leave is defined to mean an absence from post or duty of any excluded employee because of illness, accident, exposure to contagious disease, or attendance upon a member of the excluded employee's immediate family seriously ill requiring the care or attendance of such excluded employee. Immediate family shall be defined as spouse, civil union partner, children, mother, father, brother or sister of the excluded employee, or of an excluded employee's spouse or civil union partner living as a permanent member of the excluded employee's household. 2. Each excluded employee shall in addition to his or her annual vacation leave with pay, be granted sick leave as hereinbefore defined, with pay, of not more than one working day for every month of service during the remainder of the first calendar year of service following appointment. New excluded employees shall receive one working day for the initial month of employment if they begin work on the 1st through 8th day of the calendar month and one-half (1/2) day if they begin on the 9th through the 23rd day of the month. In addition, thereafter, at the beginning of each calendar year, in the anticipation of continued employment, excluded employees shall be credited with fifteen working days. Sick leave may be converted from days to an hour equivalent as necessary depending on operational needs. If an excluded employee does not use all or a portion of their sick leave time, the amount of unused sick leave shall accumulate to the excluded employee s credit from 5

year to year, and such excluded employee shall be entitled to the accumulated sick leave, if and when needed. 3. An excluded non-exempt employee may charge to his/her sick leave a maximum of three (3) days each year for the purposes of attending funerals, weddings, religious days or other personal obligations not elsewhere provided herein. Any additional days are to be charged against vacation time. An excluded exempt employee, who is not eligible for overtime, may charge his/her sick leave a maximum of four (4) days each year for the purposes of attending funerals, weddings, religious days or other personal obligations not elsewhere provided for in these rules. Any additional days are to be charged against vacation time. 4. An excluded employee who has used all accumulated vacation and sick leave and who requires additional sick leave because of injury or illness not arising or resulting from employment with the Township may apply to the Township Council for consideration of extension of sick leave subject to the following limitations: a) Fifteen (15) additional days sick leave for excluded employees who have completed at least one and no more than fifteen (15) years of service. b) Forty-five (45) additional days sick leave for excluded employees who have completed at least fifteen (15) years of service. c) Such extension may be granted for each major injury or illness but not more than three times in the excluded employee's total service. 5. When an excluded employee does not report for duty for a period of greater than three (3) consecutive work days or totaling more than ten (10) work days in one calendar year because of sickness as defined above, he/she shall show proof of his/her inability to work by submitting to the Township Manager upon request, a certificate, signed by a physician in attendance, to the effect that the said excluded employee was not, on the date or dates leave is requested, physically able to perform any duty connected with his or her job. 6. Sick leave shall be charged in amounts of one-half (1/2) day for an absence on a work day of 2-4 hours, and a full day for over four (4) hours. F. BEREAVEMENT LEAVE 1. Excluded employees shall receive up to three (3) calendar days for death in the immediate family from the date of death up to and including the day of the funeral. Immediate family shall be as defined in as spouse, child, mother, father, brother or sister of the excluded employee or of the excluded employee s spouse living as a permanent member of the excluded employee s household. 6

2. All excluded employees shall receive one day off to attend the funeral of the excluded employee's grandparents or grandchildren. G. INJURED ON DUTY 1. In case an excluded employee is disabled, either through injury or illness as a result of or arising from employment, as evidenced by the certificate of a physician, the excluded employee shall be granted a period of up to thirty (30) days leave with full pay. Such thirty (30) day initial period shall be granted each time an excluded employee is disabled. Should further additional leave be necessary, because of accident or sickness incurred in the line of duty, it may be granted up to a total of one year by action of the Township Council. 2. Payments made to any excluded employee while on IOD (Injured on Duty) leave as compensation insurance shall be deducted from the amount to be paid the excluded employee by the Township, during each time he/she is carried on the Township's payroll. 3. All injury leaves shall terminate when the physician appointed by the Township or the Township Insurance Carrier reports in writing that the excluded employee is fit for duty. H. TERMINAL LEAVE 1. Terminal leave will be based upon 50% of the accumulated sick leave time for excluded employees who have completed twenty-five (25) years of service with the Township at the time of retirement. 2. For excluded employees who retire before completion of twenty-five (25) years of service or resign with at least fifteen (15) years of service, terminal leave will be based upon the ratio of their number of months of service to 300 months of service. 3. In case an excluded employee dies before retirement, the value of accrued sick leave will be paid to the excluded employee's estate on the basis of the terminal leave formula as hereinbefore explained. 4. This amount shall not exceed $15,000 for all excluded employees newly hired after September 1, 1989. 7

I. HOLIDAYS 1. All excluded employees shall receive the following holidays with pay or, if approved by the Township Manager, a day off in lieu of those indicated. New Year's Day Martin Luther King's Birthday Lincoln's Birthday Washington's Birthday Good Friday Memorial Day 4th of July Labor Day Columbus Day Veterans Day Thanksgiving Day Day After Thanksgiving Christmas Day 2. Excluded employees are required to work the last day prior to the holiday and the first work day following the holiday in order to be paid for the holiday, unless on approved leave on such days. 3. For any excluded employees operating on a four (4) day work schedule, if a holiday falls on a Friday, the excluded employee will be provided with a floating holiday to be scheduled prior to the end of the calendar year, with the approval of the Township Manager. J. HOSPITALIZATION AND LIFE INSURANCE 1. Excluded employees and their eligible dependents shall receive paid hospitalization, major medical and Rider J coverage with the State Health Benefits Plan of New Jersey, or its equivalent at the Township s option. 2. A beneficiary designated by the excluded employee shall receive $10,000 upon the death of an active excluded employee. 3. A beneficiary designated by an excluded exempt employee in the Police and Fire Departments, who die in the line of duty while employed with the Township of Teaneck, shall be entitled to an additional $5,000. K. TRAINING 1. The Township may assume the tuition cost of training courses taken by excluded employees of the Township, which, in the opinion of the Township Manager, are of benefit to the excluded employee and the Township. Such training courses shall be taken on the excluded employee's own time, unless otherwise authorized by the Township Manager. 8

2. Excluded employees must seek approval from the Township Manager prior to attending training courses for which they are seeking reimbursement. L. ABSENT WITHOUT LEAVE An excluded employee who is absent without approved leave for five (5) consecutive work days, shall be subject to dismissal in accordance with Civil Service Commission Rules and Regulations. M. DENTAL PLAN Eligible Township excluded employees and their eligible dependents shall receive a dental plan at Township cost. N. VISION CARE PLAN Excluded exempt employees who are not eligible for overtime, shall be provided, at Township expense, with a vision care plan as long as the Township participates in a vision care program. The plan shall be made available to the excluded exempt employee and their eligible dependents. O. MEDICAL BENEFITS ON RETIREMENT Department Heads, who do not receive any compensation/recognition for length of service to the Township of Teaneck, shall be eligible to receive paid medical benefits on retirement as follows: 1. The Department Head must retire with at least twenty-five (25) years of service to the Township of Teaneck; 2. The retired Department Head and their eligible spouse or civil union partner shall be covered until they are respectively eligible for Medicare or eligible to receive paid medical benefits from another source, whichever comes first. In no such case shall a Department Head s spouse or Civil Union partner be eligible for paid medical coverage once the Department Head is eligible for Medicare. Coverage shall cease for the spouse or civil union partner, at the expense of the Township, upon the death of the Department Head. 3. The effective date of this program is June 1, 2003, upon approval the NJ State Health Benefits program. 9

P. MANAGERIAL DAYS 1. The Township Manager may, in his/her discretion, award to excluded exempt employees time off without loss of pay in recognition of the annual additional hours worked by said excluded exempt employees. If awarded, such time off shall not accumulate from year to year and will be forfeited if not used. If awarded and not used, and an excluded exempt employee separates from service, no payment shall be made for such time off. 2. Nothing herein shall require the Township Manager to award said days nor infer entitlement of said days to any eligible excluded exempt employee. Q. ALLOWANCES AND STIPENDS 1. The following excluded employees shall be eligible to receive an annual clothing allowance equal to the amount received by their subordinate personnel: a. Fire Chief, Deputy Fire Chiefs. b. Police Chief, Deputy Police Chiefs. Specified active excluded employees, covered under these Rules and Regulations, may receive vehicle allowances, telephone allowances, tool allowances, and other stipends (i.e. licenses, education/certification recognition, etc.) as determined by the Township Manager and as provided for in the annual budget. Exclude employees who are on leave leading to retirement, or on an extended leave without pay, shall not be eligible for vehicle, telephone, tool or other allowances as described in this section and as may be provided for in the annual budget. 10
